AN ORDINANCE OF MIAMI SHORES VILLAGE.. FLORIDA,
REGARDING THE BUSINESS OF RENTING AUTOMOBILES
COMMONLY KNOWN AS "YOU-DRIVE-IT" BUSINESS9
AND PROVIDING PENALTIES.
BE IT ORDAINED BY MIAMI SHORES VILLAGE:
SECTION I* From the date of the passage of this
ordinances it shall be unlawful for anyone to engage in the
business of renting automobiles to others without having ob-
tained a license so to do from the Village Manager of said
village*
SECTION 2. Before such license shall issues an
application shall be made which shall state the name of the
person to whom such license is to be issued, the street address
in Miami Shores Village at which the business shall be operated
and the number of automobiles which the applicant proposes to
use in such business, In the event the application is made in
the name of a partnership, the names of all partners shall be
stated, and if in the name of a corporation, the officers$
directors and stockholders thereof shall be stated,
SECTION 3. No such license shall be issued until
the applicant pays to Miami Shores Village a license fee in the
sum of Two Hundred ($200.00) Dollars, together with the sum of
Ten ($10*00) Dollars for each automobile used in such business.
SECTION 4. At the time of the making of said applica-
tion, applicant shall submit to the Village Manager sufficient
evidence that the applicant has a suitable place in an enclosed
building in the Village in which the automobiles so used shall
be kept, provided that in lieu of an enclosed buildings the
applicant shall furnish such evidence to the Village Manager
that he has available within said village a place which need
not be enclosed in which he can keep not more than three
automobiles.
SECTION 5. Licenses issued hereunder shall expire
on the last day of October of each year, and all licenses, taxes
or fees imposed hereunder shall be payable on or before the lst
day of November of each year, Such licenses may be transferred
with the approval of the Village Manager, provided that there
is a bona fide sale and transfer of the business in which the
transferror is engaged and of the property used in said business.
No such license shall be issued to anyone who is not the owner
of the automobi les specified in the application, and a transfer
of the title to such automobiles shall operate to r evoke the
license so issued.
SECTION 6. The Village Manager is authorized to re-
quire all persons licensed hereunder to affix suitable stamps
to be provided for by said village to the automobiles so to
be used in such business which label shall contain such infor-
mation as may be required to be placed thereon by the Village
Manager; and in addition theretos the Village Manager may require
of the perscn to whom said license is issued that he shall have
every automobile used in said business inspected not morxa than
once a month by some employee of Miami Shores Village for the
purpose of ascertaining whether or not the automobile so inspected
is in a satisfactory mechanical condition to be operated safely
on the streets of said villageg
SECTION 7. At the time of the making of the application
for the licenses herein provided fory applicant shall furnish to
the Village Manager satisfactory evidence that there has been

issued to such applicant by an insurance company authorized
to do business in this state a public liability insurance
policy covering each automobile which is to be operated by
said applicant within the limits of Miami Shores Village, which
policy insures the owner and operator of each of such automobiles,
or either of thems against loss from liability resulting from
the operation of such automobile or automobiles in the amount
of $5,000.00 for bodily injury to or death of one person, and
subject to said limit as respects bodily injury to or death of
any one person, the amount of $10,000.00 on account of bodily
injury to or death of more than one person in any one accident, and
$5,000.00 for damage to property of others occurring in any one
accident. Said insurance policy shall be maintained in full
force and effect during all times that the applicant is engaged
in such business and a failure so to maintain said insurance
policies shall constitute a violation of this ordinance and cause
the license theretofore issued to such applicant to cdase and
expire of its own force*
SECTION 8. Anyone who shall engage in the business
of renting automobiles to others in Miami Shores Village without
having first complied with all provisions of this ordinances or
who shall make any false statement on any application for license
hereunder, and anyone who thereafter violates any of the terms
hereof. shall, upon conviction, be fined not more than
or imprisoned not exceeding A::�2 —days* or both. In
the event that such violation is occasioned by an act of a servant,
agent or employee of the applicant, such servant, agent or employee
shall be subject to the penalties hereof and in addition thereto,
if acting within the scope of his employments whether dirdetly
authorized by the applicant or not, such applicant shall also be
subject to the penalties hereof.
SECTION 9. Should any part of this ordinance
be held invalid, the remainder shall not be affected thereby,
SECTION 10. This ordinance shall become effective
upon its passage and approval as provided by law,
