03-11-1982 Regular Meeting• MIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING MARCH 11, 1982 A regular meeting of the Miami Shores Planning and Zoning Board was held at 7:30 P.M., March 11, 1982, at the Village Hall, with the following members present: J. Robert Stobs, Chairman J.S. Palmer Kevin P. O'Connor Roberta Johnson Kenneth Cutchens Mr. Les R. Forney, Jr., Village Manager and Mr. Frank LuBien, Building Director were also present. 1) MINUTES: Minutes of the meeting of February 25, 1982 were approved as written by motion made by Mr. Palmer, seconded by Mr. Cutchens and carried unanimously. 2) ROOM RENTALS: Mr. Cutchens reported to the Board that he examined all existing codes and could not find specific reference relative to room rental. Mr. Palmer referred the Board to Ordinance 377, Section 216 of Ordinance 270, amended March 19, 1974, defining Family as one or more persons living as a single housekeeping unit and consisting of either any number of persons related by blood or marriage, or not more than two persons not related by blood or marriage. In all other respects the Ordinance is not affected by this amendment. After discussion of the existing Ordinances and amendments and reviewing with the Code Enforcement Director the problems existing on room rentals, the Board recommended that this be turned over to the Village Attorney for the drafting of an Ordinance prohibiting the rental of rooms, with an amortization clause included. The Chairman further discussed with the Board and the Village Manager several amendments to ordinances passed by the Board,that have not been taken up by Council. These amendments included pro- hibition of parking for certain purposes and the restrictions on types- of animals. The__Raard requested_cevi ew by the Council. • - 2 - 3/11/82 3) COMMERCIAL VEHICLES - ZONING ORDINANCE The Chairman enumerated the details of Ordinance No. 270 for Off -Street Parking Space for Dwellings, specifying that a car cannot be parked except within a closed garage, attached to the dwelling, and commercial vehicles, 3/4 ton or under, have to be in enclosed structure, in front or rear. It was the judgment of the Chairman that the entire paragraph noted above was outdated and unforceable, and should be reviewed, modified and updated, as numerous garages in the Village are enclosed for extra living space, and all do not provide for off-street parking space. There was a discussion by the Board and the Building and Zoning Director relative to garage enclosures and paved areas for parking, to meet the provision for off-street parking. Mr. LuBien advised the Board that at the time of issuance of Permits the Building and Zoning Department has control of off-street parking regulations. Mr. Kevin O'Connor reported to the Board that he examined the Statutes, spoke to the Department of Highway Safety, the Department of Transportation and the Highway Patrol, none of which had any guidelines. He referred to the Florida Motor Vehicles Statutes, No. 320.01, which he stated were vague relative to weight and height of vehicles and do not define themselves to what we are looking for. Mr. Palmer introduced a letter from Mrs. Yvonne T. Moyer dof 10 N.E. 110th Street. A Notice of Violation was sent to Mrs. Moyer on February 22, 1982 for parking a commercial vehicle, (green Ranger Ford Pick-up Truck),in a residential zone. Mrs. 'Moyer's letter cited that the truck could not fit,in their garage, is unlettered and is not used for commercial purposes. The Chairman outlined the procedure of the Board - to draft a proposed ordinance, advertise for a public hearing, hear the public and vote on the proposed ordinance and then take it to Council. The issue is whether we want pick-up trucks, blazers, lettered vans, etc. in residential areas of the Village. Mr. Stobs called for a reading of the Board on this situation. Mr. O'Connor is against exclusion of trucks in the Village, but not lettered vehicles, moving vans or busses; Mrs. Johnson is against all trucks parked in Miami Shores residential areas; Mr. Palmer has no objection to trucks parked in the Village; Mr.Cutchens stated he is not against pick-up trucks and vans with no advertising, but objects to commercial vehicles; Mr. Stobs would allow unmarked trucks 3/4 ton capacity or less, but exclude commercial vehicles, regardless of size. • • • • • - 3 - 3/11/82 Mr. Cutchens moved that the Board recommend the Village Attorney draft an ordinance to prohibit parking of all commercial vehicles, and all trucks in excess of 3/4 ton capacity, in a residential district of Miami Shores. The motion was seconded by Mr. O'Connor and passed unan- imously. The Chairman noted that he and other members of the Board would be willing to meet with the Village Attorney for input to get this to the Public Hearing stage. The meeting adjourned at 9:00 P.M.
