PLANNING AND ZONING BOARD MEETING
August 13, 1981
A regular meeting of the Miami Shores Planning & Zoning Board was
held at 7:30 p.m., August 13, 1981, at the Miami Shores Village Hall, with
the following members present:
Mrs. Roberta Johnson
J. S. Palmer
Kevin P. O'Connor
Kenneth Cutchens
Absent: J. Robert Stobs, Chairman
Mr. Frank Lien, Building Director and Code Enforcement Officer,
was also present.
In the absence of Chairman Stobs, Mrs. Johnson was asked to conduct
the meeting.
Minutes of the meeting of July 23, 1981 were approved by motion
made by Mr. Palmer, seconded by Mr. O'Connor and carried.
(1) Approval of plans for a gazebo, requested by
owner, Akos Aczel, 142 N. W. 103rd St.
It was brought out that this type of structure is not
specifically covered in the Zoning Ordinance, that the construction as
shown would not meet South Florida building standards and the thatched
roof is not permitted under our code. The Board suggested that the
application be withdrawn and the plan redesigned to meet all requirements.
Mr. Aczel withdrew the application.
(2) Request for approval of plans for flat roof addition, owner -
W. Russell Morris, 1175 N. E. 105th St.
Mr. LuBien reported that the proposed flat roof section would
be 47 sq. ft. over the permitted allowance. Since it appeared that the
addition could not reasonably be made to comply, Mr. O'Connor moved that
the Board approved the granting of a variance for this flat roof addition,
based on Section 702 (c), of the Zoning Ordinance. The motion was seconded
by Mr. Cutchens and passed unanimously.
(3) Request for approval of plans for alteration of offices
at 9315 Park Drive, owner - Sam Bienstock.
Mr. Bienstock stated that he is completing the remodeling of
offices at 9315 Park Drive and that he has no tenant at the present time.
After review of the parking Mr. O'Connor moved approval of the alterations.
The motion was seconded by Mr. Cutchens and passed unanimously. Mr. O'Connor
added that under the proposed new parking ordinance tkre ,_pl4ri complies with.

parking requirements and that he had considered this in passing on the
application. This is to go to Council.
(4) Request for approval of plans for carport enclosure
by owner, John Prendergast,712 N. E. 95th St.
Mr. LuBien reported that Mr. Prendergast had enclosed a
carport with wood frame, without a permit. Mr. Prendergast's attorney
petitioned for a variance under section 702 (d) re harmony with the neighbor-
hood. As wood frame construction is not permitted in our Zoning Code
Mr. Cutchens moved that the request be denied. The motion was seconded
by Mr. O'Connor for discussion. Upon vote the motion to deny was carried
unanimously.
Dr. S. Lowry Camp, a neighbor of Mr. Prendergast, informed
the Board that he had no objection to the aesthetics of the building as it
exists.
The meeting adjourned at 8:10 p.m.
