O-37-36 MIAMI SHORES VILLAGE ORDINANCE AN ORDINANCE AMENDING MIAMI SHORES VILLAGE ORDINANCE NO. 119 ENTITLED "AN ORDINANCE ZONING THE VILLAGE AS TO USES OF LAND AND BUILDINGS AND RELATING TO INTERPRE- TATION AND ENFORCEMENT OF THE ORDINANCE".9 AS AMENDED BY MIAMI SHORES VILLAGE ORDINANCE NO. .26.,ENTITLED: "AN ORDINANCE EXCLUDING THE SOUTH ONE-HALF OF LOT 5 AND LOT 6p IN BLOCK 59p MIAMI SHORES SECTION 2. PLAT BOOK 10,9 PAGE 37., FROM THE EFFECT AND OPERATION OF MIAMI SHORES VILLAGE ORDINANCE NO. llp ENTITLED: "AN ORDINANCE ZONING THE VILLAGE TO USES OF LANDS AND BUILDINGS AND RELATING TO INTERPRETATION AND ENFORCE . MENT OF THE ORDINANCE".. AND ADOPTING PROCEDURE FOR PROCUREMENT OF LICENSE FOR -USE AND OCCUPANCY OF THE SAMEIVAS AMENDED BY MIAMI SHORES VILLAGE ORDINANCE NO� ENTITLED: "AN ORDINANCE AMENDING SECTION 3. OF MIAMI SHORES VILLAGE ORDINANCE.#ll ENTITLED: "AN ORDINANCE ZONING THE ViLLAGE AS TO USE9 OF LANDS AND BUILDINGS AND RELATING TO INTERPRETATION AND EN- FORCEMENT OF THE ORDINANCE"p BY EXCLUDING CERTAIN PROPERTY FROM SAID ZONE AND MAKING SAID PROPERTY SO EXCLUDED A PART OF AND SUBJECT TO THE RESTRICTIONS AND PROVISIONS OF ZONE 3 AS PROVIDED IN MIAMI SHORES VILLAGE ORDINANCE #11 AS AFORESAID" PROVIDING FOR THE AMENDMENT AND MODIFICATION OF THE PROHIBITION CONTAINED IN SECTION 9 OF SAID MIAMI SHORES VILLAGE ORDINANCE NO. 11,9 AS AFORESAIDp REDUCING THE RESTRICTION FOR THE ERECTION OF BUILDINGS IN ZONE 3 AS DESCRIBED IN SAID ORDINANCE AS AFORESAID FROM NOT LESS THAN TEN FEET FROM THE SIDE LINE OF ANY LOTS HEREINAFTER DESCRIBEDp THE SAME BEING -A PORTION OF SAID ZONE THREE AS AFORESAID. BE IT ORDAINED BY MIAMI SHORES VILLAGE: SECTION 1. That the provision contained in Section 9 of Miami Shores Village Ordinance No. 11., entitled: I'An ordinance zoning the Village as to-uses of land and buildings and relating to interpretation and enforcement of the ordinanceup prohibiting the erection of buildings not less than ten feet from any side line, excepting building for any accessory uses on any lots in Zone 3,, as described therein, is hereby modifiedp amended and changed to prohibit the erection of any building not less than five feet from any side line excepting buildings' for any accessor'y,)uses in said Zone 3 as aforesaid, and as hereinafter provided,, said modificationp amendment and cbange to be applicable only to the property hereinafter described. SECTION k. That this amendment and modification of the pro.- visions contained in Section 9 of said Miami Shores Village Ordinance No. llp as aforesaidq shall be applicable only to the following described property located within the Village.' to wit: Beginning at the northeast corner of Northwest Ninenty- ninth Street and Northwest First Avenue; thence east along the north line of said Northwest Ninety-ninth Street to the Northwest corner of Northwest Ninety-ninth Street and Miami Avenue; thence North along the west line of said Miami Avenue to the Southwest corner of Northwest One hundred and third Street and said Miami Avenue; thence west along the south line of Northwest One hundred and third Street to the south- east corner of said Northwest One hundred and third Street and Northwest First Avenue; thence 'south along the east line of said Northwest First Avenue to the Northeast corner of said Northwest First Avenue and Northwest Ninety-ninth Streetp the point of beginning. SECTION 5. All other provisions and restrictions contained in said Section 9 of said Miami Shores Village Ordinance No. Up as aforesaid., and all other' provisions and restrictions contained in said Miami Shores Village ordinance No. Up as aforesaids shall remain in full force and virtue and effectsanything herein to the contrary notwithstanding. SECTION 4. Each word, phrases sentence or section of this ordinance shall be severable and the invalidity of any words phrasep sentence or section shall in no way or degree impair any other part or parts thereof* SECTION 5. All ordinances and parts of ordinances in conflict. herewith are hereby repealed. SECTION 6. That an emergency exists for the protection of the public welfares life and property. SECTION 7.
