AN ORDINANCE PROVIDING FOR THE OWNERS OF ALLLANDSv PARCELS AND TRACTS OF LAND-WITHIN MIAMI SHORES VILLAGE TO KEEP THE SAME FREE FROM SURPLUS GRASS, RUBBISH,, TRASH.. TO FILL ALL EXCAVATIONS AND DEPRESSIONS.9 ' PRO- VIDING FOR PENALTY FOR VIOLATION OF SAME AND FOR NOTICE TO PLACE SUCH LANDS., PARCELS AND TRACTS OF LAND IN GOOD CONDITION AND UPON FAILURE OF SUCH OWNERS TO COMPLY THEREWITH PROVIDING FOR THE VIL LAGE TO RE- MOVE ALL SURPLUS GRASSj, TRASH.9 RUBBISH,* TO FILL ALL EXCAVATIONS AND DEPRESSIONS THEREON AND PROVIDING THAT COST OF THE SAME TO THE VILLAGE SHALL BE AND BECOME A LIEN UPON SUCH PROPERTY AND PROVIDING FOR THE MAINTE- NANCE OF SEPARATE BOOKSAND FILES FOR -THE SAME. WHEREASO the condition of the lotsj tracts and parcels of land within the Village present an unsightly appearance and consti- tute an unsafe condition and a definite fire hazard,, and WHEREAS., the removal of all- surplus grass., rubbish,, trash., and the filling of all excavations and depressionso from all lots, parcels and tracts of land within the Village will materially aid the appearance of the entire Village and will reduce to a great extent the unsafe and condition of the same/ eliminate to a great degree the danger from f ire theref rom., theref ore BE IT ORDAINED BY MIAMI SHORES VILLAGE: SECTION 1. That it is the duty of all owner or owners of lots, parcels and tracts of land within the Village to keep said prope rty in a safe, clean and presentable condition and to remove therefrom all surplus grass' weeds and other growth and all trash and rubbish and to fill in all excavations and depressions thereon. SECTION 2. In the event the owner or owners of lots, tracts or parcels of land within the Village fail or refuse to keep such property in a safe, clean and presentable condition as hereinabove provided, it shall be the duty of the Village Manager to give notice as hereinafter provided to the owner or owners of such property to comply with the requirements of this ordinance within ten (10) days after the service of such notice. SECTION 3. Violation of any portion of the foregoing sections shall be punished by a fine not exceeding the sum of Fifty dollars ($50.00) or by imprisonment not exceeding ten (10) days in jail or by both fine and imprisonment in the discretion of the Village Judge. SECTION 4. The � Village Manager shall give said notice to the owner or owners of said-property at their last known mailing address office as disclosed by the files in the Village/or upon any occupant thereof, or upon any agent or employee of the owner or owners thereof,, and if the address of the owner is unknown to the Village Manager and if the property be unoccupied.,and the owner or owners thereof have no agent or employee available for service of such notice., the posting of a notice upon saidproperty by the Village Manager shall constitute and be sufficient notice to the owner thereof. All methods of giving notice as provided for herein are cumulative and independent of the other and the Village Manager may use one, or all of the same as he may deem necessary* Proof of service of such notice shall be made by affidavit of the Village Manager and filed in the records of -the Village as hereinafter provided. SECTION 5. In the event the owner or owners of such lots, parcels or tracts of land as hereinabove mentioned shall fail to remove therefrom all surplus grass., weeds,,, trash and -rubbish and refuse to fill in a32 excavations and depressions thereon after notice has been given by the Village Manager as aforesaid, the Village may cleansaid lot, tract or parcel of land and place same in a safe and presentable condition and the Village Manager shall keep an itemized list of ex- penses of the same and the costs thereof shall thereafter and therefrom become a lien and charge against the said property payable at the same time as the general Village taxes on said property become due and,,,ilp--on fail- ure to pay the amount of said lien as aforesaid the Vil e may ,have recourse to all remedies which may exist in Its favo for the ' enforde- ment thereof by virtue of its charter and ral laws -of theState of Florida appertaining thereto, and if said amount so expended by the Village as aforesaid be not paid at the time as herein provideds the same shall bear interest at the rate of 6% per amum until paid. SECTION 6.
