O-215-50 ORDINANCE NO. 215 AN ORDINANCE TO PROVIDE REVISED BICYCLE REGULATIONS, VIZ. : ANNUAL INSPECTION, LICENSE TAG REQUIREMENT, REGISTRATION NUMBER, REGISTRATION CERTIFICATE, REGIS- TRATION CHARGE, FOR DISPLAY OF REGISTRA- TION NUMBER AND LICENSE TAG, SAFETY EQUIP- MENT, NOTICE OF TRANSFER OF OWNERSHIP, DISMANTLING OR DESTRUCTION, MAKING IT UNLAW- FUL TO REMOVE OR ALTER REGISTRATION NUMBERS OR LICENSE TAGS, AND CERTAIN OTHER SAFETY REGULATIONS; PROVIDING FOR THE PARTIAL IN- VALIDITY HEREOF,$ AND REPEALING ALL LAWS OR PARTS OF LAWS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE: Section 1. Yearly Inspection The owner of any bicycle operated on the streets of the Village or, in the case of a minor, his parent or guardian, shall present the said bicycle once every year, at a time and place designated by the Chief of Police, for the purpose of having it inspected, registered, and having a license tag issued by the Police Department. Such registration shall be renewed each year in the same manner and upon the payment of the same fee as provided for in the original registration. The registration or renewal shall begin on September lst of every year and take effect on January Ist of �very year thereafter. Section 2. License Tag Required - A.11 bicycles operated on the streets of the Village shall be registered and bear a license tag as hereinafter provided. The Police Department shall install and maintain adequate records showing the name and address of the owner of each bicycle operated on the streets of the Village, the trade name under which the bicycle is known and sold, the manufacturer's serial number, the registration number, and the license tag assigned to such bicycle by the Police Department, as hereinafter provided, and such other information re- lating to said bicycle, or to the owner thereof, as the Chief of Police may deem advisable. Section 3. Registration Number - An original registration number shall be assigned to each bicycle registered by the Police Department and shall be the number of the bicycle for its entire life. The said registration number shall be stamped upon the bicycle frame in one or more places as determined by The Chief of Police. Section 4. Registration Certificate- At the time of the registra- tion of a bicycle the Police Department shall issue to the owner thereof a registration certificate, setting forth the owner's name and address, the trade name of the bicycle, the manufactnrer's serial number, the license tag number, and the registration number assigned thereto and placed thereon, and such other information as the Chief of Police may prescribe. Each such registration certificate shall have printed thereon a form to be executed by the registered owner in the event that the bicycle described thereon shall be sold. Such form shall make provision for the entry of the name and address of the new owner, and the registered owner, at the time of the sale thereof, shall fill out the said form and deliver the registration certificate to the Police Department, which, in turn, shall issue a new registration certificate t, o the new owner. Section 5. Registration Charge - The Chief of Police is hereby authorized and directed to charge a fee of twenty five cents (25�) for the license tag, and all such fees shall from time to time be delivered or paid to the Village Clerk to be deposited in the general fund of the Village. Section 6. Display of Registration Number and License Tag - The registration number and license tag assigned to a bicycle and placed thereon by the Police Department, as hereinbefore provided, at all times shall be dis- played thereon and shall not be removed except by a member of the Police Depart- ment, unless the use of said bicycle shall be permanently discontinued. The license tag shall be attached to the rear portion of the bicycle so as to be plainly visible from the rear, and securely fastened so as to remain stationary. It shall be unlawful for any person to operate any bicycle, irrespective of the ownership thereof, on the streets of the Village unless, at the time of such operation, the said bicycle shall have thereon a registration number and license tag, as here- inbefore stated, the same having been previously assigned to and placed upon such bicycle by the Police Department. Section 7. Bicycle Safety Equipment- All bicycles operated upon the Village streets shall be equipped with a brake in good working order and other safety equipment as the Chief of Police may require. -2- All bicycles operated upon the streets of this Village in the night time shall be equipped with one or more front white lights and one or more rear red lights or reflectors, clearly visible for a distance of not less than 100 feet. Section 8. Notice of Transfer of Ownership - Within forty-eight hours after the purchase of any new bicycle, the owner thereof shall register the bicycle at a place designated by the Police Department. Within forty-eight hours after the sale of any registered bicycle, the former owner shall return the regis- tration certificate to the Police Department, which shall, in turn, issue a new registration certificate to the owner. Section 9. Bicycles Dismantled or Destroyed - In the event that a registered bicycle shall be dismantled or destroyed, or its use be permanently discontinued, the registered owner thereof shall report such fact immediately to the Police Department by returning the registration certificate witha proper notation of discontinuance thereon or otherwise in writing. Section 10. Removal or Alteration of Serial or Registration Numbers or License Tags It shallbe unlawful for any person to purchase, receive, possess, conceal or otherwise acquire, have or dispose of any bicycle, bicycle part or bicycle accessory on which the manufacturer's serial number or the regis- tration number or the license tag shall have been destroyed, removed, defaced, or otherwise mutilated or altered. Every person who has knowledge that the manu- facturer's serial number or the registration number or the license tag herein provided for shall have been destroyed, removed, defaced or otherwise mutilated or altered, shall immediately notify the Police Department of all the pertinent facts and circumstances within such person's knowledge. In the event of loss, mutilation or destruction of a license tag, the owner of a registered bicycle may obtain a duplicate thereof from the Police Department, making the facts known to the Police Department, and upon the payment of a fee of twan#_4i;-ve cents (25�). Section U. Bicycle Safety Regulations - (a). The operator of a bicycle, when upon a Village street, shall not -3- carry a person upon the handle bars, frame or luggage rack, of any such vehicle, nor shall any person so ride upon any such vehicle. (b) No person shall ride a bicycle without having his hands upon the handle bars. (c) Any person riding upon any bicycle shall not attach the same or himself to any public conveyance or moving vehicle upon any roadway. (d) Auy person riding a bicycle on the streets of the Village shall ride with moving traffic, as far to the right as possible. (e) Bicycle operators shall conform to all other ordinances pertain- ing to vehicular traffic. (f) During school days, school children will be permitted to ride bicycles to and from school, within any sidewalk area in the Village, outside of the business zone as defined by Ordinance #92, during the hours of 7:30 to 9:00 o'clock A.M. , and 3:00 to 4:30 o'clock P.M. Section 12. If any section, part of section, paragraph, sentence or clause of this ordinance shall be adjudged by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of any other portion hereof, but shall be restricted and limited in its operation and effect to that specific portion hereof involved in the controversy in whick such decision shall have been rendered.
