03-18-1999 Regular MeetingMIAMI SHORES VILLAGE PLANNING & ZONING BOARD MEETING MARCH 18, 1999 The regular meeting of the Fanning and Zoning Board was held on Thursday March 13, 1999 at the Village Hall, commencing at 7:36 PM, with the following present: Robert Blum, Chairman Ivor Hegedus, Vice -Chairman Max Wolfe Sturman Jim McCoy Norman Powell Richard Sarafan, Vdlage Attorney Also Present Frank LuBien, Building & Zoning Director Veronica A. Galli, Recording Secretary All witnesses expected to testify were sworn in at this time. ITEM #1 MINUTES, FEBRUARY 18, 1999 Mr. Sturman moved to accept the Minutes as presented Mr. Hegedus seconded the motion and the vote was unanimous in favor. ITEM #2 REQUEST FOR APPROVAL OF FENCE INSTALLATION. Luis Biancalana 9301 NE 9 Place Mr. LuBien informed the Board that the ordinance requires a 3 Y2 foot high fence in the front yard, a five foot high fence on the side yard and/or rear yard. Mrs. Biancaiana informed the Board that she wanted consistency in the height of the fence. She stated that the consistency would create harmony with the overall landscaping of her home. Mr. Sturman moved to approve the request as submitted. Mr.Hegedus seconded the motion and the vote was unanimous in favor. ITEM #3 REQUEST FOR APPROVAL OF PLANS FOR REVISION TO COVERED TERRACE ADDITION Guy E. O'Grady, M.D. 800 NE 96 Street Mr. LuBien informed the Board that Mr. O'Grady withdrew his request because he (Mr. O'Grady) could not attend the meeting. • ITEM #4 REQUEST FOR APPROVAL OF PLANS FOR PRE-FABRICAIW FIREPLACE NSTALLATION. Denise Bergqvist 701 Grand Concourse Mr. Jonathan Zenus, contractor for Ms. Bergqvist stated that the pre -fabricated fireplace installation would be more harmonious with the construction of the home if installed on the backside of the ridge and not the front ridge. After further discussion, Mr. Hegedus moved to approve the request with the condition that an elbow be placed to the back ridge line and that if this condition is not met, the applicant must come back to re -apply. Mr. McCoy seconded the motion and the vote was unanimous in favor. ITEM -5 REQUEST FOR APPROVAL OF VARIANCE TO INSTALL FIBERGLASS SHINGLES. Jane Hyde 561 NE 101 Street Ms. Hyde stated that she has kept the home maintained for many years and that the request to install fiberglass shingles on the west side of her home over a single door entrance is a necessary improvement Ms. Hyde provided a letter from an engineer stating that the roof in the stated area will not hold the weight of tile. Mr. McCoy moved to approve the request as submitted. Mr. Hegedus seconded the motion and the vote was unanimous in favor. ITEM 46 REQUEST FOR APPROVAL OF PLANS F9GR A7 NE 91 TerrEN E. LOSUR Bruce Alspach, DDS. Mr. McCoy stated his concern of the possibility that the enclosed area turning into a rental area by having an exterior door. Mr. Blum stated his concern with the exterior door, flood elevation, parking and that there would be no access to the main living quarters. Mr. Hegedus stated that if the kitchen door is eliminated, a fire hazard would be a possibility. Mr. Powell stated his concern regarding the possibility of a rental space development. After further discussion, Mr. McCoy moved to accept the request with the exception that the exterior door be enclosed at the time of the renovation. Mr.Powell seconded the motion and the vote was unanimous in favor. ITEM 47 REQUEST FOR APPROVAL OF APPEAL OF BUILDING OFFICIAL'S EXTERIOR COLOR REJECTION. Chris Master 273 NE 98 Street Mr. LuBien stated the submitted color was not appropriate nor in harmony with the surrounding area. Ms.Ines Hegedus informed the Board that the submitted colors, Benjamin Moore #805 Blue and #272 Yellow, were approved by the Historical Preservation Board at a meeting held on Monday March 15, 1999. Mr.LuBien stated he was not notified of the approval with a Certificate of Appropriateness from the Historical Preservation Board. Mr. Powell stated his disapproval that no pictures or any written support from the Historical Preservation Board was provided for the review of the Planning & Zoning Board. Mr. Powell went on to request that the Chairman, Mr. Blum request that all requests for approval of appeal of the Building Official's decision pertaining to exterior color of homes have photos of the home submitted along with any and all supportive paperwork on information pertaining to the request at the time the request is submitted to the Buildng Official. Mr. Hegedus moved to accept the request as • • approved by the Historical Preservation Board. Mr. Sturman seconded the motion and the vote passed with Mr. Powell and Mr. McCoy voting NO. Mr. Blum, Mr. Sturman and Mr. Hegedus voting YES. ITEM #8 REQUEST FOR APPROVAL OF APPEAL OF BUILDING OFUCIAL'S EXTERIOR COLOR REJECTION. Kornai Bhojwani 9101 NE 2 Avenue Mr. LuBien stated the submitted color was not in harmony with the area. After much discussion, Mr. Sturman moved to approve the application as submitted (colors 4/D 446 and 31B 439) and Mr. Hegedus seconded the motion. Mr. McCoy moved to amend the motion to colors #446D and HCI 19. After discussion, the main motion as amended was voted on and approved unanimously in favor. ITEM #9 REQUEST FOR APPROVAL OF APPEAL OF BUILDING OFFICIAL'S EXTERIOR COLOR REJECTION. Nancy Dowson 289 NE 102 Street Mr. LuBien stated the color submitted is not appropriate nor in harmony with the surrounding area. Ms. Dowson stated that the original color of the home shown through when they were scrapping the home to repaint it and that she matched that color to the submitted color . After further discussion, Mr. Sturman moved to approve the request as submitted. Mr. Hegedus seconded the motion and the vote was 4 to 1 for approval with Mr. Powell voting against. The motion passed. Ms. Inez Hegedus addressed the Board stating that the study she has been working on regarding the color of exterior paint on homes in the Miami Shores area for the past 6 months has stagnated and she is resigning her position with the study. Mr. Ivor Hegedus addressed the Board announcing his resignation as Vice -Chairman of the Planning & Zoning Board. Mr. Hegedus is relocating outside of the Miami Shores area. Mr. Tom Benton, Village Manager addressed the Board regarding the Village Disaster Preparedness. He explained that the Hurricane Plan is reviewed every May. This review would encompass other natural disasters such as tornado, flooding etc. Mr. Benton also stated that the Public Works personnel have been trained in disaster techniques, and mutual aid agreements are in place and are expected to work smoothly. The March 18, 1999 meeting of the Miami Shores Planning & Zoning Board was adjourned at 9:45 PM. Obert Blum, Chairman
