04-14-1983 Regular Meeting• MIAMI SHORES VILLAGE PLANNING & ZONING BOARD MEETING APRIL 14, 1983 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7:30 p.m., April 14, 1983, at the Miami Shores Village Hall, with the following members present: J. Robert Stobs,.Chairman J.S. Palmer Kevin P. O'Connor Roberta Johnson Robert J. Rossi Also Present: L.R. Forney, Village Manager • Frank LuBien, Building Director 1. MINUTES: Minutes of the meeting of March 24, 1983 were approved as written by motion made by Mr. Palmer, seconded by Mrs. Johnson, and carried. 2. REQUEST FOR APPROVAL OF PLANS FOR ALTERATION &ADDITION JOSE GROSSO, 130 N,E. 98 STREET This item was on the agenda last. month and deferred because Mr. Grosso was not present. The Building Director reviewed the facts. Mr. Grosso proposes to enclose the carport and provide two additional off-street parking areas. Plot plan details that the proposed carport will become a kitchen and the present kitchen will become a den. Plans for alteration and addition meet with all requirements and require Board approval. Following discussion, Mr. O'Connor moved that we approve application as submitted for alteration and addition, seconded by Mr. Palmer and carried unanimously. • 3. REQUEST FOR APPROVAL OF PLANS FOR FLAT ROOF ADDITION JULIO LLAMOSAS,318`N.E. 103 STREET Copy of site planwas examined by Board indicating the position of the new addition, which Mr. LuBien notes complies in all respects with our requirements for flat roof additions. Flat roof additions to pitched roof structures require Board approval. The existing structure has 1,724 sq.ft., which allows Mr. Llamosas 300 sq,ft, The proposed addition is 293 sq.ft. This is an open porch, in the middle of the block, not visible from the street. The question is whether or not to accept this - 2 - April 14, 1983 as the only logical means of putting a roof on the addition. Following discussion, Mrs. Johnson moved for approval of the flat roof addition since it is under the allowable provision in our code, seconded by Mr. O'Connor and carried unanimously. 4. REQUEST FOR VARIANCE FOR TWO SIGNS ARCHDIOCESE OF MIAMI, 9401 BISCAYNE BOULEVARD This request is for variance for two incidental signs in a residential zone; both signs exceed the area limitation, both face Biscayne Boulevard and both are less than 10 feet from the property line. Site plan submitted by Mr. Ben Lopez, Architect, indicates signs are 411 feet apart and read - Pastoral Center and St. Marthas Church. Mr. Lopez advised that.the signs would be suitable to the structure, will not be illuminated, as landscaping and floodlights would be provided. The Chairman read section 504 (b) (3), incidental signs displayed in any R district. The Chairman expressed the opinion that the ordinance was written for signs in R zone only, and now that this property has been built upon, the Board was no longer looking at an R zone property and variance should be granted as is. Discussion was held relative to existance of hardship due to the unusual situation that a large significant area is covered by minuscule signs, more than 400 feet apart. Following further discussion, Mrs. Johnson moved. for approval of variance to allow two signs, facing Biscayne Boulevard, due to unusual and peculiar circumstances. Motion was seconded by Mr. Rossi, and carried unanimously. 5. REQUEST FOR VARIANCE TO PERMIT ROOF ADDITION GRACIELA R. GONZALEZ, 100 N.E. 104 STREET This request was before the Board in February and no action was taken as the Board requested the Architect to supply elevation information. Mr. LuBien noted that in addition to the problem with the setback, with the plans as submitted by Mr, James Nunn, Architect, in order to maintain the lines of the building, there is a flat section at the top of the roof, Visually it will not appear as a flat roof. - 3 - April 14, 1983 The problem before the Board is that there is an existing single family residence and an existing detached garage, The detached garage is 5 feet from the rear property line; when it becomes attached to the building, then that portion is a violation to the rear setback requirements. The garage is presently con- forming; when attached, it will no longer be an accessory building but becomes a part of the house, Following discussion by the Board re peculiar orientation, options 'for attaching the garage and the question of setting a precedent in this case, Mrs. Johnson moved that request for variance to permit room addition be denied, seconded by Mr. O'Connor and carried unanimously. Mr. Nunn, as representative to Mrs. Gonzalez, was advised of right to appeal decision to Council. 6. REQUEST FOR VARIANCE TO PERMIT FIBERGLASS SHINGLE ROOF ALLEN KELLEY, 882 N.E. 97 STREET Building Director advised that the original roof on residence at 882 N.E. 97 Street is flint -coated asbestos shingle, Dutch lap and the structure will not support a tile roof. This requires a variance to permit fiberglass shingle roof. Mrs. Mary Singer, Realtor, Century 21, agent for the property owner, who resides in Michigan, was requested by the Planning Board to supply certification by a licensed architectural or structural engineer that the structure is not capable of supporting cement tile roof. Mr. Rossi moved that we approve the variance for a fiberglass shingle roof contingent upon receipt of verification from a licensed registered architect or structural engineer that the house.will not support a tile roof. Motion was seconded by Mr. O'Connor and carried unanimously. This is to go to Council. Mr. Stobs conveyed congratulations, on behalf of the Planning & Zoning Board,•to Kevin P. O'Connor, soon'to be Mayor of Miami Shores Village, Mr: O'Connor expressed his pleasure in serving on the Board and stated it was a great experience.• He further praised the work of our Chairman, Mr. J. Robert Stobs. He emphasized the importance of Mr. Stobs contribution to the community. Meeting adjourned at 8:40 p.m. Secretary
