06-18-1998 Regular MeetingMIAMI SHORES VILLAGE PLANNING & ZONING BOARD REGULAR MEETING June 18, 1998 • The regular meeting of the Planning & Zoning Board was held on Thursday, June 18, 1998 in the Chamber of the Village Hall commencing at 7:32 P.M. The meeting was called to order with the following members present: Present: Absent: Also Present: Robert Blum Frank Hegedus Ivor Hegedus Norman Powell Richard Sarafan, Village Attorney Ramon Camayd, Assistant Director of Building & Zoning Lisa Kroboth ITEM #1 MINUTES - May 21, 1998 Mr. I. Hegedus moved that the minutes be approved as submitted with a second from Mr. F. Hegedus. The vote was unanimous in favor. Those witnesses who expected to testify at this meeting were sworn in at this time. All applicants agreed to proceed with only three Board members present requiring a unanimous vote as stipulated in the Code of Ordinances. ITEM #2 REQUEST FOR APPROVAL OF APPEAL TO BUILDING OFFICIAL'S DENIAL OF PAINT COLOR FOR ROOF. Rosetta Betty 9105 N. Bayshore Drive Mr. Camayd explained that the Building Official, Frank LuBien, deemed the color of the roof to be inappropriate. It was his belief that the original color of the tile roof was white based on the style of the tile. Ms. Betty was present on her own behalf stating that the color of the roof was a peach whisper. Due to the condition of the roof at the time it was painted, the color undeterminable. The Board explained the Code requirement of through color tile. Mr. Blum expressed his concern of matching the paint color should the roof need to be repaired in the future. Mr. I. Hegedus moved to deny the petition and uphold the decision of the Building Official. Mr. F. Hegedus seconded the motion which was passed unanimously. Planning & Zoning June 18, 1998 Page 2 ITEM #3 REQUEST FOR APPROVAL OF APPEAL TO BUILDING OFFICIAL'S DENIAL OF EXTERIOR PAINT COLOR. Ronald P. Cleek 882 NE 97 Street As indicated at the last meeting, Mr. Cleek agreed to waive any objection for the Board's consideration of this item based on any observations of the area. Mr. Cleek submitted photographs of a cross-section homes in Miami Shores showing both architecture and color. Mr. Blum noted that paint color is harmonious when it fits the architectural style of the house. Mr. I. Hegedus moved that the application be approved as submitted. Mr. F. Hegedus seconded the motion which was passed unanimously. ITEM #4 APPROVAL OF PLANS FOR 6' HIGH TUBULAR FENCE AROUND POOL PATIO PERIMETER. Mr. Saldivar 381 NE 98 Street Mr. Saldivar was present on his own behalf stating he would like to install a 6' fence around the pool patio perimeter. However, the pool is located in the front of the home. It was noted that there is a 5' height limitation as per section 518 of the Code. Mr. Saldivar had no objection to the height limitation. Mr. F. Hegedus moved for approval of the application with a 5' maximum height limitation as per Section 518 of the code of Ordinances subject to any special consideration from Mr. LuBien of which the Board may be unaware. Mr. I. Hegedus seconded the motion with a unanimous vote in favor. ITEM #5 ESTABLISHMENT OF AN APPLICABLE ELEVATION IN DETERMINING THE MAXIMUM HEIGHT OF FENCE/WALL. Paul & Kathy Nettleton 1173 NE 104 Street Due to a lack of a quorum, this item was postponed until the next meeting as Mr. Blum must abstain from voting on the item. Mr. Blum asked that the Board consider, for discussion purposes, standardization of paint colors as the matter is so subjective. Ms. Ines Hegedus -Garcia and Mr. Jaime Camacho, members of the Historic Preservation Board with an architectural background, were present to speak on the subject. • • Planning & Zoning June 18, 1998 Page 3 Ms. Hegedus -Garcia noted that the process would not be as simple as standardizing colors; rather it would be a suggestion of color schemes. She proposed a color study be done of the area to establish a spectrum of colors. Should anyone want a color scheme not pre -approved the applicant would need to come before the Board. Mr. Sarafan suggested that the Board consider the criteria to pursue when choosing a color scheme as the Code is ambiguous regarding harmony. Ms. Hegedus -Garcia noted that there is a contact at the University of Miami who does urban planning with particular attention to color schematics. Such a study may benefit the Village in regards to future reference. It was the consensus of the Board to have Ms. Hegedus -Garcia and Mr. Camacho to begin a color study and to then make the appropriate recommendations to the Board based on their expertise and knowledge. A progress report is requested at the next Board meeting. ITEM #6 ADJOURNMENT Ms. Rosetta Betty returned with a roof tile for the Board to determine its' color. It was determined that the tile was a cement tile - gray in color which would require a paint. Based on the new evidence presented, Mr. I. Hegedus moved that Item #1 be reconsidered at the next meeting. Mr. F. Hegedus seconded the motion which passed unanimously. It was suggested that Ms. Betty present the tile to Mr. LuBien for his consideration before the next meeting to determine if an appeal is still necessary.
