PLANNING & ZONING BOARD MEETING
MAY 22, 1986
A regular meeting of the Miami Shores. Village Planning & Zoning
Board, was held on May 22, 1986, at the Miami Shores Village Hall. The
meeting was called to order by Chairman Stobs, at 7:45 P.M., with the
following Members present:
J. Robert Stobs, II, Chairman
Robert J. Rossi
Larry T. McClure
Thomas Laubenthal
Absent: Patrick Duffy
Also present: Frank J. LuBien, Director of Building & Zoning
1. MINUTES
The minutes of the meeting of May 8, 1986 were amended to clarify
Mr. Laubenthal's statements, and vote regarding Item #3.
Mr. Laubenthal agreed with the architectural intent, but emphasized
that all four requirements to allow for a variance were not met.
The minutes of the meeting were approved, .asamended, by a motion
made by Mr. Laubenthal, seconded by Mr. McClure, and passed
unanimously.
2. FRONT YARD FENCE HEIGHT ON BISCAYNE BLVD.
Mr. Stobs noted that he had been approached by Mr. Forney, and by
Mr. Fann, on numerous occasions regarding this subject, of front
yard set back, and fence restriction of 31/2' on Biscayne Blvd.
It was suggested the Planning & Zoning Board revisit this restriction
with the possible intent of an Ordinance change. Further, Mr. Stobs
noted that there are only a few residences facing on Biscayne Blvd.,
and the restriction is defensible (to differentiate between Biscayne
Boulevard as a Federal Highway, and other traffic arteries in Miami
Shores) as per opinion by the Village Attorney.
Much discussion ensued concerning this issue. It was agreed that
while the traffic flow is heavy and a buffer may be desirable, Members
are opposed to weakening the Ordinance, or setting a precedent, at the
expense of the rest of the Village. Neither is it desirable to make
a change for fear of future litigation.
A poll taken to determine if Members would be in favor of having this
question settled at Public Hearing, and the response was a unanimous,
Yes.
Mr. McClure requested to know the traffic readings for Biscayne Blvd.,
and Mr. LuBien was advised to obtain from the County all information
available concerning traffic on Biscayne Blvd, and also on N.E. 2nd Ave.
Further, Members felt it advisable to notify all residents on Biscayne
Boulevard.
The Public Hearing date would be scheduled after discussion of the
other items on the Agenda.

3. NON-RESIDENTIAL REAL ESTATE SIGNS
This item had been discussed previously, and a sign, 2' X 3' was
deemed adequate. However, it was decided this issue also, would
best be dispensed with at Public Hearing, date to be determined
at the end of discussion oil other items.
4. PERMITTED USES - B-1 AND B-2

Permitted Uses were discussed at a Workshop and subsequent
preliminary rough draft has been assembled. The question will
further be discussed at Public Hearing. Date to be scheduled at
the end of this meeting.
5. DOWNTOWN REVITALIZATION BOARD
Mr. Stobs related that he had conversation with Linda VanNatta,
Downtown Revitalization Board Project Manager, with regard to the
rough draft for proposed Landscaping Ordinance. He advised her
that she would be invited, along with Members of the Downtown
Revitalization Board, to the next meeting of the Planning & Zoning
Board on June 12, 1986.
It was determined that the Public Hearing date. scheduled to review
and discuss Items 2, 3, & 4 be held on Thursday, June 12, 1986.
Mr. LuBien would notify residents on Biscayne Boulevard, on. N.E. 2nd Ave.
and all of B-1 & B-2 zone. Mr. T.F. Chambers, Jr., Do -Right Realty,
suggested that he may be able to help with a computer print out of
names and addresses.
Members received from Mr. LuBien, for future discussion and possible
adoption, anamendment to Sec 501(k) of Ordinance #270,.,dealing with
storage or disposal of junk and waste material. This amendment is
drawn up at the specific request of Mr. LuBien.
There being no further business, the meeting adjourned at 8:45 P.M.
