PLANNING AND ZONING BOARD MEETING
AUGUST 12, 1982
A regular meeting of the Miami Shores Planning and Zoning
Board was held at 7:30 P.M., August 12, 1982, at the Miami
Shores Village Hall, with the following members present:

J. S. Palmer
Kenneth Cutchens
Roberta Johnson

Also Present Frank LuBien, Building Director
and Code Enforcement Officer
1) MINUTES: Correction made by Chairman Stobs to Minutes,
Page 5, paragraph 4, motion should read - passed 4/0
Minutes were than approved as corrected by motion made by Mr.
Palmer, seconded by Mrs. Johnson, and carried.
2) REQUEST FOR APPROVAL OF PLANS FOR ADDITION
DR. MAURICE LEBOWITZ, 1285 N.E. 102 STREET
The plans submitted to the board by Mr. Bob Moore, Architect,
propose an extensive addition. Dr. Lebowitz wishes to add a 2 -story
section, with the second story continuing over on existing single
story garage. In order to limit the load placed on the existing
structure, it is proposed that the main structural supports be wood
frame with brick facing. Mr. LuBien noted that the Ordinance stipulates
masonry on all structural elements. The existing one-story structure
is CBS,brick veneer.
Mr. Bob Moore advised the Board that the structure has 20" footing
and they would like to go with 2 x 4 wood frames, with brick veneer,
which would appear identical to the existing structure and be in total
harmony.
Mr. Stobs advised that the Board required grounds appropriate
for granting a variance. Mr. Moore cited the difficulty of building
-the-addition on--any-other area of the -lot_ due to the necessity of
removing several trees and they do not wish to disturb the existing
soil if this is not necessary, and also did not want to cover any
more of the site with building.

The Board noted that no specific peculiar and unusual conditions
were affecting this property to grant hardship variance under Section
702, the alleged reason that conditions noted by the Architect do
not make it possible to apply specified provisions to this property.
It was determined that expansion would have to be CBS, whether up or
out and that wood frame sets a. precedent problem.
Mr. Stobs recommended that Dr. Lebowitz explore the feasibility
of using concrete block in lieu of wood frame.
Mrs. Johnson moved that this application for addition be
denied. The motion died for lack of second.
Further discussion was held by the Board, Mr. Lebowitz and
the Architect, following which Mr. Stobs indicated the issue before
the Board is to interpret the Ordinance as same applies to all residents
of Miami Shores.
Mrs. Johnson repeated the motion to deny variance for proposed
addition, seconded by Mr. Palmer, and passed unanimously.
Chairman advised Dr. Lebowitz he could appeal the decision of
the Planning & Zoning Board to the Council.
At 8:05 Chairman Stobs requested that Mrs. Johnson chair the
meeting.
3) REQUEST FOR APPROVAL OF PLANS FOR ADDITION
AND ALTERATION
BARNETT BANK, 9190 BISCAYNE BOULEVARD
This is before the Board, and thereafter to be presented to
Council for approval per Schedule of Regulations.
Mr. William Shives, Vice President, Barnett Banks and Mr.
Edward M. Ghezzi, Architect presented plans for approval of
alteration and addition.
Barnett Bank proposed to add an exterior structure which will
be attached to the main building by a walk-thru and also a tellers
cage will be added to the exterior of the structure. Site plan was
examined and discussed by the Board. It was noted that the section
from the tellers cage to additional structure will be roofed over.
Mr. Palmer made a motion for approval of design for alteration
and addition, seconded by Mr. Cutchens, and carried 4/0, as Mr.
Stobs was not present.
Mr. Stobs returned to the Chair at 8:15 P.M.

COMMENTS:
A discussion was held by the Board on the Howard Barwick
decision for approval of plans for addition and alteration.
The Planning & Zoning Board reviewed this case and summarized
its decision for denial of this variance.
Mr. Stobs read to the Board letter addressed to Mr. Albert R.
Toussaint, Planning Board Chairman, dated June 1, 1979 from Attorney
William F. Fann, Jr. relative to Paragraph 4(e) (2) of Ordinance
No. 403-78, Amending Section 225, Article II of Miami Shores Village
Ordinance No. 270, (copy attached for reference).
Following conclusion of discussion, Mr. Stobs stated it was
his opinion that it is obvious the Council is in need of a Workshop
with the Planning & Zoning Board with regard to their interpretation
of the roofing Ordinance.
Mr. LuBien noted that Ordinance No. 403-78 only applies to a flat
roof addition to be added to a pitched roof. There is nothing in the
Ordinance that prohibits a flat roof; that prohibits a gravel roof if
it has a 2" pitch on it; the only specific situation the Ordinance
makes reference to is if you have basically a tile roof house and
wish to add a flat roof section to same.
It was determined by the Board that a Workshop scheduled for
September 23, 1982 would be acceptable, however, request was made
for possible reprogramming to the 16th of September, due to the
absence of Planning & Zoning Board members on the 23rd.
The meeting was adjourned at 8:30 P.M.
