PLANNING & ZONING BOARD REGULAR MEETING
July 11, 1991
A regular meeting of the Miami Shores Village Planning & Zoning Board
was held on July 11, 1991, The. meeting was called to order a; 7:30 P.M.
by Chairman, Mr. Fernandez with the. following members present:

1, MINUTES - JUNE 27, 1991
Two corrections were made to the minutes under Site Plan Review.
Mr. Fernandez made considerable comments concerning the septic tanks, specifically,
"Why are they being allowed to expand their peptic tank installation without
sewers-, and why wasn't Dade County Public Schools being forced to bring a
sewer line down 103rd St?" To which Mr. Reyes responded, "There are special
exceptions by DERM, sewer hook ups are not pratical", cMr. Fernandez talked
to the gentleman on the phone the next day and he was assured that there are
provisions to allow hook ups, and they are not merely extended to Dade County
Public Schools, but also to-Teople,). Under the same heading, Mr. McClure never
worked in the. construction epartment, or with the architect. It was determined
there is no conflict of interest. other
The minutes of the meeting of June 27, 1991 were approved with these two
amendments by a motion made by Mr. McClure, seconded by Mr. Forney, and passed
unanimously.
Mr. Chambers arrived at 7:35 P.M..
Mr. McClure made a notion to move 7. on the agenda to #2, the motion was
seconded by Mr. Laubenthal, and passed unanimously.
7. DISCUSSION - FABRIC & METAL AWNINGS & ROOFS
Mr. LuBien introduced Mr. Art Heffernan, Miami Awning,.who represented
the fabric covered awnings,
Mr. Fernandez made comments to set the stagefor discussion, "The Miami
Shores Village Planning & Zoning Board is undertaking a review of various
building materials and various sections of our code. Wehave just recently
completed a review and have sent to Council our recommendations for a change
in roofing materials. The second item we are taking a look at is the area of
fabric alumlnum.atructures,..un.dder,.'this.::`heading . and this is a continuing
undertaking by this Board, to see what we can do about improving the quality
of life in Miami Shores . "'
Art Heffernan stated there are entry awnings, window awnings, patio awning,
carports, etc. These are prohibited in most cases in Miami Shores, but there
are fabric canopies, The canopy is madeup of galvanized pipe and fabric.
There is a cloth based fabric and vine, based fabric. There are certain pluses
and minuses about each, There are 3 reasons for use of awnings, To protect
from sun, rain, and energy savings. They are used today ery much, to act as a

roof structure down to small window awnings. There are custom products which
should be made out of a welded frame, as opposed to fitting frames,
Mr. Heffernan spoke on behalf of the welded frames, asthat is what he. sells,
The welded frame is very strong, created and tested.. with. proper fastening to a
structure., to withstand 140 miles per hour winds, Mr, LuBien noted that 125
miles per hour is required, and the fitted frame is acceptable according to the
South Florida Building Code. The other important thing is how the frame is
a tta.cledto"tke building, and how it is fastened into the ground, One must look
at the situation; will a footing bedug, create a plate and fastener situation
like a wedge anchor that fits into concrete; what is it being attached to above,
underneath the soffit; are we drilling into a tie beam, wood, is it a hollow
wall, etc?? All these questions are taken into consideration when putting up a
patio awning especially. Most patio awnings are attached to the house, lean off
it and have posts. When an awning has posts, it becomes a canopy. So there are
different codes which apply, In response to query,. Mr. Heffernan identified the
awning as a structuresuspendedfrom the wall (9' is the maximum in Dade County
for commercial installations, Mr. LuBien noted there is in Miami Shores a 3'
maximum projection allowed into the setback side and rear and 4' in the front.
The canopy is found at the front of restaurants, metro rail stations, cafes, etc.
The canopy has posts which must be of certain height, must set back from sidewalk
or public right of way to protect the public. Available are the aluminum frame-
work and galvenized steel pipe, The steel pipe is most cost efficient.
Trusses are incooperated into the frame to prevent sagging and to add strength
and integrity to the awning. The fabric is easily removable, but this should
be done by calling the Company. It is made installed] to withstand 75 miles per
hour winds, a code standard in the industry. Fabric does age and become tattered,
the average guarantee is 5 to 7 years. The tedlar based heavier duty vinyl
fabric used in commercial application has a 7 to 10 year warranty. Darker fabrics
fade and are not recommended. Vinyl is _ better for South Florida in that it
cleans easier, has no fabric content, can be streched over a large structure,
and from the distance looks the same as cloth, The fabric seams seem to give
way first. On the vinyl the seams are heat sealed. All awnings must be re-
placed when they get old, there are varibles. Mr. Heffernan passed around
samples of the fabric and .vinyl so that Members could feel each. The metal frame
is protected when its' covered by cloth, In response to query from
Mr. Laubenthal, Mr. Heffernan noted there is the painted galvenized paint for
galvenizing wells, strictly a coat which does not penetrate and corners are
mitered and sealed to keep rust to a minimum.. Maintenance should include clos-
ing down occassionally. Aluminum frames have not hit the market, as yet, they
are square tubed and cost prohibitive.' Gator shieldalso can be used on hugh
structures. The cloth fabric is not flame retardent, another issue to look at.
Patio awnings are viable in Miami Shores, but fly by night manufactures and
installers must be watched, as a state license is not required. Coral Gables,
Beach, Boca Raton have the most stringent codes and these should be re-
viewed. Mr. Heffernan stated sealed drawnings by an Engineer are required.
Also he gave the methods used in estimating awnings and canopies, they can run
from a very low $1,500, to $3,0.0.0.. The price is for a custom product based
on the cost of material and difficulty in installation . Mr., LuBien stated,
should awnings be approved, 'it does not create an additional enforcement problem
in Code Enforcement, He talked also to Johnny of General Screen and to Frank
Cornelius, Hurst Awning,"but neither showed up this evening, Mr. Fernandez
requested that a copy of the Coral Gables, Mime irr Beachp & Body., Raton Code be
made available to Members and theitem be placed on the nextmeeting agenda)

2. REQUEST FOR APPROVAL 0T' -VARIANCE TO ALLOW DRIVEWAY 5rNTO SIDE SETBThACK

Mr. LuBlen stated. Members had in their packet copy of a letter from
Mr, Paul, Daum making the request. with a sketch of the property and xequest,
Miriam. Daum had a Letter fram .a neighbor at 9,301.N. E. 12tFL. Ave. approving
the change.
Mr, Fernandez discussed the four criteria:-_necessaryfor a variance, but
Mrs. Daum could not address these., The beautiful landscaping of the yard and
reason why she wants to encroach in the side setback. was discussed at :length.
It can be done without a variance. Mx. McClure noted the single car garage is
used. Further, we live in a community where there is more than 1 car to a
household. The neighboring property is the back yard and not the. side yard
and there is no swell area. Mr McClure made a motion to approve the request for
a variance, seconded by -Mr. Iaubenthal for discussion.. Much discussion took
place, and the vote was called. The motion failed by a vote of 1/4 with
Mr, McClure voting in favor, all other Members voted no. The action of the
Board was explained to Mrs. Daum.
3. REQUEST FOR APPROVAL OF VARIANCE TO ALLOW TREE. TRELLIS/PLATFORM
AND HOT'TUB IN SIDE YARD AND REAR SETBACK

Mr. LuBien announced that the request had been withdrawn,

BARNETT BANK, 9190 BISCAYNE BLVD.
Mr. LuBien noted Barnett Bank had been before the Board before to request
a dish antenna and he discussed this with their representatives here this
evening. He noted that Members received a copy of the building showing where
the antenna is to be mounted and how. Mr. Bruce Apel, and Matthew Grieb in-
troduced themselves and asked what the Board needs. They have not read the
Miami Shores Village Satellite dish code. They noted this is a two way
communication for uplink and downlink arid they indicated it will not interfere
with other systems. After much discussion, it was determined this is a request
for a variance for uplink. They were advised that .a. $50.00 fee is required for
variance request.
Mr, Forney moved to approve the variance request for upldnk, seconded by
Mr. Chambers, and passed unanimously.
The request must go before Council:for approval..
Mr. McClure noted that when there is a variance request the applicant must
state the unique reason for the request, and the record should show that in
modern banking facilities two way communication is needed.
Nr. Laubenthal moved for sife plan approval, provided the drawings as
amended (showing setbacks and landscape screening are used) the motion was
seconded by Mr, Forney,and passed unanimously,.

REQUEST FOR APPROVAL OF FLAT ROOF ADDITION

Mr, LuBien presented th_e..calculations for the .flat roof addition,
limbers received in their packet architect drawing of the addition and the
elevations, The application was discussed, and the. roofing ordinance to be
sent to Council was explained, Mr, Alb,aladejo wants to proceed with his
request.
Mr. Chambers moved to approve the request as submitted, seconded by
Mr. Laubenthal, the motion passed unanimously,
6. REQUEST FOR APPROVAL OF GARAGE ENCLOSURE
Alan Major, 105 N. W. 94th St.
The narrow one car garage which Mr, Major is unable to use was discussed.
Also, Mr. LuBien explained the roof structure on the small addition in front
of the garage, and showed it on the drawing, Mrs. Major noted the driveway
will be cut back, and landscaping installed. The single family character was
explained to the Majors'.
A motion was made by Mr. Laubenthal to approve the request withthe
amendments to cut back driveway and landscape, seconded by Mr. Chambers, the
motion passed unanimously,
8. DISCUSSION - PERMITTED USES, B-4.DISTRICT & FOOTPRINT
The proposed changes to B-1 District (the final draft) was discussed at
length. Especially mentioned were the Theatre, Gasoline Service Stations,
Schools, Studios, and Printer,and Tour & Travel Agency, Mr, LuBien read from
the County Code and Zoning section 33-4, Decibel levels were discussed.
Mr. Forney made a motion to approve. as.discvssed and send to Council the
Proposed Changes.to B.--1 District.Uses, the motion was: seconded by Mr, Laubenthal,
and carried unanimously'',
Mr. Fernandez noted there is no pressing need for this to go to Council and
the minutes must be approved first. All Members agreed.
The footprint needed for N. E. 2nd Ave was discussed at length. This would
be an excellent planning tool. It will be a necessity for any pro -active approach.
The markings are in the alleys by Florida Power & Light, Southern Bell, and the
Water Department. This information may be available, but not drafted. Members
agreed in light of recent hearings on. N. E. 2nd Avenue and the lack of money
availablereceipt of the footprint will not be recommended.
9. COMPREHENSIVE REVIEW 7 DOWNTOWN,MIAMI SHORES
Considering the hour, 9. was passed on, at this time, by a motion made by
Mr.. `Laubenthal, seconded. by Nr. Forney and passed iiraenimously,

Mr. Fernandez gave a. report of the Ad Hoc Committee which: net yesterday
evening, The =census opinion was. that.DRB be. disbanded, retain certain pro-
jects such. as Haloween Bowl, etc, 'Maintain DEB Guidelines and rename DRB

architectural guidelines, and to form a Miami Shores F.evitalization Board
with an expanded role as to promoting development in a joint venture with the
Chamber of Commerce, Details to be looked at next Week, Thee Chamber will
develope .a marketing plan., This is expected to expandon the Business
Development Comm ttee report, and to get away from N. E. 2nd Ave, as the sole
focus of a business district,
M .yor Steve. Johnson of Miami Shores was present for the whole 'meeting
and was recognized. He did not wish. to speak.,
