11-19-1981 Public Hearing• • PUBLIC HEARING MIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING November 19, 1981 A public hearing on a zoning request made by Barry College was held by the Miami Shores Planning & Zoning Board at 7:30 p.m., November 19, 1981, at the Miami Shores Community Center, with the following members of the Board present: Mr. J. Robert Stobs, Chairman Mrs. Roberta Johnson Mr. J. Sa Palmer Mr. Kevin 0" Connor Mr. Kenneth Cutchins Absent: None Mr. Frank LuBien, Building Director, was also present, as well as, approximately 60 others in the audience. The meeting was opened by Chairman Stobs who reviewed the request made by Barry College for "permission to sell beer and wine" on the College premises. He pointed out the sections of the zoning ordinance that prohibits this use and then turned the meeting over to the petitioners to present their request. Mr. Tim Czerniec, Vice President for Business Affairs at Barry College, introduced Charles Cassini, Assistant Professor of Philosophy, who spoke on the need for a rathskeller as a campus recreation facility. Frank Gamberdella, a senior at Barry, presented a sketch showing the location of Thompson Hall, where the rathskeller would be located, in a room with a total capacity of 100 people, with the purpose of the rathskeller for socializing. Also speaking on behalf of the College were: Paul Orenic, senior, and Randy Sidlosca, senior. Following this presentation Chairman Stobs read letters and peti'ti'ons received that were submitted to the Chairman by residents and nonTrestdents., Letters in support of a beer and wine perni;t were received frons Stster Jeanne O'Laughlin, President of Barry College, and Congressman Bill Lehman. Letters against this request were received from the following residents, referring to noise, reckless drivers, late hour disturbances, litter, empty bottles on lawna, etc.: Oswaldo Mena, 124 N.E. 111th Street. Willits, 74 N. E. 111th St. Phil & Janice Greco, 51 N. E. 110th St. Michael Garris, 150 N. E. 111th St. T. Brugger, 160 N. E. 111th St. Oswaldo Mena, 124 N. E. 111th St. Alicia Kelley, 138 N. E. 111th St. Beverly M. Roll, 60 N. E. 111th St. Charles Leonard, 48 N. E. 111th St. George VonSzymerowski, 4 N. E. 111th St. Andres Amoedo, 112 N. E. 111th St. Kenneth R. Bond, 125 N. E. 110th St. George F. Kerr, 131 N. E. 110th St. Speaking at the meeting were: Nancy L. Ross, 100 N. E. 110th St., opposed. Robert McKinney, 145 N. E. 110th St., doesn't hear any of the disturbances reported. Ms. Bialy, 10286 N. W. 1st Ave., was in favor of the license as she stated the only place in Miami Shores where you could get a drink was at the dog track and the Country Club. Virginia Russo, 168 N. W. 111th St., opposed. Ellen Gatti, 37 N. W. 110th St., opposed. John J. Higgins, 24 N. E. 111th St., mentioned dis :' bances that neither our Police Dept. or college security were taking care of. George Kelly, 138 N. E. 111th St., stated that a liquor license would depreciate property values on N. E. 111th St. Tom Brugger, 160 N. E. 111th St., vehemently against this proposal. James Kilmire, 240 N. E. 114th St., ( stated that he worked at the College and is in favor of a bar. Everett Kolby, 307 N. E. 95th St., stated that he is a Trustee of the College and is in favor of this request. Julia Soto, 10 N. W. 110th St., opposed to the sale of beer and wine, anrtc added- that -it would not be good for the foreign students who were sent to Barry as a finishing school for young ladies. r;� 11/19/81 -3- Clara , 18 N. W. 110th St., spoke for the College's request. Terry , 160 N. E. 111th St., complained about debris and cans strewn on 111,th St., noise and distrubances from the dormitories. Offered other suggestions for socializing than drinking. Brewer Dixon, 86 N. E. 111th St., stated there is no longer a curfew at Barry, and suggested that Barry make some concessions, as a one o'clock curfew, and put some control on mufflers of cars that park on the outside of the wall along 111th Street. A student living at 990 N. E. 92nd St., stated this license wouldn't make much difference as there is now drinking on campus. Donald P. Roberts, 11028 N. W. 2nd Ave., was concerned about the zoning on the vacant property owned by the College. Ann Vigneron, 73 N. E. 110th St., stated the request for a change of use on the S-1 College property would affect the 40 acres west of Miami Ave. as well as the improved property, and would give a special zoning use to college/residential property that has been denied business property for over 30 years, which could weaken our zoning. Donald McKinnon, 178 N. E. 111th St., asked what Barry is doing or could do for the residents across the street. Sal Shortino, senior at Barry, spoke on behalf of the College. Following all comments from the audience the Planning Board was given an opportunity to speak: Mr. Cutch.ens stated that only two people who spoke in favor are not connected with the College. Mrs. Johnson asked about the hours of operation which Mr. Czerniec stated are not definite at this time. Mr. O'Connor stated that the Board has been deprived of reports from our Village Attorney and the Chief of Police; that he felt this license should be in the Village and not in the County (as suggested by others), that he isn't moved by the specter of litigation resulting from special use, that the responsibility of the students will make or break it, and that the operating hours were no issue. Chairman Stobs pointed out that these facilities existed at other universities, and that the noise and trash was no issue. Mr. O'Connor then moved that the Planning & Zoning Board recommend to the Village Council that Section 501 of the Zoning Ordinance be amended to • • 11/19/81 -4- include the S-1 District, accompanying that recommendation that it is the Board's intention, within legal perimeters, that this apply only to the improved college property and not to the vacant property or any change of ownership. The motion was seconded by Mrs. Johnson and carried 3/2 with Mr. Cutchens and Mr. Palmer dissenting The Chairman announced that this recommendation would be before the Village Council on December 15, 1981.
