03-23-1988 Public HearingMIAMI SHORES VILLAGE PLANNING & ZONING BOARD MiEETING PUBLIC HEARING March 23, 1988 The Miami Shores Village Planning & Zoning Board convened on March 23, 1988, at the Miami Shores Village Community Center, at 7:30 P.M.. Chairman Rossi called the meeting to orderwith the following members present: Robert J. Rossi, Chairman Terrell F. Chambers, Jr. Richard M. Fernandez Thomas Laubenthal Larry T. McClure Also present: Frank LuBien, Director of Building & Zoning Elly F. Johnson, Village Manager Spero Canton, Mayor William F. Fann, Jr., Village Attorney 1. MINUTES - March 10, 1988 A motion was made by. Mr. Chambers to approve, as written, the minutes of March 10, 1988, seconded by Mr. McClure, and passed unanimously. 2. REQUEST FOR APPROVAL OF REROOF WITH WOOD SHAKES J. H. Keffer 1234 N. E. 96th St. Mr. Keffer was not present to make his request. Mr. LuBien presented the information with a letter from A.A. Mandel, P.E., Consulting Engineer, stating the roof structure will not safely support concrete roof tile and recommended that the new roofgo back as existing wood shakes. Mr. McClure moved to approve the variance for wood shakes, for the non- conforming roof, based on the letter from the Consulting Engineer. Motion was seconded by Mr. Laubenthal and passed unanimously. 3. PUBLIC HEARING EVALUATION OF N.E. 2nd .AVE BETWEEN 94th ST. AND EL PORTAL LIMIT TO DETERMINE NEED, IF ANY, TO CHANGE ZONING CLASSIFICATION. Mr. Rossi in opening the meeting, first established the hearing is conducted as a directive from Council, the notice of Public Hearing was advertised in Neighbors, Sunday, March 20, 1988, also notices were sent to all property owners within 5O0/radius of the subject property. This meeting is being held for the purpose of in -put from immediate surrounding property owners, and others as might be interested in the hearing. Approximately 60 people attended the meeting. Mr. Rossi then noted that anyone present who wishes will have the opportunity to speak. He requested each come forward to the microphone, state name and address, identify area of proximity, and limitcomments to five minutes. Hillie Cuesta, 235 Grand Concourse, stated she moved into her home four years ago. She feels rezoning the area on N. E. 2nd Ave. is a bad idea, it simply extends a business district, that at this time is not being fully supported. Downtown needs tobe refaced and made more appealing. She moved into the area because her husband lived here before. St. Rose Church and School are good for her family. Miami Shores seemed a stable community in which to raise her children. Young people who lived here before are moving back & revitalizing the area. PLANNING & ZONING - PUBLIC HEARING -2- 3/23/88 Mr. Robert Frix, 270 N. E. 92nd St. noted he lives within 300' of the proposed area. The request for rezoning is actually Modified Commercial not Modified Residential. There is no need for it, as his two exhibits will establish. The first is a petition signed by 141 residents of Miami Shores who feel the zoning change in this area is unwarrented. As of 10:00 A.M. today, study revealed ten (10) vacant locations in Miami Shores Business District, for a total of 15, 750 sq ft. This space should be occupied before the business district is extended. Police have a difficult time policing the present district, extending would strain their efforts. In response to query, Mr. Frix further stated this 141 signatures is approximately 40% of the affected area residents. Mr. Rossi requested the petition be made a part of the minutes for the public record. Barbara North Burton, Of c: 9999 N. E. 2nd Ave - Res: 1202 N. E. 101st St. Being respectful of research done concerning the vacancies, she stated that a group of doctors have bought Center Pharmacy and will soon occupy the space. She expressed concern that 141 people would sign a petition for no change. She further stated, there are only 3 parcels in her rezoning request. 215 Grand Concourse is a major blight in the area and the two vacant lots a trash pile, she stated. This change will increase the tax base which is needed. In her newest petition for rezoning the two vacant lots, Dr.<Farrow has joined with her. She further stated that she has obtained oral legal opinion from several attorneys that this is not considered spot zoning, as stated. The only action coming from this meeting should be the decision to hold a legally called Public Hearing. Mr. Rossi noted he has not been privy to the latest petition for rezoning two other parcels, and requested the map be left with the Board for review. Also this is a public hearing, as requested by Council to look at all property on N. E. 2nd Ave, not just one or two pieces. Marcus Ambrose, 234 N. E. 92nd ST.. Mr. Ambrose stated his home is at the edge of the proposed area of change. He stated this item has been brought up, and discussed several times and each time residents have said, no to special interest. How many times does this come up? He bought his house as a res- idential neighborhood and the character of the Village is important to him. He is not in favor of alleyways becoming streets, back yard - a parking lot. He has spent $35,000. on improvements in six months. Young people are coming in and spending money on fix up. Mr. Ambrosewent on to say that this change is not needed nor necessary, and if approved property values will diminish. Ms.. Phillips, 253 N. E. 92nd St.. Ms. Phillips reminded all that we should be looking at all options. They moved into their home 1z years ago, because of the beautiful residential character. She has spent heavily to remodel, but now has other projects on hold until this issue is resolved. Ms. Phillips further noted the Zoning Board has been asked to look at alternatives for the buffer. Park is a buffer, expanding the business district is not. Donald Clippinger, 165 N. E. 98th St.. Mr. Clippinger stated that what happens on N. E. 2nd Ave. is everyones business. He moved to Minimi Shores last Oct. and loves it here, this is the oasis of Northeast Dade County. El Portal it- self is sufficient buffer. There is adequate provision for a resident office in the Miami Shores Village Code. There is enough commercial space available in Miami shores without moving south. PLANNING & ZONING PUBLIC HEARING -3- 3/28/88 Warren Wilson, 520 N. E. 102 St.. Speaking for himself and his father-in- law, Mr. Koppen who has an office on Biscayne Blvd. Mr. Wilson said that because of much controversy surrounding this issue, sides are being chosen, and we are loosing perspective. It does affect everyone and must be looked at from an overall standpoint. He is in favor of rezoning because it is a progressive move. Mr. Rossi reminded the people that the Board is also looking for new ideas. John F. Riddell of 253 N. E. 92 St., noted that he has been in Miami Shores 11/2 years and will relocate and rent his house if this rezoning takes place. Four young people have moved in and invested large sums in their homes since he moved in. We need to continue this trend and protect homeowners. Miami Shores should be advertised more. John L. Zavertnik, 155 N. E. 92 St. Mr. Zavertnik lives within 100' radius of the proposed change. He is concerned with the safety of his four children, the increase in traffic pattern and the increase in parking. There has not been a problem in the area in the twelve years he has lived there. This change must be considered very, very carefully. Wesley McCravey who lives at 258 N. E. 92nd St. moved here from Coral Gables many years ago. He raised his children here and has always loved the area, he wants it kept as a residential community. Mr. Harrigan, 260 N. E. 99th St. Mr. Harrigan commented, this Board had al- ready voted thumbs down on this issue and Council sent it back to be recon- sidered, it seems zoning and real estate is where the money is. This Board determines what is best for the Village, they don't have to be concerned with re-election. He has read and heard many promises for the area. Dade County, at this time is faced with many zoning problems and learning to say, No. Police visibility and protection are being strained now. He favors a park. Deborah Seigler, 10603 N. E. 10th P1. Which is not near the area discussed. She commented that she moved here six years ago and if you want to see problems live near the Motel on Biscayne Blvd at 105th St.. These people have sunk $ into their property and they must realize sometimes land use must be changed. She defended Barbara North Burton, all her efforts on behalf of of Miami Shores Village and her efforts for rezoning at this time. Ms. Seigler is not in favor of a park and feels an appropriate buffer , as requested will not change the character of Miami Shores. She favors a change in land use. Mark E. Bachmann, 166 N. E. 93 St.. Remarks made by Mr. Bachmann reflected on his drive on the expressway system to work in Pompano, the accessibility to the system from his home. His father-in-law lives in Miami Shores. His wife was born and raised in Miami Shores. His children play in the alley in Miami Shores. He loves the residential character of Miami Shores Village. Dan Piscitelli has lived at 138 N. E. 92 St. for four years. Miami Shores is a beautiful residential community. If this property is rezoned for commercial it may increase tax base, but decrease property values. If the area is derelict and violations exist there are rules on the books to enforce correction. Code enforcement should take over. PLANNING & ZONING PUBLIC HEARING -4- 3/23/88 Mrs. Wilson lives at 236 N. E. 93rd St., and is opposed to rezoning. She looks out over the vacant property and does not find it less than desirable. These vacant lots are not, nor have they ever been a trash .pile. Mr. Rossi received no response to his request to hear from anyone who owns or lives in the actual property affected. Mrs. Pat McIntosh of 313 N. E. 92 St. commented, she is one of those 8 to 10 people who went out to obtain the 141 signatures opposed to the change. She said they quit at this 141 count when it was evident that approximately ninety out of 100 people seemed opposed to the change. Aue Dr. DeStaf.ano, 265 N. E. 92 St., has lived 200' from the proposed property change for 24 years, it is the overwhelming concensus that there shall be no change. Mr. Ambrose stated he is not opposed to change but feels this rezoning is detrimental to the community. He noted that no homes have been built on the vacant lots because of the uncertaintity surrounding the zoning issue. He gave an example of homes being built on Biscayne Blvd. with lush, lovely landscaping, and walls surrounding the homes. Mrs. Burton again noted this is no high level business zone. She has a secretary and associates and intends a professional office with a residential facade. She further noted this is not a bona fide public hearing as Mt. Sinai nor the owner of the vacant lots received notice of this hearing, or they would have supported the change. Mr. LuBien in response to question from Mr. Rossi, stated that the person Dr. James sold his house to was in very recently for a copy of the prints and wants to return the house to a single family residence. Also, the owner of 2 vacant lots had indicated a desire to build homes on the lots. In response to query from Mr. Fernandez, Mr. Fann, Attorney noted that no study has been made of this property and it is simply a request from one person to rezone and in his opinion it is spot zoning, which is prohibited. Zoning change must first be made through comprehensive study, and then the Comprehensive Plan must be changed. Use variances are allowed in some communities, but is illegal in Miami Shores. Statements from Board Members followed. Tom Laubenthal thanked everyone for turning out, he replied to those who asked, how long can this go on. He is thankful for the process that gives one the right to present a request. The preception tonight is for Community to present both issues. Overall the change is not a favorable idea.. The area is not conducive to this change. He does like the idea of an upgraded look, new home construction and a brochure advertising Miami Shores Village. Terrell Chambers noted, we need more advertising for Miami Shores and Miami Shores Business District, he would promote this advertising. He would like to see the approach developed, what can be done in downtown Miami Shores, We need more retail business not more offices. We want the recommendations to come from the Public. PLANNING & ZONING PUBLIC HEARING -5- 3/28/88 Larry McClure also thanked those who turned out to help Members determine if there is a need. There is the question, do the advantages outweigh the disadvantages? It is no extension of the business district as retail sales are quite different. He sees no increase in traffic to N. E. 2nd Ave., but is concerned for children in the area and does not want to .see alleys turned into streets. There is no great increase in tax base. Increase in police protection and visibility is not affected, and finally there has been no real expressionof need for rezoning the property. from those attending the meeting Richard Fernandez apologized that the expressionsAhere have been of a personal nature and they shoud not be, but are a difference of opinion. He has heard no persuasive argument showing a need. The charge of the Board is to protect the residents and feels the request is unwarrented. He had gone on record before as being opposed and continues to oppose. This is basically a residen- tial community, his home and business is in Miami Shores. He is in favor of reviewing other ideas for buffer area, but opposed to rezoning. made by some of the public during the Pub. Hearin Mr. Rossi apologized. to Mrs. North Burton for the personal attarlksA she has worked hard in many different areas for Miami Shores Village. He further noted the charge from Council was to look at buffer ideas, beginning with N. E. 2 Ave. The personal request which came before the Board may be classed as mixed use commercial. The purpose of this hearing has been accomplished. Resdients are happy in the area and have no major problems, it would be an injustice to change the character of the residential neighborhood. Mr. Rossi liked the idea of possible tax relief on the vacant lots and toward develop- ment in residential character. Code Enforcement may also be pursued,they need help both financially and support. Any action taken needs to be reported back to Village Council. Following further discussion, Mr. Chambers moved to have a legal Public Hearing with notices being sent certified mail. Motion failed for lack of a second. Additional comments followed, concerning process for change. Mr. Fernandez made a motion to report to Village Council that this Board has studied the issue, and found no need for rezoning the property. Motion was seconded by Mr. Chambers. Discussion continued by Mr. Grau, 857 N. E. 98th St., is the question being answered? Council says there is a problem. He further mentioned real estate prices, difficulty in financing and property values, and a need for a profess- ional planner. Members responded that what was said is, there was no need established, add Robert Swarthout who is preparing our Comprehensive Plan for Miami Shores is a Professional Planner. Mr. Boyle, 585 Grand Concourse, commented he had been present all evening, watching and listening to the whole process. .Board Members came very close to resolving the issue. of in -put has been these people like the way it is, it was made clear they want no changes made and they should be listened to. Consensus PLANNING & ZONING PUBLIC HEARING -6- 3/28/88 Following further discussion the vote was called and motion passed by unanimous vote. Brief discussion followed, concerning Council action when this matter goes back to them. Also Planning & Zoning Board did not act on the petition, as it was not presented to them, further the Village Attorney has advised that this is spot zoning, and his opinion is accepted by the Board. 4. Though not on the agenda, Members received in their packet an outline of the Code Enforcement report from Councilwoman Marty Stofik. Mrs. Stofik requested that Mr. Rossi, and one other Member of the Planning & Zoning Board; Larry McClure, volunteered, join with volunteers of Council, and Code Enforce- ment Board as a Work Group to make recommendations for streamlining procedures and how additional manpower could best be utilized. Mrs. Stofik reported this group will meet after the Code Enforcement Board. Meeting in April.
