11-10-1983 Regular MeetingA regular Board was held Shores Village MIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING NOVEMBER 10, 1983 meeting of the Miami Shores Planning and Zoning on November 10, 1983, 7:30 p.m., at the Miami Hall, with the following Board members present: J. Robert Robert J. Thomas J. J. Leslie Patrick L Stobs, Chairman Rossi Laubenthal Wiesen . Duffy Absent: None Also Present: Frank LuBien, Building Director 1) MINUTES: Minutes of the meeting of October 27, 1983 were approved as written by motion by Mr. Rossi, seconded by Mr. Duffy and carried. 2) REQUEST FOR APPROVAL OF PLANS FOR ALTERATION R. TERRY CUSON, 1183 N.E. 91 STREET Mr. LuBien advised the Board that Mr. Cuson called the Village Manager and requested the item be removed from the Agenda. 3) REQUEST FOR APPROVAL OF PLANS FOR GARAGE ENCLOSURE FELIX ATILES-FIGUEROA, 262 N.E. 103 STREET By way of background, Mr. LuBien advised that this garage enclosure was completed without a permit, Notices were sent to stop the work and obtain a permit. This is the first step toward rectifying the situation. Mr. Atiles-Figueroa presented plans, prepared by an engineer and certified,as requested by Mr. LuBien. He also presented a recent survey. Following discussion by the Board re offstreet parking and the side setback being in conformance, Mr. Wiesen moved for approval of garage enclosure based on plans clearly depicting a 9/6" setback. Motion was seconded by Mr. Rossi, and carried unanimously. - 2 - 11/10/83 4) REQUEST FOR APPROVAL OF PLANS FOR ADDITION BENNET PUMO, 1133 N.E, 91 TERRACE Mr. LuBien noted that these plans were brought before the Board for two reasons; this structure does not conform to the required side setback on one side, and in section 225 (f) it states, all roofs having an incline of less than 21/2 inches per foot shall be constructed of built up gravel and shall be approved by the Planning and Zoning Board for harmony. Board examined the plans submitted and a lengthy discussion followed relative to structures annexed into Miami Shores with non -conforming setbacks, The Board felt that this is not a non -conforming use problem, it is a non -conforming setback problem as exists particularly on 91st Terrace. It was the Boards contention that this should be treated as a variance as the use is consistent - there is no change, however, a hardship exists as to the peculiar and unusual circumstances surrounding this structure in that it was built in the setback when Miami Shores allowed it. Mr. Laubenthal summed up the following.as grounds for acceptance: 1) the residence as it exists is maintaining its current use, therefore, section 524, non -conforming uses, does not apply; 2) infringement into setback was existing condition; 3) existing structure is in harmony with the neighborhood; 4) proposed addition does conform with front setback and maintains the established buildings side setback. Mr. Laubenthal moved that the request for garage additionbe approved as submitted, under grounds for hardship stated above, and variance be granted by the Board. Motion was seconded by Mr, Wiesen, and carried unanimously. This item goes to Council. Mr. Stobs read a memo received from the Village Manager relative to review and update of the Comprehensive Plan by July, 1984, The Village has an applicant for intern position for Urban Planning, January through May, 1984. The Board agreed that the Village Manager should proceed with his recommendation for an Urban Planner. • • - 3 - 11/10/83 At the request of the Village Manager, Mr. LuBien distrubuted a copy of letter from the Catholic Community Services, Archdiocese of Miami. They intend to move to the first floor of 9990 N.E. 2nd Avenue in the Spring of 1984. They advise the present professional staff consists of 14 social workers and family counselors as well as six clerical and management personnel. They provide family and individual services.
