02-09-1984 Regular Meeting• MIAMI SHORES VILLAGE PLANNING & ZONING BOARD MEETING FEBRUARY 9 , 1984 A regular meeting of the Miami Shores Planning & Zoning Board was held on February 9, 1984, 7:30 p.m., at the Miami Shores Village Hall, with the following members present: J. Robert Stobs, Jr., Chairman Robert J. Rossi Patrick Duffy J. Leslie Wiesen Thomas J. Laubenthal Absent: None Also present: Frank J. LuBien, Director of Bldg, & Zoning 1. MINUTES: The minutes of the January 26, 1984 meeting were approved as written, motion made by Mr. Wiesen, seconded by Mr. Laubenthal and carried unanimously. 2. REQUEST FOR APPROVAL OF PLANS FOR DORMITORY BARRY UNIVERSITY 11300 N. E. 2nd Avenue ?r, LuBien; Director of Building & Zoning presented plans to the Board for review. He stated this dormitory will be built on the S. E. corner of Barry University Campus on Ne E. 2 Ave., Mr, Tom Czerniec, Vice President of Business Affairs at the University and Mr, Pete Beggs, Architect answered questions regarding the floor plan and construction, and parking spaces, Mr. Beggs stated they hoped to be under construction in about one month. Mr. Czerniec noted the plans are preliminary, he hoped for some minor changes to be made by the architect. Their purpose for attending this meeting is to have the Board review the. site and structure and to be sure it is in harmony, Mr. Rossi moved for approval of the site plan as presented, 4110 seconded by Mr. Wiesen and carried unanimously, - 2 - February 9, 1984 3. REQUEST FOR APPROVAL OF INSTALLATION OF TOW -AWAY SIGNS BARRY UNIVERSITY 11300 N. E. 2 Avenue Mr. LuBien submitted copies of photographs of the pro- posed signs. He stated the reason for this to come before the Board for approval is covered in Sec. 504 (8) (2). Mr. LuBien further stated he could find nothing in the code specifically addressed to signs in a..S-1 district, According to State Statures, sign must be posted at each entrance of every parking area. Mr. Ulloa, of Barry University and Mr. Czerniec answered questions for the Board. In reply to Mr. Wiesen's question, "What has been happening up to this time, and who is parking that should not be"? Mr. Czerniec stated threats had been made, but no action taken. Mr. Ulloa noted the need for a policy with teeth in order to enforce the rules.. He felt the mere presence of the signs would be a deterrent for unlawful parking. Much discussion followed with regard to cars being towed away indiscrimantly. Location of signs and University policy and security. Mr. Stobs, Chairman stated there had been previous requests for such signs on N. E. 2 Avenue which were rejected. He noted this is not an area where continued abuse is a great problem. Furthermore, granting this request could cause a church:; stores and other small offices, unable to use their parking spaces to make similar requests. Mr. Laubenthal moved, that the signs be installed at the location as shown on plans if adjusted to in -board side so as not visible to passing traffic, and the signs are as occurs. The policy to install the signs be at the discretion of Barry University, and policy is not a subject for confirmation of codes and ordinances. The motion failed for lack of a second. Mr. Wiesen moved for disapproval of the Tow -Away Signs. seconded by Mr. Rossi and passed 4/1, with Mr. Laubenthal dissenting. 4. 'REQUEST FOR APPROVAL'OF PLANS FOR ADDITION -FOYER 'MARTINLEFKOWITZ 9405 N, E. 9'AVENUE Code Enforcement Director, Mr, LuBien presented members with a fact sheet and sketches of the planned addition, He ad- vised the members a variance is required for the addition as the existing residence and proposed addition are non -conforming construction, the proposed addition being of frame. - 3 - February 9, 1984 Mr. W. W. Baggesen, Jr., Architect for Mr. Lefkowitz answered questions for members, He stated that since the total con- struction of the house is wood, he did not feel the restric- tion to masonry on the foyer addition is justified. Mr. Lefkowitz stated to the Board he has lived in the house since 1953. He stated that upon stripping of old window frames the discovery of Dade County pine underneath. The house is a most interesting house to live in. He feels the cost of niasoney as opposed to frame is exorbitant. Mr. Stobs advised the manner in which this issue is resolved could create a problem of setting a precedent. Following further discussion, Mr. Wiesen moved for approval of plans as is. The motion failed for lack of a second, Mr. Laubenthal moved to approve the plans on condition that the structural wall be masonry and interior and exterior be finished to conform with existing architecture. The motion failed for lack of a second. Mr. Rossi moved that the plans be denied as drawn, and that the plans be redrawn to match the existing architecture, seconded by Mr. Duffy and passed 4/1, with Mr. Wiesen dissenting. Mr. Stobs advised Mr. Lefkowitz of his right to appeal to Council, at their next meetinge ftk®m Tuesday, Feb 21, 1984, 7:30 p.m.. Mr. LuBien advised the Board that Steven Rubinstein was extended an invitation to attend tonight's meeting, but was unable to attend because of a previously scheduled meeting with the Revitalization Board. Mr, Stals requested that 4 Rul!4ttptelit intg current regulations that exist within various other County State, and Federal agencies with respect to waterfront development, Mr. Stobs did not request Mr, Rubinstein write an ordinance, but detail pertinent information needed to develop a future ordinance.
