08-14-1986 Public HearingMIAMI SHORES VILLAGE PLANNING & ZONING BOARD MEETING PUBLIC HEARING August 14, 1986 A regular meeting and Public Hearing of the Miami Shores Village Planning & Zoning Board was held on August 14, 1986, at the Miami Shores Village Hall. The meeting was called to order by Acting Chairman, Mr. Rossi. at 7:30 P.M., with the following Members present: Robert J. Rossi, Acting Chairman Patrick Duffy Thomas Laubenthal Larry T. Mc Clure Absent: J. Robert Stobs, II Also present: Frank J. LuBien, Director of Building & Zoning 1. MINUTES The minutes of the meeting of July 24, 1986 were approved as written, by a motion made by Mr. Laubenthal, seconded by Mr. McClure and passed unanumously. 2. REQUEST FOR APPROVAL OF PLANS FOR GARAGE ENCLOSURE MELBA CATHER 158 N. E. 110th ST. Members reviewed plot plan, floor.,plan showing garage side of the house and floor plan of the converted garage. Also note from Melba Cather explaining changes to be made. Melba Cather was not present. Mr. LuBien explained the front portion will be a bedroom and bath, and the rear portion will be maintained as a laundry room. There is no access door to the exterior except from the utility room. The other door into the bedroom is from the kitchen. Mr. Rossi explained to Members that normally.a front elevation view is necessary, however since the garage is at the rear of the house it is not necessary. Following brief discussion Mr. Laubenthal moved to approve the plans as submitted, seconded by Mr. Duffy, and passed by a 3-1 vote, with Mr. McClure dissenting. 3. REQUEST FOR APPROVAL OF PLANS FOR NEW SINGLE FAMILY RESIDENCE ALBERTO DIAZ LOT 4, BLK 1, BISCAYNE RIVER HEIGHTS Members received in their packets for review: a tract plan, a survey sketch showing the house on the lot, front elevation as the house will face 104th St., and elevation as it will appear on Biscayne Blvd. PLANNING & ZONING BOARD MEETING PUBLIC HEARING -2- 8/14/86 Mr. & Mrs. Alberto Diaz were present. Ricardo Ruiz, Architect indicated several window changes he expects to make on the house plans. The purpose is to comply with the code for 10% ventilation in the rooms. Also there will be a gable change. There being no further questions, Mr. McClure moved to approve the plans as submitted, seconded by Mr. Laubenthal, and passed unanimously. 410 4. PUBLIC HEARING - LIMITING USE IN "X" ZONE TO PARKING LOTS ONLY There were no residents or owners present to express sentiment con- cerning this issue. Mr. LuBien advised Members that he was requested to.advise the Board, the main reason for this scheduling before the Board along with the concept of Downtown Revitalization is to preserve those lots not yet built upon, because of the premium of available land. Members reviewed a map indicating properties "x" zoned. Some owned by the Village, some privately owned, some being business with parking in rear, some have homes now, and some are paved and others unpaved. Much discussion continued concerning property becoming non -conforming, appeal of tax assessment, and direct notification to owners of record. Mr. Duffy inquired about a severe hardship created for the owner who might want to convert a garage to a bedroom, or add pool or remodel, also a property owner's right to appeal the tax assessment. Mr. LuBien felt this a valid question, he would like to have the Village Attorney address. Mr. Rossi read from the Section of the Code to be reviewed. Mr. LuBien indicated this hearing is a motivational step to instruct the Village Attorney to prepare an Ordinance to restrict the use of ':'" zone for parking only. Property owners of record in B-1, B-2, "X" zone and all residential property abutting the X zone, would then receive notice 30 days prior to Public Hearing to discuss. the Ordinance. The Board could instruct the Village Attorney as to their wishes regarding verbage. It is expected these changes will be included with the changes to be made in the B-1 and B-2 zone. Other discussion continued. Mr. Laubenthal moved to request that the Village Attorney prepare an Ordinance, a new description for the "X" Zone that will effectively delete the reference to residential, fall out and bomb shelters as permitted use, to make it exclusively parking, and further to ask his advise as to how to make it clear that these are appropriately de- signated as non -conforming use lots. The motion was seconded by Mr. McClure. Discussion ensued concerning multi level parking. The motion passed by unanimous vote. • • PLANNING & ZONING BOARD MEETING PUBLIC HEARING -3- 8/14/86 5. DISCUSSION - LETTER FROM TROPICAL CHEVROLET REGARDING USES NEEDED BY AUTO DEALERSHIP It was noted that Mr. Feldner had been sent a copy of this agenda, however in the absence of Mr. Feldner and. Mr. Stobs, Mr. Duffy moved to table this discussion, seconded by Mr. Laubenthal and carried by unanimous vote. The meeting adjourned at 8:30 P.M. reta Approved Act
