02-25-1982 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING FEBRUARY 25, 1982 A regular meeting of the Miami Shores Planning and Zoning Board was held at 7:30 P.M., February 25, 1982, at the Village Hall, with the following members present: J. Robert Stobs, Chairman J.S. Palmer Kevin P. O'Connor Roberta Johnson Kenneth Cutchens Mr. Frank LuBien, Building Director, was also present. 1) MINUTES: Minutes of the meeting of February 11, 1982 were approved as written by motion made by Mrs. Johnson, seconded by Mr. Cutchens and carried unanimously. 2) CODIFICATION - ZONING ORDINANCE Building and Zoning Director, Mr. Frank LuBien, re- quested that the Board review previous recommendations regarding clear cut definition of commercial vehicles. Mr. LuBien presented to the Board a list of problems encountered by the Code Enforcement Department which need clarification by Ordinance, namely: a) Definition of commercial vehicles b) Repairing of vehicles c) Construction specifications for parking spaces (The New Parking Ordinance, Zoning Ordinance No.270 and in the Code, no reference is made to the construction specifications of parking space for residential areas). d) Renting Rooms - (Minimum Housing Ord.No. 430-81 has no specific statement about room rental. _Mr. LuBien stated 2 - February 25, 1982 that a clear cut Ordinance relative to room rental, with an amortization clause, is needed. The Code Enforcement Director informed the Board that the Elsie Baioff case, due to be heard in Circuit Court on the 1st of June, Attorney J.G. Fletcher has referred to the grandfather clause. Chairman Stobs requested that Mr. Palmer and Mr. Cutchens prepare a definition for Renting of Rooms for review and input by the Board. With reference to commercial vehicles, Mr. O'Connor, at the behest of the Board and the Code Enforcement Director, contacted other municipalities that have Ordinances re No Commercial Vehicles in the Front Yard, and advised the Board that he could find no case law defining this. He will study this further for discussion at a future meeting. Mr. Brian Gardner of 25 N.E. 110 Street, Miami Shores requested and was given permission to come before the Board. Mr. Gardner is the owner of a Green Ford Pick-up Truck, and was issued a Notice of Violation from the Building and Zoning Department on February 22, 1982 for parking this vehicle in a residential zone. Mr. Gardner explained to the Board that the Ford Pick-up Truck was Mrs. Gardner's personal vehicle. Mr. O'Connor, due to prior commitment, withdrew from the meeting at 8:30 P.M. After conclusion of discussion, the Chairman asked that consideration be given that the commercial vehicle question be addressed under the Parking Ordinance by Zones and a proposed ordinance be drafted for a Public Hearing. The meeting adjourned at 8:40 P.M.
