02-12-2004 Regular Meeting03/25/04 THU 09:58 FAX 3053752560 • DADE PLAN DEV REG 12 FL 1V1d ME SHORES VILLAGE PLANNING AND ZONING BOARD Thursday, February 12, 2004 Village Hall Summary of Meeting The Planning and Zoning Board of the village of Miami Shores held its regularly scheduled meeting on Thursday, January 8, 2004, at the Village Hall_ The meeting was called to order at 6:30 PM with the following members present: Members Present Tim Crutchfield Richard Fernandez Robert Abrarnitis Cesar Sastre Members Late Donald Sllockey (Arrived at 7:25 PM) • Planning and Zoning Staff Present Al Berg, Director of Planning and Zoning • S eakers and Others ion Atten e Pablo Andrade, Recording Assistance SECTION 604: SI'Z'E PLAN APPROVAL —GARAGE ENCLOSURE APLICANT: MARIA BELTON (PROPERTY OWNER) ADDRESS: 18 NE 107TH STREET, MIAMI SHORES, FLORIDA Mr. Berg presented a request to amend the agenda in order to discuss Ms. Maria Belton's property case located at 18 NE 107th Street, Miami Shores, Florida. The item was included on the agenda by a unanimous vote of the board Mr. Berg stated that Ms. Maria Belton requested to put a 20 feet driveway and include a garage enclosure in her property. Stafrecommendcd. Ml Crutchfield made a motion to approve it, and Mr. Sastre seconded the motion. The members of the board approved the motion unanimously. Zoos 03/25/04 THLT 09:58 FAX 3053752560 • • DADE PLAN DEV REG 12 FL CODE REVISIONS OF PARKING AND LANDSCAPING PARKING Mr. Fernandez stated that he has two items to present under the parking item, which deals with boats and recreational vehicles (RV). With regards to paving the swale, he felt it is the Village's property and they should have a say on what is done. Mr. Abrarnitis gave hand outs to all members of the board that relates to proposed amendment dealing with bringing swale paving into code compliance. He wanted an inspection of the paving during the re -occupancy inspection. Mr. Crutchfield let the board know that he has obtained information from the Internet about the material for parking and turf block parking. Mr. Fernandez stated that turf pavers materials for parking would be included in the agenda for discussion. Ms. Sastre requested to include statues and fountains in the agenda for discussion. Mr. Abramitis stated that he is looking for a way to trigger some compliance in getting mentioned swales unpaved. He began the discussion with the amendment of section 520 C. In the past, there were situations were people were enclosing garages, which force parking out to the streets. He suggests proposing a mechanism so when someone wants to remove parking from his or her property or to reduce the pervious area of it, and if they enclose a garage or have a nonconforming parking pave in the swale, then, they should bring it into compliance. Otherwise, a variance will be needed under 702. Mr. Crutchfield stated that he would not like to discourage residents from improving their properties. Maybe, there is a variance consideration to apply. In addition, he showed samples of turf block. He suggested that turf block should be encouraged to use, particularly, in Swale type parking areas because it gets rid of the drainage problem and keeps the green of the swale. He felt that residents should be allowed to pave up to 50 % of the width of the Swale. Mr, Fernandez stated that he could see that being interpreted as being a policy rather than issue of ordinance. If it is adopted as a policy, it could give the board flexibility in dealing with it. He would like to consider this item for further discussion. Fernandez stated that the issues of statues are size, safety issues attached and if they are accessory structures_ In addition, if they become offending they should come to the board_ Mr. Berg stated that statues should be reasonably customary and within normal use of the area. Mr. Crutchfield stated that large fountains should come under the site plan and is a judgment call for the staff as far as safety and the size issue. Mr. Berg stated that monuments and statues above 6 feet high should be approved by Planning and Zoning. Mr. Shockey suggested not allowing hard scape items on the setbacks. Statues should not be allowed as many are out of scale with the house_ Mr. Fernandez called for a break at 7:40 PM Mr. Fernandez reconvened meeting at 7:45 PM PARKING CONTIN JE Recreational Vehicles, Boats and Trailer Boats Mr. Fernandez said that there is currently an informal policy in reference to recreational. vehicles in the village_ It states that RV's can be put in properties for about three days. In addition, he is pursuing the possibility of expanding the RV's capability to 25 feet or less in the rear of the property and the owner of the RV should be the owner of the house. Mr. Fernandez stated that there is one canal in Miami Shores, which is owned by the property owners or by the village. The other one is in the Biscayne canal that is a state owned canal_ In dealing with a property located on the Biscayne canal, it is difficult to regulate size of boats. They have never been regulated, and it is on state waterway. In addition, he said that there are have not been any known complaints about the village water way. Mr. Berg explained that either the state regulates the canal or DEEM. Mr, Crutchfield stated that the fact that the State has the waterway does not mean that the Village cannot regulate it. Mr. Fernandez stated that limitation of trailer boats is 20 feet and should be in the side or the rear of the house. Proposals have suggested about boats larger than 25 feet and if they are longer thanthe house, they should not be stored in the side yard. Wane wants to put a 25 feet boat on the side of the house, the boat has to be in the rear of the house just like the recreational vehicles. The maximum height of boats should not be higher than the eaves of the house Mr. Crutchfield stated his opposition to increase size of boats to 25 feet. He would like to keep it the way it is in the code at this time. APPROVAL OF MINUTES Chair Mr. Fernandez asked the members if they had reviewed the minutes from their meeting on January 12, 2003. The board member Tim Crutchfield suggested a couple of changes inthe minutes. Mr. Fernandez moved to approve the minutes, seconded by board members Mr. Crutchfield and Mr. Sastre. The motion was passed unanimously. ADJOUR.NE.MNT There being no further regular business before the board, the meeting was adjourned at 8:25 PM.
