01-28-1982 Regular MeetingMIAMI SHORES VILLAGE PLANNING & ZONING BOARD MEETING Thursday, January 28, 1982 A regular meeting of the Miami Shores Planning and Zoning Board was held at 7:30 P.M., January 28, 1982, at the Miami Shores Village Hall, with the following members present: J. Robert Stobs, Chairman Ms. Roberta Johnson Kevin P. O'Connor J.S. Palmer Kenneth Cutchens Mr. Frank LuBien, Building Director, was also present. (1) MINUTES: The minutes of January 14, 1981 were approved as written by a motion made by Mr. Palmer, seconded by Mr. Cutchens, and carried unanimously. (2) REQUEST FOR APPROVAL OF ADDITIONAL USE SIKANDAR KARIM, 9099 BISCAYNE BOULEVARD (RE -SUBMITTAL) DINNER THEATRE Mr. Karim resubmitted a site plan drawing to the Planning and Zoning Board. After a review of this case it was determined by the Board that a site plan, certified by a registered surveyor or engineer, with a seal, be presented to the Building and Zoning Department, with noted fire department approval. Ms. Johnson moved that the request for approval of additional use be approved providing Mr. Karim produce an exact copy of the particular site plan, as submitted to the Board, with seal, by next Monday afternoon in time for the Council meeting on Tuesday. The motion was seconded by Mr. Cutchens. Mr. O'Connor wished it to be noted on the records that he did not approve of doing things this way; that the Board should fulfill its responsibilities to the Council, be consistent and go by the book in interpreting the Ordinances. It was again reiterated by the Board that 2 January 28, 1982 there is no problem in this case other than the site plan which was submitted to the Board without a seal and therefore rejected for lack of same. • The following vote was taken on Ms. Johnson's motion: J. Robert Stobs No Ms. Roberta Johnson Yes Kevin P. O'Connor No J.S. Palmer No Kenneth Cutchens Yes The motion failed, (3) REQUEST TO REPAIR NON -CONFORMING FENCE BLAIR & LISA HYATT, 134 N.E. 102 ST. Mr. LuBien reported that non -conforming fence, constructed by a previous owner in 1973, is deteriorated and was damaged by recent demolition work. Mr. Hyatt wishes to repair the six foot non -conforming fence. After discussion by the Board, it was decided that this case is not covered under non -conforming use, but rather Section 518 - paragraph (a). Motion was made by Mr. Kevin O'Connor to reject this request for six foot fence replacement, seconded by Mr. Palmer, and passed unanimously. (4) CODIFICATION - ZONING ORDINANCE Mr. LuBien, Code Enforcement Director, advised the Board that our Zoning Ordinances have been placed in the hands of the Coding company to prepare the Code. Mr. LuBien suggested that the Board give consideration to preparing Ordinances and Amendments in regard to commercial vehicles, recreational vehicles and parking thereof in the Village. He further recommended that the pending Ordinances in regard to passenger vehicles be modified and drafted into Ordinance form. Motion was made by Mr. Stobs that a committee be formed, headed by Mr. O'Connor. The motion was seconded by Mr. Palmer, and carried unanimously. • • - 3 - January 28, 1982 The Board, with suggestions and input from the Code Enforcement Director, would draft Ordinances and Amendments that would be clear and more effectively enforceable.
