Planning & Zoning Board Meeting
January 21, 1999
The regular meeting of the Planning & Zoning Board was held on Thursday, January 21, 199 at
the Village Hall commencing at 7:35 PM. The meeting was called to order with the following

All witness expected to testify were sworn in at this time.
ITEM #1 MINUTES, DECEMBER 17, 1998
The Board indicated that there were two typing errors in the Minutes of December 17, 1998. The
corrections were as follows:
Item #3 - the second to last sentence is to read: It is the consensus of the Board that it is not
prepared to move forward but would look favorably on changes to color, landscaping and roof.
And
In the summary by Mr. Swarthout, first sentence, the word felt is to replace flet.
Mr. McCoy moved to approve the amended minutes, Mr. Powell seconded the motion and the
vote was unanimous in favor.
ITEM #2 REQUEST FOR APPROVAL OF PLANS FOR ALTERATIONS
Miami Shores Chevron 9601 N.E. 21' Avenue
• Mr. Bill Duffy, with D.F. Consultants, Inc. and Mr. Chuck Orlandi presented to the Board a
drawing showing the changes to the landscaping and the roof of the proposed site. The Board
discussed the line of sight issue at 96th Street and N.E. 2°`' Avenue. The Board stated their
concern that the landscaping was not going to block the line of sight. Mr. Duffy stated the
landscaping in that area will not interfere with the line of sight as indicated on the drawing. The
Board also stated their concern with the color of the tile for the roof. The Board felt that the roof
tile color should be in harmony with the existing tiles in the area. Mr. Duffy told the Board that
he would submit a color for the tile and sample to Mr. LuBien.
Mr. Sturman moved to approve the plans with the stipulation that barrel tiles in the terra cotta
color family be used for the roof. Mr. McCoy seconded the motion and the vote was unanimous
in favor.

ITEM #3 REQUEST FOR APPROVAL OF NEW SIGN AND REPLACING COPY OF
EXISTING SIGN.
Miami Shores Auto Repair 9734 N.E. 2`d Avenue
Mr. Orlandi presented a picture of the new sign that would replace the existing sign. Mr. Orlandi
stated that mechanical services was being eliminated at the 96th Street location and that the new
sign would indicate mechanical services at the 97' Street location.
Nir. McCoy moved to approve the request as submitted. Mr. Powell seconded the motion and the
vote was unanimous in favor.
ITEM #4 REQUEST FOR APPROVAL OF PLANS FOR GARAGE ENCLOSURE
Roman Jetter 144 N.W. 10511 Street
Mr. Roman Jetter stated that his brother Dominic lives with him and his family and that in order to
have privacy, he would like to enclose his garage with a side entrance so his brother could come
and go as he pleased.
Chairman Blum opened the discussion by explaining that historically, enclosures accessed solely
from the inside and not the outside, would avoid the possibility of the enclosed area turning into a
rental property. Chairman Blum also expressed his concern regarding the area for parking. Mr.
Jetter stated that the entire parking area is paved and could accommodate three cars with no
problem.
Mr. McCoy moved to approve the plans with the variation of enclosure on the west side step up
area with an interior door to the exterior of the house. Mr. Sturman seconded the motion. The
vote was four (4) to one (1) against approval, with Mr. Sturman voting for approval.
ITEM #5 REQUEST FOR APPROVAL OF PLANS FOR FLAT ROOF ADDITION
Angel & Johana Perez 9760 North Miami Avenue
Mr. Perez stated the addition of a flat roof will not deteriorate the appearance of the
neighborhood and that it would be enhancing the residence. Mr. McCoy stated that a flat roof
would be a natural choice in his opinion.
Mr. Hegedus moved to approve the variance as proposed. Mr. Powell seconded the motion and
• the item passed unanimously.
ITEM #6 REQUEST FOR APPROVAL OF PAINT COLOR FOR ROOF TILE.
Margaret Z Annis 379 N.E. 94th Street
Ms. Annis stated that she has been the property owner for many years and over this long period of
time, many different companies have repaired her roof and unfortunately, the color roofing tiles
do not match perfectly. Ms. Annis also stated that she would like to paint the entire roof a
consistent dark red color to make a more attractive home.

Mr. Sturman state that Ms. Annis' roof is both clay and cement tiles and that clay would not allow
paint to adhere to it, but if a sealant was applied, the paint might adhere. Chairman Blum
suggested that Ms. Annis test areas of the roof before painting the entire roof.
Mr. Hegedus moved to approve the application as presented. Mr. Powell seconded the motion
• and the item passed unanimously.

ITEM #7 REQUEST FOR APPROVAL OF APPEAL TO BUILDING OFFICIAL'S
DECISION IN REJECTING PAINT COLORS FOR A HOME.
Damaso DelRosairo 290 N.E. 101' Street
Mr. LuBien presented to the Board the color samples by Mr. DelRosario, scarlet cap, cyclamen
and mostoza picante. Mr. DelRosario stated his choice was any one of the 3 colors presented,
with his first choice being scarlet cap. Chairman Blum stated the colors were somewhat bold and
not appropriate for Miami Shores. Mr. LuBien explained that the colors were not in harmony
with the area.
Mr. Hegedus moved to accept the mostoza picante color with white trim. The motion lacked a
second and the motion failed.
After further discussion, Mr. Sturman moved to approve a color in the terra cotta family that he
applicant chooses. The motion failed for lack of a second.
Mr. McCoy informed the Board that he had to leave the meeting for a previous commitment. Mr.
McCoy left the meet at 8:22 PM.
Mr. Sturman moved to deny the appeal of the Building Official's decision. Mr. Powell second the
motion and the motion passed with a vote of three (3) to one (1) with Mr. Hegedus for no.
The Board further discussed the issue of paint color for homes in Miami Shores with the
possibility of broadening the choice of colors to go beyond pastels. Mr. Sturman volunteered to
investigate the home color issue and present his findings to the Board.

Mr. Cicale withdrew his request.
