O-242-53 ORDINANCE NO. 242 AN ORDINANCE ADOPTING THE PLAT OF MIRROR LAKE SUBDIVISION. BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1. That the proposed plat of "Mirror Lake Subdivision" being a replat of "Philbrick's Miami Shores Lake Subdivision, " recorded at Book 49, Page 39, of the Public Records of Dade County, Florida, be and the same is hereby adopted. Whenever the Chief of Police shall have knowledge of an unlicensed dog, the Owner thereof being know, he may give written notice to the Owner of such unlicensed dog, that unless a license shall be secured within five (5) days from the date of said notice and payment made of the regular license fee pre-requisite to the issuance thereof, the un- licensed dog shall be seized; any unlicensed dog so seized shall be impounded in the Dog Pound. The term "Dog Pound" as used herein, means the HUMANE SOCIETY OF GREATER MAIMI, Dade County, Florida, or any other quali- fied pound selected by the Village Council. Section 8. Any unlicensed dog, the Owner of which is unknown to the Chief of Police, or any dog running at large, within the provisions of Section 3. of this Ordinance, shall be seized by any Police Officer, or agent of the Humane Society, and shall be impounded in the Dog Pound. If the name and address of the Owner is known to the Chief of Police, notice shall be given to the Owner by mail, and if unknown, notice shall be given by posting same in a conspicuous place in the Village Hall. Notice to the Owner shall contain a description of the dog, the date impounded, and the advice that the dog will be sold or otherwise disposed of unless re-claimed and repossessed by the Owner within five (5) days from the date of mailing of such notice. Section 9. It shall be the duty of every Owner of a dog which is lost, strayed or stolen, promptly to notify the Chief of Police in writing, said notice to be delivered by mail or in person to the Chief of Police at the office of the Police Department in the Village Hall, and said notice shall contain a description of the dog, the date when lost, strayed or stolen, and the Owner's name and residence address. Section 10. The Owner of any impounded dog may reclaim and repossess said dog at any time within five (5) days after the impounding and upon payment to the Dog Pound of a fee of $1. 00 per day for the care and maintenance of the dog while impounded, and in the case of an unlicensed dog, upon obtaining a license for such dog as herein provided for. Section 11. If the Owner of any dog fails to reclaim such dog within five days from the date of impounding, the Dog Pound may cause said dog to be sold or otherwise disposed of, and in the event of sale, the proceeds of the sale shall first be applied to defray.the cost and care and maintenance of the dog while impounded, at the Dog Pound.' Section 12. Any dog that has bitten a person or persons within a period of fourteen (14) days prior to knowledge of such biting being brought to the attention of the Chief of Police, shall be seized and impounded by the Dog Pound and maintained therein for a period not exceeding fourteen (14) days; if, upon expiration of such fourteen day period the dog shall be living and not afflicted with rabies during this time, it shall be returned to the Owner thereof on the fourteenth day following quarantine. As an alternative quarantine, the Owner of the dog may designate a veterinary hospital to care for and maintain the dog during the fourteen day quarantine period. All charges for care and maintenance of such dog while in quarantine shall be paid by the Owner of the dog. Section 13. The seizure or keeping of a dog by any person, except by the true Owner thereof, shall be unlawful, and the unauthorized possession of a dog by such person or persons without first having reported such possession to the Chief of Police within a period of twenty-four (24) hours after the dog has come into the possession of the person holding the animal, shall be presumptive evidence of an intent to steal the dog. Section 14. Any person who shall keep or harbor or own any dog which engages in frequent or habitual barking, yelping or howling, or which is mean or vicious, and any person who shall refuse to deliver his dog to the Chief of Police when required to do so under the provisions of this ordinance, or any person who keeps a dog and who is cruel to such animal, -3- and any person who steals any dog or who abandons a dog, shall be deemed guilty of a misdemeanor and subject to the penalties provided for in this ordinance. Section 15. No person shall keep at his home in Miami Shores Village more than three (3) dogs which are over the age of six months. Section 16. Any person convicted of violating any of the pro- visions of this ordinance shall be punished by a fine not to exceed Five Hundred Dollars ($500. 00) or by imprisonment for a term not to exceed sixty (60) days or by both such fine or imprisonment, in the discretion of the Court. Upon the conviction of any person owning or harboring a mean or vicious dog, the Municipal Judge may order the Chief of Police to cause such dog to be humanely destroyed. Section 17. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 18. This ordinance shall be construed severally.
