BE IT ORDAINED BY MIXja SHORZS VILLAGE:
SECTION 1. There is hereby created Miami Shores Village
Recreation Department which shall be operated and maintained by
the office hereby created of Director of Recreation of Miami ' Shores
Village and that said Department of Recreation shall have authority
and control and supervision over all play grounds, atheletic and
public activities in the Village , shall maintain and operate the
Conmunity House and Recreation Hall and maintain in a proper
way said Comunity Hall in such manner as may be suitable to
the Village Council.
SECTI017, 2. That the Director of Recreation shall be recom-
mended by the Village Manager and appointed by the Village
Council to serve subject to the pleasure of the Council, said
Director shall be fully and properly qualified to perform the
duties of such position and shall maintain and operate the Recrea-
tion Department in the best possible manner for all of the citizens
of the Village, and shall have such help and assistance as the
Council frcm time to time may authorize. The Director of Recrea-
tion shall be under the direct supervision of the Village 11anager
and shall be directly responsible to him for the functions of his
Department, and said Village Manager may require of and from
said Director periodical reports as to the conduct of said
Departments and such reports shall in turn be submitted to the
Council for its information and such action thereon as may be
necessary*
SECTION 3. The Community House and play grounds of the
Village shall be used only by the Village residents. Exceptional
or special use of the Cormiunity House for such functions as parties,
dances or benefit gatherings held by private associations or groups
shall be had only after application in writing has been made to the
Director of Recreation setting forth the purposesfbr which the
use of said property shall be put, and after due investigations
that all requirements have been fully complied with,such special
permit or license shall be granted by the Director, except in
eases for unusual use of said premises shall always be referred
to the Village Manager for final action thereon, and his decision
shall be conclusive , provided however, that the party. interested
therein may appeal to the Council for revision or modification
of the decision of the Village Manager. No use or permit of said
premises shal"I be granted to any person, firm, corporation or
organization for personal profit or gain, nor for charitable pur-
poses, except where the function for charitable purposes is for
the public welfare of the citizens of andMiami Shores Village.
The Director of Recreation may initiate and hold functions in
said Community Hall and parks and play grounds of the Village
that may incur expenses for professional services for entertainers,
artists , musicians or otherwises and in so doing occasion the
necessity of charging admission to pay for such services, subject
to the approval of the Village Managers and in all such cases all.
moneys collected therefor shall be paid into Miami Shores Village
for deposit in the general funds of the Village, and all such
expenses incurred shall be paid out of such funds so received by
Village by its check, provided however, that in no event shall
the Director of Recreation., Village Manager, nor any one connected
with the operation of the Department of Recreation be authorized
to obligate the Village for any function or functions held in said
premises, and that any contracts or agreements made and executed
by the Department of Recreation or the Village Manager for such
functions shall be paid only out of the revenue of such particular
function., provided however, the Council may, if it shall so desire,
underw ite or guarantee payment of the expenses of any functions
which may be held in said Community Halls play grounds or parks
of -the Village.
SECTION 4. That the Director of Recreations' subject to
the approval of the Village Manager, may accept and require a
charge of and from those using the Community Hall sufficient in
amount to pay for the expense of opening and closing, said property
including lighting, water, janitor and other expenses in connection
therewith.
SECTION 5, That the Director of Recreation, subject to the
approval of the Village Manager be, and he is hereby directed
and authorized to promulgate such other and further rules and
regulations pertaining to the use of the property herein described
as may be most beneficial to the property thereof, and upon the
adoption of such rules and regulations the same shall be presented
to the Council for such action as the Council may take concerning
the same.
SECTION 6. That the Recreatioji Department., Director of
Recreation and the. Village Managerq� , nor neither of them shall
have authority to obligate the Village for the expenditure of
any funds in connection with the premises herein described, with-
out first procuring the approval and consent of the Council for the
same*
SECTION 7* Each word, phrases sentence or section of this
ordinance shall be severable and the invalidity of any word,
phrase, sentence or section shall in no way or degree impair
any other part or parts thereof.
SECTION 8. All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION 9. This ordinance shall be effective immediately
upon its passage.
