AN ORDINANCE DEFINING COMMUNISM., EXPRESSING A CLEAR
AND PRESENT DANGER THEREFROM AND FIXING PENALTIES FOR
THE ADVANCEMENT THEREOF.
WHEREAS the government of Miami Shores Village, Florida is estab-
lished under the authority of the State of Florida; and
WHEREAS the State of Florida is itself constituted on the fundamental
basis that justice be established, public order maintained and liberty perpetuated;
and
WHEREAS the tenets of the political ideology known as Communism
including enforced rule by one political party of state socialism. with its attend-
ant practices of supremacy of the state, suppression of individual rights and
support of atheism are opposed,, hostile and repugnant to,, and destructive of., our
expressed basic foundations; and
WHEREAS Communism as herein defined constitutes a clear and present
danger to our Democracy; and
WHEREAS Miami Shores Village,, Florida is chargeable with the responsi-
bility of preserving the individual rights guaranteed by the Constitution of the
State of Florida, the Constitution of the United States of America and our Declar-
ation of Independence, now therefore
BE IT ORDAINED BY MIAMI SHORES VILLAGE., FLIDRIDA AS FOLLOWS:
SECTION 1. Hereafter it shall be unlawful for any person,, group of
persons or corporation, either singly or collectively,, to promote., advocate,
support, encourage, advertiseo disseminate or otherwise advance either by words,
signs, gestures, writings, pictures or other form of communication the political
ideology known as Communism as herein defined.
SECTION 2. Any person guilty of violation of any provision of this
ordinance shall be punished by a fine of not more than $500.00 or by imprisonment
for not more than 180 days or by both such fine and imprisonment.
