07-14-1994 Regular MeetingMIAMI SHORES VILLAGE PLANNING & ZONING BOARD REGULAR MEETING JULY 14, 1994 The regular meeting of the Miami Shores planning & Zoning Board was held on Thursday July 14, 1994. The meeting was called to order at 7:35 P.M. by Chairman Waiters with the following members present: Robert Blum Les Forney Charles Smith Cliff Walters Absent: Larry McClure Also Present: Mr. Bill Fann, Village Attorney Mr. Frank LuBien, Director Building & Zoning 1. Minutes - June 23, 1994 Mr. Forney moved to approve the Minutes of June 23, 1994 as submitted. Mr. Blum seconded the motion and It passed unanimously. 2. Request for approval of plans for dock and hoist Mr. Bud Laurence 1634 NE 105 St Mr. Bunell, contractor for Mr. Laurence, stated that the new construction of the dock and hoist will replace davits that are in place at the present time. Mr. LuBien stated the reason for this Item coming before the Board was that"there is a high profile of construction. After a discussion, Mr. Forney moved to approve the request as submitted. Mr. Blum seconded the motion and It passed unanimously. 3. Request for approval of variance to reroof with shingles Beverly Roil 60 NE 111 Street Mr. George Miller, roofing contractor for Ms. Roll stated that the shingles that are on the roof presently have been there for 17 years and are in desperate need of being replac- ed. The consensus of the Board was that the letter submitted by Mr. George Jenetopulos, Florida Architect *14185 was not sufficient and the Board suggested an evaluation from an engineer regarding the structure and the capacity that the roof will support. After further discussion, Mr. Miller withdrew the application on behalf of Ms. Roll. Planning & Zoning meeting - 2 - July 14, 1994 4. Request for approval of variance of Patty Walker patio setback 9301 NE 4 Ave Ms. Walker stated that the patio she would like to install, would enhance the property and provide a private area for her family. Mr. Forney stated that some homes are situated so that you can't do what you would like to. Mr. Smith stated that peculiar and unusual circumstances occur because of the unusual layout of the property. Mr.,Blum agreed with Mr. Smith. Mr. Fann stated that the peculiar circumstances refer to the real property and in his opinion, do not fit the definition of hardship. Marteily 149 NW 99 St Ms. Marteily stated she wants to enclose the garae use the area as a family room and to have a placeforsher to children to study. Mr. Fann requested to be excused and left the meeting at 8:20 PM. After a discussion, Mr. Smith moved to approve with the provision to removed the rear door and block rInuthe area. Mr. Forney seconded the motion and it passed unanimously. 6. Discussion: Proposed amendment to Section 225 (4)()) Providin• for roofin• materials on non-conformin• roofs. Mr. Smith presented to the Board various samples and literature pertaining to higher grade alternative roofing materials than those suggested for use on structures which Planning & Zoning meeting - 3 - July 14, 1994 cannot support tile. Following the presentation, Mr. Smith presented posed ordinance which would codifythetyfa idrabtpes pro- le alternatives and eliminate the use of asphalt and flexible laminated shingles. After further discussion, Mr. Forney moved to send the proposed amendment to Mr. Fann, the Village Attorney, to place the amendment In proper ordinance form and return it to the Board In 30 days. Mr. Blum seconded the motion and it passed unanimously. (Copy of the proposed amendment is attached.) A motion for adjournment was made at 8:48 P.M. Veronica A. SMITH 3057546142 P. 01 PROPOSED AMENDMENT TO MIAMI SNORES VILLAGE CODE APPENDIX A SECTION 225 (4)(1) EXCEPTION 70 MASONRY CONSTRUCTION REQUIREMENT FOR STRUCTURES NOT ORIGINALLY ENGINEERED TO SUPPORT MASONRY ROOFING MATERIALS (j) Any roof or mansard fascia with an incline of not less than 2 1/2 inches per foot, legally in existence and not originally engineered to support masonry roofing materials, may be permitted to be re -roofed with rigid cementious fibre roofing shingles of not less than .170" thick upon the recommendation of the Planning and Zoning Board. —he Planning and Zoning Board shall have the authority to approve such alternative roofing materials based on color, shape, dinension, texture, manner of lawful application and harmory with other bu• ldings in the proximity thereof. The Planning and Zoning Board shall not have the authority to approve such roofing materials on the basis of economics. The use of flexible laminated fiberglass and. asphalt shingles is hereby expressly prohibited.
