The regular meeting of the Planning & Zoning Board was held on Thursday, February 18, 1999 at
the Village Hall, commencing at 7:32 PM, with the following members present:

All witnesses expected to testify were sworn in at this time.
ITEM AI MINUTES, JANUARY 21, 1999
Mr. Hegedus moved to accept the Minutes as presented. Mr. Sturman seconded the motion and
the vote was unanimous in favor.
ITEM 42 REQUEST FOR APPROVAL OF APPEAL TO BUILDING OFFICIAL'S
DECISION IV REJECTING PAINT COLORS.
Mark Cicale 142 N.W. 101' Street
Mr. Cicale presented samples of the color paint he submitted on his application on stucco pieces.
The Board discussed the presentation and Mr. Hegedus moved to approve the application as
submitted, thereby overturning the Building Official's deniaL Mr. Sturman seconded the motion
and the vote was unanimous in favor.
Mr. Sturman stated he is working on submitting his findings regarding color choices for homes in
Miami Shores, and is hopeful that he will present his findings to the Board in the near fixture.
• Mr. Tim McCoy arrived at 7:55 PM.
ITEM 43
REQUEST FOR APPROVAL OF PLANS FOR GARAGE ENCLOSURE AND
APPROVAL OF VARIANCE TO PERMIT WOOD FRAME CONSTRUCTION.
Roman letter 144 N.W. 105` Street
Mr. Gilbert Fein, architect for Mr. fetter, stated that he was requesting wood frame construction
because of the difficulty in tying the new structure to the existing roof and the area that he will be
working in is very small. Mr. Sturman moved to approve the garage enclosure with compliance
to the building code provided in Section 523.1 of the Miami Shores Village Code of Orcizances.
Mr. McCoy seconded the motion and the vote was unanimous in favor.

ITEM #4 REQUEST FOR APPROVAL OF 6' WOODEN POSTS IN A 5' FENCE WITH
A LIGHT FIXTURE ON TOP OF EACH POST.

1VIr. LuBien stated that the request for 6' wooden posts violates the 5' height limitation cited in the
Village Code. Mr. Russo stated that he is requesting permission for the 6' wooden posts so that
he can attach a light to each one. He also stated that by doing so, the improvement would add to
the esthetics of his yard. After further discussion, Mr. McCoy moved to reject approval of the
application as submitted. Mr. Hegedus seconded the motion and the vote was unanimous
Mr. Hegedus left the meeting at 8:20 PM for a previous commitment.
ITEM #5 REQUEST FOR APPROVAL OF APPEAL TO THE BUILDING OFFICIAL'S
DECISION IN REJECTION PAINT COLOR
James T. Mills, Jr. 102 N.E. 107`'` Street
Mr. Mills presented photographs of homes in Miami Shores that are painted with uncommon
colors. After review of the photographs, the consensus of the Board was that the majority of the
homeowners did not obtain a permit to have the home painted the color as shown in the photo.
After further discussion, Mr. McCoy stated his concern regarding the choice of color that Mr.
Mills had on the application as not being appropriate for Mani Shores. Mr. Blum stated that the
colors are getting too vibrant and that Miami Shores is a community of harmony. Mr. Sturman
reiterated that he will look into the possibility of chang the color code for lvfiami Shores and he
will report back to the Board.
Mr. Mills requested that his application be altered to include the Board's approval for Benjamin
Moore color 44E012. Mr. McCoy moved to accept the revised application for approval of
Benjamin Moore color 4/E012 for Mr. Mtlls' home. Mr. Sturman seconded the motion and the
vote was unanimous in favor.
The February 18, 1999 meeting of the Miami Shores Planning & Zoning Board was adjourned at
9:10 PM.
