10-14-1982 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING OCTOBER 14, 1982 A. regular meeting of the Miami Shores Planning and Zoning Board was held at 7:30 P.M., October 14, 1982, at the Miami Shores Village Hall, with the following members present: J. Robert Stobs, Chairman Kevin P. O'Connor Roberta Johnson J.S. Palmer Robert J. Rossi Also Present: Frank LuBien, Building Director MINUTES: Minutes of the meeting of September 23, 1982 were approved as written by motion made by Mr. Palmer, seconded by Mr. O'Connor and carried. At the request of the Building Director, Item 3 on the Agenda was moved up to Item 2. REQUEST FOR APPROVAL OF FLAT ROOF ADDITION DR. DANIEL FINKELSTEIN, 444`N.E. 101 STREET This case is before the Board for approval of flat roof addition to existing flat roof area, which is 514 sq. ft. The proposed flat roof addition is 72 sq. ftR,totalling 586 sq.ft., which is 60 sq. feet within the allowable footage (pitched roof area 4321 sq.ft - 15% = 648 sq.ft.). This flat roof section is in the rear and not visible from the street. Sketch of section of the roof for proposed addition and a full floor plan was submitted to the Board. Mr. LuBien advised that this complies with our guidelines, however, it requires approval of the Planning and Zoning Board. Mrs. Johnson moved for approval of this request for flat roof addition, seconded by Mr. Palmer and carried unanimously. - 2 - October 14, 1982 2. REQUEST FOR VARIANCE TO MASONRY CONSTRUCTION BOB DAVIS, LOTS 10, 11 & 12, EL PORTAL SECTION The basic construction of exterior walls of proposed house has prefabricated panel system, which.uses wood frame for structural elements. This does not comply with our Zoning Ordinance which requires masonry construction in Miami Shores Village. A variance to Section 225 Appendix A -Zoning is requested. At this point, Mr. O'Connor noted that at the joint meeting with the Council this very question was discussed at length,as well as the overall Ordinance, and the Council and Planning & Zoning Board actually expanded on the Masonry Ordinance to cover areas that prior to the joint meeting were gray. A discussion followed with Mr. Davis and his architect, Mr. Richard Skrip, who presented engineering data and other materials to the Board for consideration, and expounded on the advantages of the structure. The Board advised that we cannot entertain a request for a variance as Mr. Davis is not the legal owner of the property in question but would enter into an informal discussion, without any decision by the Board. Mr. Davis accepted the Board's decision that the current owner, not the prospective purchaser, has to come before the Board to request a variance. 4. REVIEW - SECTION 225 APPENDIX A - ZONING PREPARATION OF AMENDMENT AS PER SUGGESTIONS AT JOINT MEETING OF SEPTEMBER 9, 1982 The Board reviewed, discussed at length and concurred with Section 225 APPENDIX A -ZONING as interpreted by the Council and the Planning & Zoning Board. Mr. Palmer moved the the Zoning Ordinance be modified as presented to the Board by the Building Director, and a Public Hearing be advertised for November 11, 1982. The motion was seconded by Mr. O'Connor and carried unanimously. 5. REVIEW - STRUCTURES IN•REAR YARD OF WATERFRONT PROPERTIES (SEE COUNCIL MINUTES 9/21/82) A discussion was held on waterfront properties and various structures thereon. The Chairman advised he viewed these structures; some in good taste and others rundown and in poor taste. Mr. O'Connor stated that he was not offended by chickee huts. 1 October 14, 1982 After conclusion of discussion by the Board, Mrs. Johnson moved ths;t we resffirm4.denial of approval of.the chickee hut; that there is no difference between waterfront and other properties in Miami Shores Village. The motion was seconded by Mr. Palmer and carried with the following vote: Mr. Stobs Aye Mr. O'Connor Nay Mrs. Johnson Aye Mr. Palmer Aye Mr. Rossi Aye The Chairman read correspondence received from Mr.Forney on August 24, 1982 and Mr. Stobs reply of October 12, 1982 relative to commercial vehicles.
