PLANNING & ZONING BOARD MEETING
September 11, 1986
A regular meeting of the Miami Shores Village Planning & Zoning
Board was held on September 11, 1986, at the Miami Shores Village Hall. The
meeting was called to order by Chairman Robert Stobs at 7:30 P.M., with the
following Members present:

Patrick L. Duffy
Thomas Laubenthal
Larry T. McClure
Robert.J. Rossi
1. MINUTES
The minutes of the meeting of August 28, 1986 were approved as
written, by a motion made by Mr. Rossi, seconded by Mr. McClure,
and passed uanaimously.
2. REQUEST FOR APPROVAL OF PLANS FOR GARAGE ENCLOSURE
ROBERT LATIMER
53 N. E. 109th ST.
This request was tabled at the last meeting, pending a request from
the Board that Mr. LuBier/survey the interior and report back at this
meeting, also Members requested that a floor plan be furnished.
Mr. LuBien reported that the enclosure is complete, and all is in
order. Members received in their packets a more complete floor plan.
Mr. Duffy moved to approve the plans as submitted, seconded by
Mr. Laubenthal and passed unanimously.
3. REQUEST FOR APPROVAL OF PLANS FOR RESIDENCE
ALBERTO DIAZ
LOT 4, BLK 1, BISCAYNE RIVER HEIGHTS
Following changes to these plans which do not conform to the Code,
Mr. LuBien made a futile attempt to contact both the owner and the
architect to inform them. There was no representative at the last
meeting to respond to questions. Mr. Stobs requested that this
request be scheduled for this meeting, and that no permit will be
issued before the proper plans are submitted and approved.
Much discussion took place concerning the flat roof deck at the
2nd floor elevation, this gives the appearance of a flat roof
addition to a pitched roof. Mr. LuBien noted that he noticed the
terrace with the rail and spoke with Mr. Diaz, offering several
alternatives, but Mr. Diaz apparently had not discussed this with
his architect, Mr. Ruiz.
Mr. Rossi agreed with Mr. LuBien that Mr. Ruiz is to be commended
for his efforts to create a pleasing design, considering the irregu-
larity of the lot. Nevertheless there is the fear that granting this
request would lead to others of a similar nature.

Much discussion continued regarding decks, terraces, and flat roofs.
Mr. Ruiz indicated that Mr. Diaz is not pressed for time to build his
home, they will be open to suggestions from the Board and are willing
to listen and abide by the Miami Shores Village Codes. Further, Mr. Ruiz
stated that he will come into Village Hall for a Code book and take
the plans back for further discussion with Mr. Diaz. They will work
together and re -present an acceptable plan to the Board.
Members agreed thatif the terrace remained, aesthetically speaking,
a roof is more desirable. It was finally determined that alternative
plans will be submitted.
The meeting adjourned at 8:15 P.M.
