REGULAR MEETING
JANUARY 23, 1997
The regular meeting of the Planning 8v Zoning Board was held on Thursday,
• January 23, 1997, in the Chambers of the Village Hall commencing at 7:30
P.M. The meeting was called to order with the following members present:

APPROVAL OF MINUTES
1. MINUTES - JANUARY 9, 1997
Mr. Forney moved to approve the Minutes. Mr. Hegedus seconded the
motion, and the motion passed unanimously approving the Minutes.
AGENDA ITEMS
2. REQUEST FOR APPROVAL TO PAINT EXISTING RED ROOF WHITE -
Daniel Demirgian - 9101 NE 2 Avenue
Mr. Lubien reported the homeowner had begun to paint a terra cotta
colored roof with a white sealant in order to prevent further leaking without
first obtaining a permit. He was before the Board because he would need a
variance to change the color of the roof. Mr.Caldwell stated the reason a
variance could not be granted to paint the roof white was because of the
possibility that the white color would eventually chip and peel and expose
patches of the original terra cotta color. Mr. .Demirgian advised the white paint
• was a sealant only and he would, if necessary, apply a reddish color paint over
the sealant to match the terra cotta color. Mr. Lubien stated this would not be
acceptable. Mr. Demigrian said there was a financial factor involved here
because he did not have the $15,000-$25,000 it would cost to put on a new
roof, and applying the white sealant with a reddish colored paint over it would
cost only $3,000. He cited cases where other homeowners had painted their
roofs and were not in violation. Mr. Demirgian also said because of new roofing
techniques now available, contractors would sometimes give a 30 year

guarantee against chipping and peeling if a roof was painted with a sealant.
Chairman Walters suggested Mr. Dermigian ask the manufacturer of the
sealant to color the paint with a reddish pigment and then seal the roof. Mr.
Lubien said this would be acceptable and no variance would be needed if the
color chosen matched the present color of the roof. He advised the white
sealant already applied to the roof must be removed and could be sandblasted
off.
Mr. Caldwell moved to deny the variance to paint the present roof white.
Mr. Forney seconded the motion, and the motion passed unanimously.
3. REQUEST FOR APPROVAL OF PLANS FOR FRONT YARD FENCE -
Arthur IL Rice - 1680 NE 104 Street
Mr. Lubien reported the original plans were for a 5 foot fence. He said he
had altered the plans to provide for a 3 1/2 foot masonry and ornamental metal
fence which would be acceptable. Mr. Rice said he would like to have 3 1/2 foot
solid masonry fence with columns as depicted in the plans. Mr. Lubien said
this would be acceptable.
Mr. Hegedus moved to approve the application. Mr. Forney seconded the
motion, and the motion passed unanimously.
4. REQUEST FOR APPROVAL OF PLANS FOR FRONT YARD FENCE -
John Rice - 261 NE 102 Street
Mr. Lubien advised the application was for a 3 Y2 foot ornamental metal
front yard fence, and the plans submitted were acceptable.
Mr. Forney moved to approve the application. Mr. Hegedus seconded the
motion, and the motion passed unanimously.
5. REQUEST FOR APPROVAL OF PLANS FOR ENCLOSED STAIRWAY
ADDITION -
Nationsbank - 9475 NE 2 Avenue
Mr. Lubien stated the application was before the Board because there
would be a change to the exterior elevation of the building due to construction
being done to the interior of the building. He reviewed the plans and said he
was satisfied that everything was in compliance. The architect for the bank,
Mr. Ray Fato, described the work to be done in detail.
Mr. Caldwell moved to approve the application. Mr. Hegedus seconded
the motion, and the motion passed unanimously.

6. REQUEST FOR APPROVAL OF SPECIAL USE VARIANCE TO PERMIT
CLASSROOM AND ADMINISTRATIVE USE -
Miami Country Day School - 10653 NE 6 Avenue
This item was removed from the Agenda.
