AN ORDINANCE ADOPTING THE BUILDING RESTRICTIONS
OF EACH AND EVERY THE SUBDIVISIONS LOCATED WITHIN
MIAMI SHORES- VILLAGB AS A PART OF THE ZONING -
ORDINANCES AND LAWS OF SAID VILLAGE WITH CERTAIN
EXCEPTIONS AND PROVIDING FOR VIOLATION OF SAME
AND PENALTIES THEREFOR AND VESTING IN THE VILLAGE
BUILDING INSPECTOR CERTAIN DISCRETIONARY POWERS.
BE IT ORDAINED BY MIAMI SHORES VILLAGE:
SECTION 1. Effective from the--date of this ordinance it
shall be unlawful to use any property within.Miami Shores Village
without complying with each and every of the building restrictions
of the various subdivisions located in Miami Shores Village., and each
and every of said building restrictions are hereby adopted as a part
of the zoning ordinances .and laws of said Village, and the .building
inspector of said Village is hereby directed to issue building permits
or permits for the use of any land withinsaid Village only upon full
compliance with the zoning ordinances of the Village and all bailding
restrictions of each and every the subdivisions located in said Village.
SECTION 2. The provisions of this ordinance shall not apply-
to those restrictions running with the land in -the subdivisions located
within the Village wherein the original subdivider or developer., or
his, or its successors retain the authority to approve or disapprove
plan's for the erection of houses within said subdivision located within
said Villageo or for any other use thereof., and in this' respect said
reitrictionslare hereby excepted from the zoning laws of said Village.
The building inspector may in his discretion consult with the original
subdivider or developer, or his or its successors., concerning the use
of any land in said Village, and said building inspector may, if he
shall see fit so to do., compel compliance with each and ever.y use, the
restrictions running with the land located in Miami Shores Village.
SECTION 3. In no event shall the provisions and conditions
of the zoning laws now in force in -the Village be modified -or ,changed
in any manner or degree in subdivisions within the Village Wher.e rdstric-
tions running with the� land within such subdivisions pr I ovide : for lesser
or lower requirements. concerning the use and occupancy of land' therein
than said Village zoning laws, and, in such evenC the restrictions
running with the land Wouahsubdivision shall not be and become a, part
of the zoning laws of a&
