05-13-1993 Regular MeetingMIAMI SHORES VILLAGE PLANNING & ZONING BOARD REGULAR MEETING MAY 13, 1993 A regular meeting of the Miami Shores Planning & Zoning Board was held on May 13, 1993. The meeting was called to order at 7:35 P.M. by Chairman McClure with the following members present: Les Forney Cliff Walters Tom Laubenthal Also Present: Mr. Frank LuBIen, Director of Building & Zoning 1. Minutes of April 22, 1993 Mr. Forney moved to approve the minutes of April 22, 1993 as submitted. Mr. Laubenthal seconded the motion and it passed unanimously. 2. Mr. Forney moved to amended the agenda to place Item 6 be- fore Item 5 for the convenience of the public. Mr. Laubenthal seconded the motion and it passed unanimously. 3. Request for approval of plans to allow flat roof addition. Juan Carlos Nisenbaum 9929 Biscayne Blvd. After a brief discussion, Mr. Walters moved to approve the plans as submitted. Mr. Forney seconded the motion and It passed unanimously. 4. Request for approval of detached "No parking" sign Jay Stein, M.D. 9699 NE 2 Avenue Dr. Stein stated that In recent months, vehicles have been abandoned in the parking area and he wants to place the standard "No parking" "tow away" sign to discourage the abandoning of vehicles In the area. After a brief discussion, Mr. Laubenthal moved to approve the request to place the standard sign designated by Dr. Stein. Mr. Walters seconded the motion and it passed unanimously. 5. Request for approval of variance to the required side set back Francis C. Bergau 1343 NE 104 Street Mr. Christopher P. Kelley represented Mr. Bergau and stated that the plans were ok'd by Mr. LuBien and that the plans did Indicate that there was an 8" encroachment Into the setback. Mr. Bergau stated that the reason for enclosing the area was to keep the area a safe play area for his children and keep the area shaded from the florlda sun. Planning & Zoning Board meeting - 2 - May 13, 1993 Mr. LuBien stated that he had an Initial conference with Mr. Bergau and advised him that his existing residence was set- back 9.8 feet and that this set -back Is non -conforming. How- ever, Mr. LuBien did not object to alining the screen en- closure at the same point. Subsequent plans were submitted ® and Mr. LuBien assumed that the screen enclosure would be In Ilne with the residence. Without scrutinizing the plans, Mr. LuBien approved them. This was an error on his part, not uncommon In plans processing. At the inspection, Mr. LuBien observed that there was an encroachment into the required set -back, and advised the contractor of the problem. Mr. LuBien also stated that one of the purposes of inspect- ions is to assure that all requirements are met. After further discussion, Mr. Forney moved to approve the variance and Mr. Laubenthal seconded the motion. The motion passed with a vote of 3 to 1 with Mr. McClure voting NO. Mr. McClure explained to Mr. Bergau that he would have to appear before the Council because alt variances, once approved by the Board must go before Council for final approval. Mr. LuBien told Mr. Bergau that he will be notified by mall the time and date of the meeting. 6. Request for approval of screen porch. Mr. Guy O'Grady 800 NE 96 St Mr. O'Grady stated that he has been working on this pro- tect for approximately 10 years and that all the specifi- cations meet with all the requirements necessary. After a brief discussion, Mr. Laubenthal moved to approve the plans as submitted. Mr. Forney seconded the motion and It passed unanimously. Mr. O'Grady was Informed that he has to go before Council to get final approval because the roof Is of manufactured slate and glass and Is a non -conforming roof. Mr. McClure told Mr. O'Grady that he will be notified of the time and date by mail. 7. Discussion: Ordinance restating the meaning of the word "Family". Mr. Forney began the discussion. He stated that he and the Village Attorney, Mr. Fann, have discussed the wording of the existing ordinance and that there was the necessity for re- view for possible change of the ordinance. Planning & Zoning meeting - 3 - May 13, 1993 After further discussion, Mr. Forney made a motion to have a 111 Public Hearing on May 27, 1993 to consider an ordinance amending Section 216 of Ordinance No. 270, being the zoning • ordinance of Miami Shores Village, restating the meaning of the word family as used in said ordinance.
