PLANNING & ZONING BOARD MEETING
MAY 14, 1987
The Miami Shores Village Planning & Zoning Board meeting was held on
May 14, 1987, at the Miami Shores Village Hall, Chairman Stobs called the
meeting to:.order at 7:30 P.M., with the following members present:

Patrick L. Duffy
Thomas Laubenthal
Larry T. McClure
Robert J. Rossi
Absent: Frank LuBien, Director of Building & Zoning
1. MINUTES, April 23, 1987
The minutes of the meeting of April 23, 1987 were approved, as written,
by a motion made by Mr. Laubenthal, seconded by Mr. Rossi, and passed by
unanimous vote.
2. REQUEST FOR APPROVAL OF RESIDENCE DESIGN
KEN RICH
920 N. E. 99th ST.
Mr. Stobs explained to Members that this is not a site plan approval, but
a request for approval of design for a new residence to be constructed on
a vacant lot.
Mr. Rich was absent, but Mrs. Rich did reply to query that it is a 75' lot.
Her brother Michael Grillo, whom she said is a builder, answered other
questions the Members had.
Following discussion, Mr. Rossi moved to approve the design, seconded by
Mr. Laubenthal, and passed by a 4-1 vote, with Mr. McClure dissenting.
(The reason being, he did not feel the design in harmony with other houses
in the area.)
3. REQUEST FOR APPROVAL OF FENCE INSTALLATION
MICHAEL BYRD
9500 N. E. 6th AVE.
Mr. Byrd explained that Mr, LuBien felt this request should be approved
by the Planning & Zoning Board because of the unusual nature of the house.
The rear property line is the side property line of the abutting plot. In
essence, the chain link fence will be at the front yard .of the abutting
plot. The previous owner had a hedge at the property line, but he prefers
a fence.
Members reviewed a drawing of where the proposed fence will be installed.
Mr. Rossi commented that although this is not an everyday occurance, it is
not unique.
Mr, Laubenthal moved to approve the request7 seconded by Mr. McClure, and
the motion carried by a unanimous vote,

Mr. Rossi excused himself at this point.
4. REQUEST FOR APPROVAL OF VARIANCE TO PARK MOTOR HOME
KAROLY VARADI
10610 N. E. 10th CT.
Members reviewed a letter from Mr, Varadi, in which he noted that he is
contemplating the purchase of a 30' motor home, which when not in use,
he planned to park in the back yard. The request is for a variance to
Appendix A- Zoning, Sec 501 (s)(1).
Mrs. Varadi stated that 30' is considered a standard size for recrea-
tional vehicles and 20' motor homes are not being manufactured. Further
she stated, the motor home when not in use on the road, will be parked
in the back yard, out of neighbors view. At no time and under no cir-
cumstances will the vehicle be used as living or sleeping quarters within
Miami Shores Village. She stated also that there are at least five other
instances where a motor home is parked at the residence.
Mr. Stobs advised Mr, & Mrs. Varadi, this section of the Code applies not
only to motor homes, but also to boats, Also, the recreational vehicle
can be seen from the Golf Course. Any other violations to the Code in
Miami. Shores Village are a situation for the Code Enforcement Board to
look at.
Mr. McClure noted, because of the very strict guidelines, a variance is
not in order, however, he is not opposed to reviewing this Section of the
Code, at a future date.
Following continued discussion, Mr. Laubenthal moved to deny the request
for lack of grounds for a variance. Motion seconded by Mr. Duffy, and
passed unanimously.
Mr. Stobs then explained the appeal to Council process to Mr. & Mrs. Varadi.
Mr. Rossi returned to the meeting.
5. REQUEST FOR APPROVAL OF PLANS FOR ADDITION & ALTERATION
FRANCES KING
469 N. E. 91st ST.
The area of the present building is 2,444 sq ft, and the proposed addition
is 1,126 sq ft. The set backs as required by Code are 25' front, 10' side,
and 15' rear. The setbacks provided here are 244' front, 4'2" & 5' side,
and 46' in the rear. The property is non -conforming, structure encroaches
on the required setback.
Mr. Nathan Wimberly and Mr. Charles Smith, Architect noted1he gazebo will
be removed, but the garage in the rear will be remodeled. The character
of the house:will be maintained, The garage in the rear does have a kitchen
and was rented in the past, but all this will be removed in the remodeling
process. Mr. Smith outlined changes to be made and answered questions asked
by the Members of the Board.

Mr. Stobs explained that the structure is non -conforming, and to grant
a variance is to compound the situation. Discussion continued concerning
the non -conformity, and the fact that in order to grant a variance the
request must meet two of four of the requirements for a variance, which
is not so in this case. Mr. Stobs also advised Mr. Smith that if he
works within the 10' set back, Mr. LuBien could approve the project.
Much discussion continued, as several alternatives to plans were recom-
mended. Mr. Smith stated he wanted a decision this evening, and did not
wish to withdraw the request.
Following further discussion, Mr. Stobs advised Members the request could
be acted upon, followed with special direction to Mr. Charles Smith, the
architect, and for Mr. LuBien, Director of Building & Zoning.
Mr. Duffy moved to deny the request for approval of the plans for addition
and alterations as submitted. Motion was seconded by Mr. Laubenthal, and
passed by a unanimous vote.
Direction to Mr. LuBien as outlined by Mr. Duffy follow:
1. There is no problem with the glass enclosure of the sun deck.
2. Garage may be enclosed if it meets with the normal garage enclosure
standards.
3. The driveway ribbons to the existing carport must be cut short, to
make room for a planter or separation, so as not to give any appear-
ance of enclosure.
4. The existing rear garage may be remodeled, however, if rebuilt, the
proper set back is required.
5. New building additions must adhere(to the required set backs.
6. REQUEST FOR APPROVAL OF EXTERIOR COLOR
JEAN EDMOND
189 N. W. 97th ST.
It was noted that this house has been painted without a permit.
Jean Edmond was not present, but had listed two other locations where he
felt the color is similar to the color he used.
In discussion, Mr. McClure noted that he is not in favor of such a dark
gray color. He felt that in previous discussions Members favored more
pastel colors. Mr. Stobs felt the color submitted for approval should
be.no darker than the two locations Mr. Edmond mentioned.
Mr. McClure moved that, Mr. LuBien request from the applicant a more
realistic color sample and compare it to the present house color, and if
it is in fact darker, it should not be approved. Mr. Laubenthal seconded
the motion.
In further discussion Mr. Duffy is not in favor of the concept of placing
the burden on the owner. Mr. McClure felt therehhould be a limit on how
dark the color should be.
Mr. McClure called for the vote, and the motion carried by 4-1, with
Mr. Duffy dissenting.

7. Mr. Stobs outlined the dates of regular Planning & Zoning Board meetings
when Robert K. Swarthout, Inc. will attend to discuss the New Comprehen-
sive Plan. He requested that Members make a note of the dates and advise
him of any conflicts. The dates listed are Jun4ll, 1987, July 9, 1987,
and Autust 13, 1987.
There being no further business to come before the Board, the meeting adjourned
at 9:15 P.M.
