The meeting.was called -to order at 7:35 P.M. by Chairman, lir. Fernandez .with: the following members present. Richard M. Fernandez Terrell F. Cham&ers, Jr. Les Forney Thomas Laubenthal Larry T. McClure Also present: Frank LuBien, Director of Building & Zoning 1. MINUTES - JUNE 13t 1991 The minutes of the meeting of June 13, 19.91 were approved by a motion made by Mr. McClure, seconded by Mr. Laubenthal and passed unanimously. Mr. McClure made. a motion to move 4. on the agenda to 2., and to move 5. to 3. The motion was seconded by Mr. Forney and passed unanimously. 4. SITE PLAN REVIEW MIAMI SHORES ELEMENTARY SCHOOL Mr. LuBien explained to Members that Mr. Manuel Reyes, Architect presents his plan as a courtesy to the Board, Mrs. Della Zayer, Principle of Miami Shores Elementary also was present. Mr. McClure explained that he is an employee of Dade County Schools, has never worked in construction and has no conflict of interest. department or with the architect. There is Mr. Reyes showed Members photos of the school as it exists. Large chart - boards showing the addition, elevations, and plans were reviewed for Members. Guidelines for Dade County School Board and the State have been met. The addi- tion is a reference to the existing building without copy. There will be eight classrooms to be used for art, music and resource. A two story building on 103rd Street and 6th Avenue. Music & art ,rooms Will be directly in back of the existing bandshell. Administrative offices will be refurbished, kitchen redone, elevators added, and air conditioning for the new area. Discussed were ramps for the handicapped, drainage and windows. Colonade will be extended to the new. Bike racks will be moved and fenced. The project is already funded. Student population at the school was discussed. Date of construction commencement also was discussed. Work will be m.nim Zed when school is in session. Final open- ing day is projected for the new school year 1993. There was discussion concern- ing the additional baths and use of septic tanks, it was noted that rules which apply to others do not include the Miami Shores Elementary School. Members con- cluded the addition is beautifully done, and complimented Mr. Reyes on his work. 5. REQUEST FOR APPROVAL OF VARIANCE TO ALLOW TREE TRELLIS/PLATFORM & HOT TUB IN SIDE YARD. AND REAR SETBACK ' JOHN E. CAHILL, 1060. N. E. 104th STREET Mr. LuBien stated that Mr, Cahill called to withdraw his request and have it placed on the next agenda so that he can be better prepared. (. Mr. Fernandez made considerablecomments concerning the septic tanks, specifically,"Why are the] being allowed to expand their septic tank installation without sewers, & why wasn't Dade Cly Public Schools being forced to bring a sewer line down 103rd St?" To which Mr. Reyes responded? "There are specific exceptions by DERM, sewer hook ups are not uraticle_ PLANNING & ZONING BOARD REGULAR MEETING & PUBLIC HEARING -2- 6/27/91 2. ROOFING ORDINANCE - PUBLIC HEARING Mr. Fernandez read the. Ordinanceby title and noted ad for Public Hearing. Mr. Laubenthal explained fore, about eight persons present, the work which the Planning & Zoning Board did in preparation for this modification in the Roofing Ordinance. Tile will remain for the pitched roofs, for flat roofs, new material which is more affordable and lasts longer is added. Mr, Chambers made a motion to semi this Ordinance to Council, seconded by Thomas Laubenthal, Mr. McClure offered an amendment to recommend that Council approve same. Amendment was accepted by Mr. Chambers, accepted and seconded by Mr. Laubenthal and carried unanimously. be Aluminum awnings willAdiscussed at the next meeting and Mr. LuBien will obtain a speaker for this agenda. 4. Miami Shores Elementary School. Mr. McClure moved that the Miami Shores Elementary School issue return to the floor, seconded by Mr. Laubenthal, and passed unanimously. Mr, Forney moved that a formal letter, complimenting th4 Architects work be sent , seconded by Mr. Laubenthal, and carried unanimously. This in response to request from Mrs. Zayer. 3. BASKETBALL ORDINANCE - PUBLIC HEARING Mr. Fernandez read the ordinance by title. Discussion began with Ms. Lillian Walls, 560 N. E. 95th St, who commented, she is opposed to Basketball Goals because of the imposition on neighbors, a great damage to the Community, reduction of property values, Community Center with courts accessibility. She feels this is a job imposed on Planning.& Zoning by Council. People have not been properly informed, A letter should go out to each property owner in Miami Shores. Mr. Fernandez agrees very strongly with. Mrs. Wells, and intends to vote No on the ordinance, Mr. Laubenthal noted his concern, that the structure will not comply with setback requirements. The ball can be hit out of place. He strongly opposes the basketball goal:. in the front yard. Mr. Forney commented,:all the horrible things that might happen.. are mentioned, but there are many good neighbors in Miami Shores who will curtail activity when approached properly. Mr. McClure & Mr. Chambers will reserve comments for later. Douglas M. Jacobs, 1284 N. E. 94th St, does not -find -`.the ordinance offensive, HA wondered.howmany complaints there havebeen, stating he feels it is a Code Enforcement issue, Mr. Jacobs disagreed that there is.a decrease in property value. Many ,young. people, are moving into Miami Shores and basketball is right up there with_ patriotism, Mom and apple pie-. PLANNING & ZONING BOARD REGULAR MEETING & PUBLIC HEARING ,3-, 6/27/91 John P. Davies, 150. N, E, 106th St, makes a living working with children. Child play in the front yard is not a nuisance. Children should be permitted to laugh. and play wherever. Margaret Burch of 170. N, ' W, 105th St„ , feels that children playing basket- ball is ok in the back yard, The codes regulate hedges,. fences, etc., why not the looks and the noise of basketball goals, Dick Lasch of 345 N. E. 1QOth.St,, is opposed to basketball goals in the front yard. The.:±slue eemay Tiat"is=:..1.ditafter Che_ gdxneis played, an un- sightly goal", Betty Lasch, 345 N. E. 100th St,, also apposes basketball goal inthe front yard. Backyard play is ok, The basketball goal in the front becomes an eye- sore after a while, Mr. McClure says the wording of the Ordinance is somewhat hazy. It was never intended that the backboard be attached to the house., It disturbs him that people havea problem with children playing, Children should be. allowed to play in the front yard or wherever, Mr. McClure would like to see changes in this Ordinance. Mr. Laubenthal wholly approves of child play and encourages this activity, but not in the front yard. Basketball goals in the front yard become unsightly, dangerous, and deminish the property value. Mr. Chambers noted that a pool in the rear yard, or a bar b que can be as much a nuisance as basketball. He would encourage child play wherever. Mr. McClure would like to see two changes made in the Ordinance. Sec 1 of f X31 Dimensions; Basket.height may be up to 10'. Under Sec 5. add d. Court:.areashall not be outlined or painted. Mr. McClure made a motion to approve the Ordinance with the changes and recommend it be sent to Council, The motion was seconded by Mr. Forney. Discussion & comments continued concerning noise control and lit courts. An amendment offered by Mr.'Laubenthal for (2) Location: and a 25' setback from front property line was killed as not accepted by Mr. McClure. Mr. McClure also would add (11) Play only in daylight hours, This addition was not accepted by Mr. Forney. The vote was called, and the original motion made by Mr. McClure passed 3/2. Mr, Forney, Mr. McClure, and Mr. Chambers voted for, AMr.' Fernandez and Mr. Laubenthal voted agains t . A break was taken at 9:15 P.M.., The meeting reconvened at 9:25P.M. 6. COMPREHENSIVE REVIEW - DOWNTOWN MIAMI SHORES Mr. Fernandez has a copy of the book of prepared material for the ad hoc committee dated 9/4/84 with spicificz1bning changes recommended. Mr, Laubenthal passed::.aut a typed sheet of his comments, and gave a summary presentation. • • PLANNING & ZONING BOARD REGULAR MEETING & PUBLIC HEARING -4- 6/27/91 Mie, Forney commented that one need only look at the economie situation ri)Dade.County-to know. that Downtown Bevi_teltzation is dead. We must be very, very careful_in looking at changes .in the present structure, Mr. McClure noted be would like to review the material in this "Blue. Book". He is very disappointed that no one has the answer to the, problem, Mr. Chambers noted we have.many.rules regulations in place, we.must maintain the single family characteristic. Be has no problem with a height increase up to 10% Mr. Fernandez commented that owners will not appear for the hearings. We most hold the line and face facts., it is a mistake to expand used beyond what we have. There is no mutuality of developers and owners, and this is necessary. It was requested that Mr. LuBien make a copy of the "Blue Book" for each Member of the Planning & Zoning Board. NEW BUSINESS Mr. LuBien opened discussion regarding the Print Shop which is opening in Miami Shores (N. E. 2nd Ave.). Following brief discussion Mr. McClure suggested Mr. Fernandez talk the situation over with the Village Attorney to see if the issue can be resolved. A brief discussion concerning the expenditure of $5,500.00 for buildable footprint of Miami Shores downtown, It was determined this item will be on the next meeting agenda listed as Changes in B-1 District.
