O-214-50 ORDINANCE No, 23J+ AN ORDINANCE TO PROVIDE THAT NOISES EMANATING FROM COMMERCIAL BUILDINGS OR PRUISES, BARBE- CUES, SOFT-DRINK ST�ANDS* RESTAURANTS OR VEHIC- LES SHALL NOT BE AUDIBILE A DISTANCE OF ONE HUNDRED FEET FROM THE PLACE OF EMAKALTIONO AND REPELLING ALL LLWS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE VILUGE COUNCIL OF THE VILLAGE OF MIAMI SHORES, FLORIDA, as follows: Sectlon 14, It shall be unlawful for any person own- Ing, occupying or having charge of any building or premises, on which any commercial business is transacted, including but not limitbd to barbecue, restaurants and soft-drink stands� at any time to cause or suffer or allow any loud, unnecessary, excessive or unusual noises in the operation of any radio, phonograph or other mechanical sound-making device or instrument, or reproduo- Ing device or instrument, or in the playing of any band, orches- tra, musician or group of musicians, where the noise or music is plainly audible at a distance of one hundred (100) feet from the building, structure, vehicle or premises in which., or from which,, it is produced. The fact that the noise or music is plainly audible at a distance of 100 fq9t from the vehicle or premises from which it originates constitutes prima facie evidence of a violation of this Ordinance. Seation 2: Violation of this Ordinance shall be pun- ished by a fine not exceeding /& a Dollars or imprisonment not exceeding -30 days, or both, in the discretion of the Court. Section 3: This Ordinance shall take effect Immediate- ly upon its passage and adoption, Section All ordinances or parts of ordinances in conflict herewith are hereby repealed.
