12-11-1980 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING December 11, 1980 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7:30 p.m., December 11, 1980, at the Village Hall, with the follow- ing members present: Mr. J. Robert Stobs, Chairman Mrs. Roberta Johnson Mr. J. S. Palmer Mr. Kevin p. O'Connor Mr. Kenneth Cutchens Mr. Frank LuBien, Building Director, was also present. Minutes of the meeting of November 13, 1980 were approved as written by motion made by Mrs. Johnson, seconded by Mr. Palmer and carried. (1) Mr. Ed. Mitchell, 10600 N. E. 10th Court, requesting approval to construct wood deck in side setback. This item wascarried over from the November 13th meeting at which there was a tie vote. Mr. LuBien reported that this deck is approxi- mately 2 ft. above grade at the highest point and appears to be a porch con- structed of wood which he would define as a structure which is not permitted in the setback. After discussing the purposes of the deck, as well as,. attempting to assist Mr. Mitchell to bring it in conformity without arriving at an acceptable solution, Mr. Palmer moved that the request be denied. The motion was seconded by Mr. Cutchens and carried unanimously. (2) Mr. Bill Heffernan, 161 N. E. 106th St., requested approval of flat roof addition and frame stucco construction. This home has both pitched and flat roof areas. The new addition of 85 sq. feet would be tied into a flat roof which is already in excess of the 15% allowed by Ord. 403-78. The Board was in agreement that there was no practical way to put a pitched roof on this addition. After discussion Mrs. Johnson moved approval of a variance to permit the flat roof addition of 85 sq. ft., since there is no other practial way to roof this addition due to "peculiar and unusual physical conditions" (Sec. 702, Zoning Ordinance). The motion was seconded by Mr. Palmer and carried unanimously. The wood frame construction was denied by motion made by Mrs. Johnson, seconded by Mr. Palmer and passed unanimously. (3) Mr. Joseph Velez, 75 N. E. 104th St., building without permit carport in setback. A non -conforming three -car garage was demolished at the above address & rebuilt as a flat roof carport with a non -conforming setback of 6.15 ft. Mr. LuBien reported that there was no problem with the flat roof as the remainder of the house has a flat roof. Mr. O'Connor moved that the 12/11/80 -2- request for a setback variance be denied. The motion was seconded by Mrs. Johnson and carried unanimously. A flat roof carport with the proper setback was approved by motion made by Mrs. Johnson, seconded by Mr. O'Connors and carried 4/1 with Mr. Cutchens. This was approved on the basis that it matches the existing house as to aesthetics and harmony. (4) Mr. John Lauri, 268 N. E. 102nd St., requesting approval of a flat roof addition. This plan was for a flat roof addition to a flat roof house. As this was the only practical way to roof an addition, it was approved by motion made by Mr. Palmer, seconded by Mr. O'Connor and carried unanimously. (5) Plans for new residence at 10055 Biscayne Blvd., with flat roof porch, owner N. V. Knoxvest. The flat roof porch did not exceed the 15% allowed. (6) Plans for new residence at 9959 Biscayne Blvd., with flat roof porch, owner - N. V. Knoxvest. The flat roof porch did not exceed the 15% roof area. Mrs. John moved that items (5) & (6) be denied because the roof ordinance applies to existing structures. The motion died for lack of a second. Both plans were then approved by motion made by Mr. O'Connor, seconded by Mr. Cutchens and passed 4/1 with Mrs. Johnson dissenting. (7) Plans for new residence presented by Harolld Bader, Homes America Construction Corp. for a portion of Lot 12, Block 76, Miami Shores Sub. Permit to build on this lot was approved by the Board 8/28/80 as an undersized lot of 7182 sq. ft. The plan presented did not meet either sideyard setback. Mr. Cutchens moved that the plan as presented be denied. The motion was seconded by Mrs. Johnson and passed unanimously. (8) Plans for addition and alterations to home of David A. McKibbin, 858 N. E. 97th St. The plan called for a flat roof to match existing flat roof on residence, a frame and stucco exterior wall and wood paneling on front exterior. After discussion Mr. O'Connor approval with modification of frame construction to CBS, that the flat roof is in harmony with the existing building and that the wood as used is decorative. The motion was seconded by Mrs. Johnson and passed unanimously. Mr. LuBien brought up the problem of vans and trucks being parked at residences which is not adequately covered in the zoning ordinance. This subject is being studied by the Board. Minutes of the meeting of October 23, 1980, were approved as written by motion made by Mr. Palmer, seconded by Mr. Cutchens and carried. (1) REQUEST BY MR. ED MITCHELL, 10600 N. E. 10th Ct. FOR APPROVAL TO CONSTRUCT A WOOD DECK IN THE SIDE SETBACK. It was reported that this construction had been started and consisted of a wood deck attached to the house and extending to the side lot line. Its elevation was approximately 1-1/2 ft. at the highest point and 6 inches at the low, due to an irregular ground level. Mr. Mitchell argued that this should be considered the same as a patio deck and that it looked better than a slab on the ground. Mr. LuBien pointed out that it falls in the definition of a structure which is not permitted in the setback. After further discussion Mr. Cutchens moved that it be denied as to its architectural and structural effect. The motion was seconded by Mr. Palmer but failed to carry on a 2/2 vote. This will be reviewed again when there is a full Board present. (2) ALTERATIONS AND REMODELING OF BISCAYNE FEDERAL OFFICE at 9033 BISCAYNE BLVD. Plans were presented by Mr. LuBien for remodeling the inside of the office at 9033 Biscayne Blvd., with a new front elevation. These plans were approved as presented by motion made by Mr. Palmer, seconded by Mr. O'Connor and passed unanimously. (3) REQUEST BY JOHN MAYO, 1275 N. E. 93rd St., TO CONSTRUCT WOOD DECK FOR POOL PATIO. This deck conformed at to setbacks and the wood material permitted as in the use of wood trim. Mr. Palmer moved approval of the pool deck. The motion was seconded by Mr. Cutchens and passed unanimously. It was requested that the use of wood for pool patios be included in the proposed zoning ordinance on wood trellises.. 11/13/80 -2- (4) RE -ROOFING HOME OF ALEXANDER ORR, 9431 N.E. 9th AVE. WITH CEDAR SHAKES. Use of non -tile material is approved on re -roofing based on structural limitations. A letter was presented from the Engineering firm of H. J. Ross Associates stating that the roof structural system could not support concrete tile. The proposed Cedar Shakes were approved by motion made by Mr. Palmer, seconded by Mr. O'Connor and passed unanimously. 4110 Mr. LuBien listed some areas that should be reviewed by the Board to eliminate problems he has encountered: (a) Number of vehicles permitted on property, required space and permitted parking areas. (b) Requiring fences to put framework on inside. (c) Commercial vehicles, definition and where permitted. Mr. O'Connor stated he would work on an ordinance for vans, and trucks and parking areas. The next meeting was set for December 11, 1980, due to the Thanksgiving holiday. The meeting adjourned at 8:35 p.m. Village C)rk Approved:
