05-13-1982 Regular Meeting• • HEARING PLANNING AND ZONING BOARD MEETING THURSDAY, MAY 13, 1982 7:30 P.M. MIAMI SHORES VILLAGE HALL A meeting of the Miami Shores Planning and Zoning Board was held on May 13, 1982, at 7:30 P.M. at the Village Hall, with the following members present: Also present: 1) MINUTES: J. Robert Stobs, Chairman J.S. Palmer Kenneth Cutchens Kevin P. O'Connor Roberta. Johnson Frank LuBien, Building Director & Code Enforcement Officer Leslie R. Forney, Jr., Village Manager William 0. Yates, Attorney The minutes of the meeting of April 27, 1982 were approved as written by motion made by Mr. Palmer, seconded by Mr. Cutchens and carried unanimously. 2) PUBLIC HEARING: HISTORIC PRESERVATION ORDINANCE The Chairman opened the Public Meeting and invited comments from the floor. Mr. Seth Brinson of 330 N.E. 96th Street, a one year resident of Miami Shores, presented memorabilia of both Dade County and Miami Shores for examination. Mr. Branson feels that historical preser- vation is worthless without preservation of memorabilia. He also stated that the Historic Preservation Ordinance should not require owners consent; should offer tax incentives to residential homes as well as commercial establishments; he is not in agreement with the provision for 5 year residency for members of the Preservation Board. Mr. Tom Beck of 357 N.E. 92nd Street, a Shores resident whose home was built in 1925, expressed the opinion that incentives backfire - 2 - 5/13/82 seriously and suggested to the Board a contract should be made with the owner of declared historic site, and if the contract is violated, all incentives should be reimbursed. Mrs. Marty Stofik of 35•N.E. 91 Street read from a prepared statement noting that in her opinion the ordinance under consider- ation was very good. She suggested the following changes: require the Historic Review Board to hold regular meetings, monthly or bi-monthly; add to Section 5 provisions for a moratorium on alterations and/or,demolitions during the period between recommenda- tion for designation by the Board and the final decision by the Village Council; the reference to owner consent, in Section 5, paragraph 4, should be deleted. Mrs. Stofik noted that Coral Gables, Miami, El Portal or North Miami does not allow for owner consent in its Ordinance. Mrs. Stofik advised the Board, that although she is not a 5 year resident of Miami Shores, she is a concerned citizen, a member of Dade Heritage Trust and the Miami Preservation League. Mr.O'Connor, after discussion with the Code Enforcement Officer, informed Mrs. Stofik that.our Ordinances cover architectural altera- tions and demolitions. Mr. Tim Blake, Coral Gables. Attorney, President of Dade Heritage Trust, local affiliate for National Historical Preservation Board, as Chartered by the U.S. Congress addressed the Board. He discussed the owners consent issue, suggested ad valorum tax relief for historic property that has been restored, and stated that donation of easements and facade could be made to charity. He also noted that both commercial and income property benefit by tax credit, below line for improvements if on the National Register, provided they are designated by the local Historical Board and go through the process. Mr. Blake also felt the 5 year provision requirement was lengthy. Mr. Carl W. Orleman of 9600 N. Miami Avenue was also present and acknowledged he was present as an interested citizen to learn the facts. The Chairman read from a letter he received from Mrs. Arva M. Parks, 1006 So. Greenway Drive, Coral Gables, who is active on both the Dade County and Miami ordinances. Mrs. Parks grew up in a 1920's home in the Shores and her latest book "Miami the Magic City" gives equal billing to Miami Shores and Coral Gables. Mrs. Parks offered her assistance concerning our historic preservation ordinance if required. Following comments by the audience the Planning Board went over the Historic Preservation Ordinance as proposed, step by step. • - 3 - 5/13/82 The following changes, deletions or additions were suggested by the Board: SECTION 2. Definitions: (14) line 3 add: "or current record title holder." SECTION 4. Historic Preservation Board: A - The Establishment of the Historic PreservationBoard, Line 6, strike out - "All members shall serve Stagger terms. B - Organization and Members: Line 13 - recommend to read: "in field of business, finance or law and a licensed general contractor. • Following last line B - Addition - Residence requirements shall not apply to Special Advisors to the Board. F - Meetings: Line 1 - The Board shall meet quarterly SECTION 7. Application for Cert, of Appropriateness for Alteration or Demolition of Historic Landmarks: B - Demolition of Sites on Landmark Inventory: 2. Line 2 - "there will be a 180 day delay SECTION 10.
