05-27-1993 Public Hearing and Regular MeetingMIAMI. SHORES VILLAGE PLANNING & ZONING BOARD REGULAR MEETING AND PUBLIC HEARING MAY 27, 1993 The regular meeting and public hearing of the Miami Shores Planning & Zoning Board was held on May 27, 1993. The meeting was called to order by Chairman McClure with the following members present: Larry T. McClure Les Forney Cliff Walters Tom Laubenthal Charles Smith Also Present: Mr. Frank LuBien, Director of Building & Zoning Chairman McClure welcomed Mr. Charles Smith as the new member of the Planning & Zoning Board. 1. Minutes of May 13, 1993 Mr. Forney recommended to amend the minutes by striking the word "slight" from the minutes and replace It with the word "brief". Mr. Forney moved to approve the minutes as amended of May 13, 1993. Mr. Laubenthal seconded the motion and it passed unanimously. 2. Request approval of change of address Curtis Roll 20 NW 101 Street Mr. Laubenthal began the discussion stating that If the re- sident were to change the address, that the property owner would be creating a non -conforming situation. Mr. Roll stated that he would like to change the address In order to facilitate the use of his yard and his purpose is not to build an addition but to enhance the landscape of the yard. After further discussion, Mr. Laubenthal made a motion to deny the request for change of address. Mr. Forney seconded the motion and the vote was 4 to 1 with Mr. Walters voting NO. 3. Public Hearing - Ordinance to change definition of Family Chairman McClure began the discussion with the reading of the proposed Ordinance; An Ordinance amending Section 216 of Ordinance No. 270, being the Zoning Ordinance of Miami Shores Village, restating the meaning of the word family as used In said Ordinance." • Planning & Zoning meeting - 2 - May 27, 1993 Chairman McClure reviewed the history related to the approval of the present definition of family. He also stated that the present definition Is being challenged In court and that the basis for the challenge is a similar Supreme Court case. PUBLIC COMMENTS Mr. Bill Ford 301 NE 96 Street Stated he was opposed to the change In definition. Mr. Randy Mannapperuma 210 NE 107 Street Stated he was opposed to the change In definition. After further discussion, Mr. Forney moved to approve the amending of Section 216 of Ordinance No. 270 and recommended adoption by the Village Council. Mr. Smith seconded the motion and it passed unanimously. 4. Report from Public Works Director Mr. Randy Mannapperuma 210 NE 107 Street Mr. Benton, Director of Public Works, had presented the Board a memo stating his position regarding Mr. Mannapperuma's situation In which he stated that there are two drains In the swale. The presence of gravel In the swale does not enhance the function of these drains. The proper procedure would be to clear that area of the gravel and compacted material underneath the gravel, and replace with fresh soli and sod. After further discussion, Mr. Laubenthal moved to deny the application of Mr. Mannapperuma for a variance to allow gravel In the front swale. Mr. Smith seconded the motion and it passed unanimously.
