O-201-49 ORDINANCE NO. 201 AN ORDINANCE REGULATING THE TRANSPORTATION OF SCHOOL CHILDREN WITHIN THE LIMITS OF MIAMI SHORES VILLAGE. BE IT ORDAINED BY MIAMI SHORES VILLAGE: Section 1. That from arid af ter the enactment of this ord inance it shall be unlawf ul f or any person., f irm or c orpor- ation to transport for hire or consideration any school child- ren to or from school or any school activity within the limits of Miami Shores Village unless such person., firm or corporation be licensed by Miami Shores Village for the transpoitttion of school children. Section 2. Any person, firm or corporation desiring to be licensed by Miami Shores Village shall make application to the Village manager for such a license and submit for inspection the equipment proposed to be used and operated by such licensee. If the equipment measures up to the standards prescribed by this ordinance and chapter 234, Florida Statutes Annotated, 1941, then the Village manager diall certify compliance by the proposed licensee to the Village Council who shall thereupon Issue or re- fuse a certificate of public convenience ard necessity, if, in the opinion of the Council the issuance of such a certifica�e is warranted . The Village Council in its certificate shall specify the routes to be traveled by the licensee and the period of ser- vice. Any certificate herein granted by the Village Council shall be revokable at the will of said Council. Section 3. All transportation equipment shall be of such construction as will meet the requirements of Section 234.08, Florida Statutes Annotated, 1941, and the equipment so used shall be limited to the transport of not more than 20 pupils at any one time and shall be constructed, maintained and operated in accord- ance with all requirements of law and the regulations of the State Board relating to school busses. Section 4. Any person, firm or corporation licensed by Miami Shores Village to transport school children to or from school or any school activity shall be required t o carry not less than $50,000 liability insurance f or bodily injury to any one child and not less than $100.,000 for bodily injury in any one a cc id ent 9 and $5.000 property damage. Section 5. Each school bus driver shall be specially licensed by the Village and shall possess the qualifications prescribed by Section 234.14, Florida Statutes Annotated, 1941. Upon sufficient evidence that the holder of the license does not fulfill all of the qualifications required by the State Law for a school bus driver, said license may be revoked by the Village Council. Section 6. Each school bus shal.1 be operated in conform- ity with all the rules of the road duly established by law and shall observe all traffic requirements for the route over which it travel s a nd ah al 1 b e brought to a full stop bef ore cross ing any railroad track and before entering or crossing any arterial highway or dangerous thoroughfare and until the driver has clearly observed tkxt it is safe to proceed . Section 7. The Village manager shall designate a physician or physicians to examine and report the physical condition of bus drivers in accordance with the regulations of the State Board of Education and the procedure prescribed by the State Superintendent for tim examination of bus driverS . This examination shall be required of all bus drivers every six months., and a certificate of such examination filed with the Village manager. This ordinance shall become effective immediately upon its passage and approval and all laws or parts of laws in conflict here- with are hereby repealed .
