PLANNING & ZONING BOARD
REGULAR MEETING JUNE 9, 1994
The regular meeting of the Miami Shores Planning & Zoning
Board was held on Thursday June 9, 1994. The meeting was
called to order at 7:35 P.M. by Chairman Walters with the
following members present:
Robert Blum
Les Forney
*Charles Smith
Larry McClure
Cliff Waiters
Also Present: Mr. Frank LuBlen, Director Building & Zoning
Mr. Bill Fann, Village Attorney
1. Minutes - May 26, 1994
Mr. Forney moved to approve the Minutes of May 26. 1994 with
the following amendments:
Page 2, Item 5 seconded paragraph should be added and read as
follows: The Village Attorney advised the Board that the
legislative intent of the ordinance was to recognize that
metal sheds in general were permissable In Miami Shores and
was not Intended to address the sheds frame. In addition,
the Board was informed that as a result of Hurricane Andrew,
metal frame sheds will no longer be permitted by the South
Florida Building Code.
Mr. McClure seconded the motion and it passed unanimously.
Mr. Smith arrived at 7:42 P.M.
2. Request for approval of flat roof visible from
front elevation.

Requires variance to Section 225. (e) Flat roofs are
permitted on additions to existing pitched roof structures
providing:
(3) The addition is not visible from the front elevation
of the building on an inside lot, or is not visible from
the front or side streets elevations on a corner lot;
Mr. Franklin Grau, architect for Mr. & Mrs. Shaw stated that
the present structure Is falling apart and in need of repair.
He also stated that when the fascia Is completed, the roof
will not appear flat although it will be.
Mr. Smith requested a recess at 7:50 P.M. In order for Mr.
LuBlen to get the original plans of the home.
The meeting reconvened at 7:52 P.M.
Mr. Fann stated there Is no legal reason to grant a variance.
Mr. Forney stated, in his opinion, the hardship issue Is met
because If the roof is not there, when it rains, there Is no
protection.

Mr. Forney moved to approve the variance. Mr. Smith seconded
the motion for discussion. After further discussion, the
vote was: Mr. McClure, Mr. Smith, and Mr. Blum NO; Mr. Forney
and Chairman Walters YES. The variance was denied with a vote
of 3 - 2.
3. Request for approval of Driver's License office

This item placed on the Agenda by Planning & Zoning Director
due to the heavy pedestrian and vehicular traffic that would
be generated at the site and surrounding property.
Mr. Moroz stated the driver's license office would be a test-
ing center opened approximately 4 days a week.
Mr. Smith stated that the assertion that this building would
qualify as an office use would be Incorrect he would prefer a
renewal agency rather than a testing center.
Mr. Smith moved to deny the request. Mr. Forney seconded the
motion and it passed unanimously.
4. Discussion - Ordinance amending Sec. 518 (b),
Appendix A, zoning
Fences on corner Tots providing for wood picket
fences in front yards.
Mr. McClure passed out information pertaining to wood picket
fences and suggested that if•picket fences were to be con-
sidered as an amended usage in the Code, a clear definition
of picket fences would have to be developed.
Mr. McClure's information indicated various types of fences
considered "picket" with various shapes, sizes, heights etc.
After further discussion the consensus of the Board was to
by-pass the issue of picket fences.
Mr. Forney moved to forward on to Mr. Fann, the Village
Attorney, the proposed Ordinance amending Section 518 (b) of
Miami Shores Village Ordinance Number 270, as amended;
Limiting authorized fencing materials for certain corner
lots; providing effective date. So he, Mr. Fann, could pre-
pare the Ordinance and return to the Planning & Zoning Board.
Mr. McClure seconded the motion and it passed unanimously.
A motion for adjournment was made at 8:35 P.M.
