O-16-34 MIAMI SHORES VILLAGE ORDINANCE NO.
A, n ordinance providing for the erection of safety signal
devices. at all railroad crossings at points within Miami Shores Village
where any railroad crosses or intersects traveled thoroughfares, high-
ways and streets within the said Village, and concerning the enforce-
ment and penalties for violation of the said ordinance.
BE IT ORDAID-ED BY MIAMI SHORES VILLAGE:
SECTION 1. Effective from the date of this ordinance it shall be
unlawful for any person or persons, firms or corporations to operate
railroad trains, engines or other means of conveyance upon railroad
tracks within Miami Shores Village over or across traveled streets, high-
ways and thoroughfares of the Village without first having provided and.
erected, and thereafter maintaining good, sufficie nt an& proper warning
devices and signals at all intersections of such railroad tracks and
such traveled streets, highways and thoroughfarei of the Villageq to
signify and warn of the approach of any train or trains.. engines or
other means of conveyance operated upon such railroad tracks to and across
such traveled streets, highways and thoroughfares of said Village.
SECTION 2. Any person, firm or corporation., who , or which., shall
for himself or through another violate the provisions of this ordinance
shall be punished by a fine no-t exceeding $100.00 or by imprisonment at
hard labor on the streets or other public works of the Vill-age , or any
other lawful place during a period not exceeding thirty (30) days . . or by
,both such fine and imprisonment in the discretion of the Court of the
Village,, and each day on which this ordinance shall be violated shall be
construed as a separate and distinct offense.
SECTION 3. Each wor4, phrase., sentence or section of this ordi-
nance shall be severable and the invalidity of any word, phrase, sentence
or section shall in no way or degree impair any other part or parts
thereof.
SECTION 4. All ordinances and parts of ordinances in conflict
herewith or heretofore enacted upon the subject matter of this ordinance
are hereby repealed.
SECTION 5. That an emergency exists for the protection of the
public welfare, life ard property.
SECTION 66 This ordinance shall be effective immediate1y
upon its passage*
