08-23-1984 Regular MeetingMIAMI SHORES VILLAGE PLANNING & ZONING BOARD MEETING AUGUST 23, 1984 A regular meeting of the Miami. Shores Planning & Zoning Board was held on August 23, 1984, 7:30 p.m., at the Miami Shores Village Hall, with the following members present: J. Robert Stobs II, Chairman Patrick L. Duffy Thomas Laubenthal Robert J. Rossi J. Leslie Wiesen Also present: Frank J. LuBien, Director of Building & Zoning 1. MINUTES Mr. Rossi recommended an amendment to the minutes of August 9, 1984, page 2, paragraph 4, to read, 'Mr. Laubenthal moved to deny the application as Submitted, on the basis that it might be financially impractical'. Motion was seconded by Mr. Wiesen, arid carried unanimously 2. REQUEST FOR APPROVAL OF PLANS FOR TRELLIS AT FRONT ENTRY GEORGE OBENOUR 147 N. W. 109th ST. Mr. LuBien explained, he is seeking the Boards approval because of a small contradiction, as he sees. it. He stated that he has no objection to the trellis itself, as the plans were prepared by a registered architect. Members reviewed Plot Plan of the block, illustrating variations of setbacks of adjoining proper- ties. He explained the variations are a result of F.H.A. approved subdivisions and an attempt to avoid exact uniformity of appear- ance. Mr. LuBien noted that the average setback as shown is 34.98 ft., Mr. Obenour's_ required setback is 35 ft.. The Schedule of Regulations in referring to trellis says, it should be 25 ft., for this reason, Mr. LuBien feels the need. for Board approval. It was the consensus of the members that since there is no encroach- ment or violation, there shouldbe no objection. Mr. Wiesen moved to approve the plans as submitted, seconded by Mr. Duffy, and carried unanimously. Mr. Obenour did attend the meeting and thanked the Board for their approval. 3. REQUEST FOR APPROVAL OF PLANS FOR GARAGE ENCLOSURE JAMES GOLDSTEIN 420 N. E. 95th ST. As members reviewed the plans, Mr. LuBien stated this case requires the Board's approval, as is customary. for all garage enclosures. PLANNING & ZONING BOARD -2- 8/23/84 He called attention to the required off street parking which has been provided for. Approval forthegarage enclosure is sought as a non rental unit and for aesthetic appearance. Mr. Rossi, in observing the detail.of the plans commented that this is the type of detail work (showing elevation) members need to make intelligent., educated decisions. Mr. Goldstein further explained his plans to avoid completely the • semblance of a closed up garage, and his plans for landscaping. Following further discussion, Mr. Wiesen moved to approve the request, seconded by Mr. Laubenthal-:and.carried unanimously. 4. AMENDMENT TO SECTION 518 Mr. Stobs requested that Mr. LuBien.make.copies for the Board of the minutes:of the Planning & Zoning Board, Feb. 22, 1979 which he had received from Al Toussaint. Copies were distributed. Much discussion followed concerning the comments of this. meeting and the proposed amendment to the Zoning Ord. #270, Section 518, referring to.fence bench mark and the need to define same. Mr. LuBien stated that he is satisfied with the ordinance as it is, he has no problem measuring fence height from the point of installation, and feels an ordinance will cause considerable con- troversy. He further noted, creation of an artificial situation to circumbent the ordinance is never acceptable. Mr. LuBien explained that he is primarily concerned with a ruling from the Planning & Zoning Board -and Mr. Fann,concerning restric- tion of fence attachments. Members were given copies of the.South Florida Building Code and the Dade County Code, addressing fence zoning: codes. Mr. LuBien noted he:has.no objection to the attachments or reed screening,, so long as it is properly:maintaine.d in a sightly manner. Discussion. continued, concerning maintainance of attachments, and who determines the need for replacement. It was finally,. recommended that Mr. LuBien:will.further consult with Mr. Fann, Village Attorney, requesting inclusion of wording, "no attachments'.', or other suitable wordage.
