AN ORDINANCE TO PERMIT CITIZENS OF MIAMI
SHORES VILLAGE TO KEEP CHICKENS ON THEIR
PREMISES WITHIN THE VILLAGE LIMITS FOR
THE DURATION OF THE PRESENT WAR: PROVIDING
FOR SECURING PERMITS; PROHIBITING THE SALE
OF CHICKENS AND PROVIDING THAT NO NUISANCE
SHALL BE CREATED BY NOISE., UNSIGHTLINESS OR
UNCLEANLINESS: AND DECLARING AN EMERGENCY
TO EXIST.
WHEREAS., the United States is in a second world conflict.,

WHEREAS, the Federal Government has declared the possibil-
ity of a national food shortage, and has urged that every citizen provide
as much of his own food as possible including the raising of poultry and
the production of eggs, and
WHEREAS, Miami Shores Village has prohibited the keeping of
poultry within its municipal boundaries during normal conditions, and
WHEREAS, a large number of citizens, if not a great majority,
axe desirous of helping to produce food by keeping and raising chickens
for their own use.,
NOW9 THEREFORE.. BE IT ORDAINED BY MIAMI SHORES VILLAGE:
Section 1. For the duration of the present war the Village Manager may
issue permits to residents of Miami Shores Village permitting the keeping
on any one parcel of ground used primarily for a home., of not more than
twelve (12) hens together with not more than twenty-four (24) growing chickens,
( but roosters are strictly prohibited ) where such hens and chickens are to
be used exclusively for the owners and their families, and not for commercial
purposes.
Section 2. Such permits may be secured at the Village Office upon written
application therefor,, under oath., in which the applicant states that he or she
has read this ordinance and agrees to remove all poultry and equipment used
to house the same immediately upon the repeal of this ordinance. No permit
shall be issued until the Village Manager has cau' sed an inspection to be made
of the premises upon which the poultry is to be kept and the same are found to
comply with the requirements of this ordinance.

Section 3. All poultry permitted mLwt be kept enclosed within
yards., coops and pens which shall be maintained in a clean.. sanitary., and
sightly condition at all times., and subject to such reasonable rules and
regulations as the Village Manager may from time to time prescribe.
Section 4. The Village Manager is authorized and empowered to
cause inspections to be made from time to time to see that the provisions
of this ordinance are being complied with. , He is authorized to revoke
any permit immediately upon discovering a violation of any of the provisions
of this ordinance and to send written notice to the applicant for the per-
mito' of such revocation. Provided written notice of intention of doing
so is delivered to the Village Office within forty-eight (48) hours of
such revocation, the holders of the permit may appeal to the Village Coun-
cil to have such revocation set aside.
Section 5. Any person keeping poultry within the limits of Miami
Shores Village without a permit therefor beginnin thirty (30) days after
the adoption of this ordinance shall be subject to a fine of One ($1.00)
Dollar, for each day that poultry is kept without a permit., by the Village
Court., together with the costs of court.
Section 6. This. is an emergency ordinance and is to remain in force
only during the existence of the emergencyp nam ly the food shortage caused
by the present war and immediately upon the termination of this war,, this
ordinance shall immediately become null and void.
