O-80-39 MIAMI SHORES VILLAGE ORDINANCE NO. AN ORDINANCE AMENDING MIAMI SHORES VILLAGE ORDINANCE NO. 52, ENTITLED: "AN ORDINANCE ADOPTING A UNIFORM PLAN FOR THE SAFE AND HARMONIOUS DEVELOPMENT OF MIAMI SHORES VILLAGE, ESTABLISHING BUILDING ZONES AND REGU- LATING THE NATURE AND CONSTRUCTION OF BUILDINGS WITH REFERENCE THERETO; AND DECLARING AN EMERGENCY TO EXIST n BY AMENDING AND CHANGING THE PROVISIONS OF BUILD2NG ZONES tngn AND nIn OF SECTION 2 THEREOF, BY PROVIDING THAT CERTAIN PROPERTY BE EXCLUDED FROM SAID ZONES "Hn AND nl", AND THAT SAID PROPERTY SO EXCLUDED BE ZONED FOR SCHOOLS, COLLEGES, WHETHER SECTARIAN OR NON-SECTARIAN, AND AUTHORIZING THE ERECTION OF BUILD- INGS THEREFOR. WHEREAS, the erection, operation and establishment of a female college or school with all usual appurtenances thereto may be located within Miami Shores Village upon the property hereinafter described, and WHEREAS, such college or school, sectarian or non-sectarian, will be of great value to the Village and citizens thereof, and WHEREAS, it is necessary for the erection of such school or college that the Zoning Ordinance of said Village be amended so that the same can be erected, maintained and established,, and WHEREAS, the Planning Board of said Village has by formal resolution .approved and recommended rezoning of said land hereinafter described, and WHEREAS, such rezoning will not conflict in any wise with the general plan of the development of said Village, but will assist and aid the proper development thereof. NOW THEREFORE, BE IT ORDAINED BY MIAMI SHORES VILLAGE: SECTION 1. That Miami Shores Village Ordinance No. 52, entitled: "An Ordinance Adopting a Uniform Plan for the Safe and Harmonious Development of Miami Shores Village, Establishing Building Zones and Regulating the Nature and Construction .of Buildings with Reference Thereto; and Declaring an Emergency to Exist". be amended to be and read as follows: That the following described property located in building zone nHn, to wit: The Wiest one hundred and twenty-five (125) feet of the Southeast one-quarter (SEJ) of the Northeast one- quarter (NEI) of Section 36, Township 52, Range 41 East, be, and the same is hereby excluded from the operation of Building Zone "Hif, and the terms and provisions of said Miami Shores Village Ordinance No. 52, with respect thereto. That the following described property located in building Zone "Itt, to wit: 411 of the Southeast one-quarter (SE4) of the Northeast one-quarter (NEI) of Section 36, Township 52, Range 41 East, save and except the Fest one hundred and twenty-five (125) feet thereof, be, and the same is hereby excluded from the operation of building zone "Ip, and the terms and provisions of said Miami Shores Village Ordinance No. 52, with respect thereto. SECTIO' 2. That said property above described so excluded from the effect of said Miami Shores Village Ordinance No. 52, and building zones "Hs and "I". thereof, and the use thereof be restricted solely for use of schools, colleges, and institutions of learning,, whether sectarian or non-sectarian. SECTION 3. That the use of said property herein described for educational purposes and all buildings which may be erected thereon shall be submitted to the Planning Board of said Village and the Council thereof, and that before said property can be put to the use herein designated approval thereof must first be had an4 obtained from said Planning Board and the Village Council upon such terms, conditions and qualifications as may be determined by said Planning Board and' said Village Council. SECTION 4. Each word, phrase, sentence or section of this ordinance shall be severable and the invalidity of any word, phrase, sentence or section shall in no way or degree impair any other part or parts thereof. SECTION 5. AU ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 6.
