PLANNING & ZONING BOARD MEETING
AUGUST 9, 1984
A regular meeting of the Miami Shores Planning & Zoning Board
was held on August 9, 1984, 7:30 p.m., at the Miami Shores Village Hall,
with the following members present:
J. Robert Stobs II, Chairman
Patrick L. Duffy
Thomas Laubenthal
Robert J. Rossi
Absent: J. Leslie Wiesen
Also present: Frank J. LuBien, Director of Building & Zoning
1. MINUTES
Minutes of the meeting of July 26, 1984 were approved as written,
by a motion made by Mr. Rossi, seconded by Mr. Laubenthal, and
carried unanimously.
2. REQUEST FOR APPROVAL OF PLANS FOR ALTERATIONS
MIAMI SHORES BAPTIST CHURCH
370 GRAND CONCOURSE
As members reviewed copies of the plans, Mr. LuBien stated that
there are non-structural alterations to the interior. The primary
change is in the elevation to provide a more harmonious appearance
with the rest of the Church structure. Mr. LuBien further stated
that since this is not commercial or business zoned, there is no
need for Council to approve.
Mr. Nunn, the Architect, in reply to questions, stated that there
is an Air Conditioner on the roof, however it is screened and not
visible, also the tile roof will match what is existing.
Mr. Stobs noted that the entire Church facility has been tied to-
gether in anr:aesthetically pleasing manner.
A motion was made by Mr. Laubenthal, that the proposal as submitted
on the basis of being harmonious with both the area and with the
established style of the Church -be accepted and approved, seconded
by Mr. Rossi, and carried unanimously.
3. REQUEST FOR VARIANCE FOR FLAT ROOF ADDITION

Sketches of the existing residence and the proposed addition were
reviewed by members.
Mr. LuBien explained that the total existing pitched roof is 1723
sq. ft., the existing flat roof is 356 sq. ft., the proposed flat
roof addition is 114 sq. ft., for a total flat roof overage of
170 sq. ft.(the existing flat roof structure exceeds the limit by
56 sq. ft.). Mr. Lubien further noted, the proposed addition will

be abutting the flat roof area, the possibility of building with
a pitched roof and tying in to the flat or existing pitched roof,
though not economically feasible, is not insurmountable. There
exist no grounds for a variance.
Mr. Morgan was advised that had the existing flat roof addition,
installed by the previous owner, been pitched, there would be no
problem at this time.
Much discussion followed.
Mr. Laubenthal moved to deny the application as submitted, on the
basis, that whilc it might be4practi.cal, there is no aconomically inancially
-Leasiblc colution.. He further emphasized to. Mr. Morgan that the im-
addition by others has created this awkward problem for him.
Mr. Rossi seconded the motion, and it carried unanimously.
4. AMENDMENT TO SECTION 518
A letter from Mr. William Fenn, Jr., Village Attorney, with refer-
ence to fences and walls in other than the front yard, was distri-
buted by Mr. LuBien. In the letter Mr. Fann suggested an amendment
to Section 518 (b).
The subject of bench mark elevation was discussed at length.
Mr. LuBien stated that not having bench mark elevation spelled out
does not present a problem to him. So far as he is aware, there
has never been an ordinance passed addressing this matter. He
further noted that the height is based on location, without creation
of an artificial situationto justify circumventing an ordinance.
The wording of the amendment to Section 518 (b) was discussed.
In reply to Mr. Stobs query, Mr. LuBien stated that he is not aware
of any laws or standards. Metro might have with regard to walls or
fences.
Mr. Stobs was especially concerned with the woodfence being per-
mitted without specific identification.
Mr. Laubenthal suggested'the clause, 'or the use of similar materials
as attachments', be included.
Following much more discussion, Mr. LuBien stated that he will, at
the.next meeting have additional reference from the South Florida
Building Code and Metro adressing the matter.
The meeting adjourned at 8:30 p.m.
