PLANNING AND ZONING BOARD MEETING
OCTOBER 28, 1982
A regular meeting of the Miami Shores Planning and Zoning
Board was held at 7:30 P.M., October 28, 1982, at the Miami Shores
Village Hall, with the following members present:
J. Robert Stobs, Chairman
J. S. Palmer
Kevin P. O'Connor

Robert J. Rossi
Also Present; Leslie R. Forney, Village Manager
Frank LuBien, Building Director
MINUTES:
Minutes of the meeting of October 14, 1982 were approved as
written by motion made by Mrs. Johnson, seconded by Mr. O'Connor
and carried.
2. REQUEST FOR APPROVAL OF FLAT ROOF ADDITION
ENRIQUE LANGTON, 835 N,E. 92 STREET
This is a proposed addition to an existing pitched roof house
that has a flat roof portion. The addition also has a pitched roof
portion; it is at the rear of the house and complies in all respects
to our criteria for' flat roof additions and is within allowable limitations.
The portion of the pitched roof addition will be tiled to match the existing
material.
Following discussion and examination of plans submitted, the Board
determined that cement and tile roof was not practical.
Mr. O'Connor moved for approval of application for flat roof addition,
seconded by Mrs. Johnson, and passed unanimously.
3. REQUEST FOR VARIANCE TO PERMIT PLACEMENT
OF TEMPORARY HOUSING UNITS
BARRY UNIVERSITY, 11300 N,E. 2ND AVENUE
This request is for variance to allow Barry to place 13 modular
aluminum units, for housing approximately 100 students, either in the
Southwest corner of N.E. lllth St. and 2nd Avenue, or as an alternative,
in the Northwest corner along North Miami Avenue and Northeast 115th St.__
Sr. Jeanne O'Laughlin, President of Barry University,.Mr. Timothy
Czerniec and Mr. James Killmeyer were in attendance on behalf of the
Uniyersity,

Sister Jeanne explained to the Board that as a vibrant,
growing institution,the._Uniyersity requires additional residence
space on campus to provide students with secure and supervised
living quarters. All existing living quarters are filled to
capacity. Utilizing a tentative cite plan, Sister Jeanne reviewed
the placement of the proposed units, which are to be used for
approximately two years. She further provided general information
of projected development plans of Barry for construction of permanent
structures to replace the requested modular housing units.
Mr. Timothy Czerniec provided information as to size and
description of the units and assured the Board that Barry would
provide appropriate landscaping so as to create a suitable aesthetic
environment. Mr. Czerniec advised that the units of anodized
aluminum, with steel roof, meet the tie -down standards of the
South Florida Building Code.
Mr. Stobs discussed which section of our Zoning Ordinance
was applicable to this case. He read Article V, Section 501,
prohibited uses, paragraph (m) which stipulates:
Use of any of the following as a dwelling
of any type:Accessory building, building
not designed for residential purposes,
houseboat, temporary building, tent,
trailer or similar building or object.
Following lengthy discussion, the second consideration was
that these buildings would require a variance to our Masonry Ordinance,
Section 225. It was further determined the buildings were permanent
structures to be used for temporary housing,
The Board also noted that a site plan outlining dimensions,
parking, landscaping, etc, be submitted to the Board for review,
per Section 604 of Miami Shores Village Code.
Mr. Rossi made a motion that we address this issue as permanent
structures for temporary housing, and review under 604 grid Masonry
Ordinance, seconded by Mr, O'Connor, and carried 4/1, with Mr. Stobs
dissenting,
• Approximately 60 residents appeared at the Meeting, The Chairman
opened the meeting for public comments.
Dr. Doggett, 10728..N.W, 2nd Avenue, was concerned relative to
evacuation in the event of a hurricane.
Mr. Les Forney, Village Manager, stated that a modular building
when properly installed and maintained is not a temporary. structure,

Mx'. Terry Cuson, 1183 N,E, 91 Terrace, felt the University
dict not come properly prepared for submittal of request for
variance,
Mrs, Gertrude Doggett, 10728 N.W. 2nd Avenue, was concerned
with: the time limitation of the temporary structures.
Mrs. Mary E. Paulfus, 11040 N.W. 2nd Avenue, strongly felt
these temporary structures would become permanent and we should
have a fixed date for removal of the units.
Mr, Nick Dallis, 186 N.W. 108th St. thought the request for
variance should have been presented with more information and
photographs.
Mr, Kenneth Cutchens, 1235 N.E. 100th Street, stated that
a surety bond should be supplied guaranteeing performance of
obligation for removal.of temporary housing on specific date,
Mr. Vic Smith, 188 N.W. 110 St. was concerned with the
tine limitation of the structures.
Following public discussion, the Chairman requested the
applicant issue a site plan to be presented to the Board at
the next meeting. Motion was made by Mr: Rossi to._table this case
until further information was obtained from Barry University,
and carried unanimously,
The meeting adjourned at 9:00 P.M.
