10-09-1980 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING October 9, 1980 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7:30 p.m., October 9, 1980, at the Village Hall, with the following members present: Mr. J. Robert Stobs, Chairman Mr. Albert Toussaint Mrs. Robert Johnson Mr. J. S. Palmer Prior to seating of the new Board, minutes of the meeting of September 25, 1980, were approved as written by motion made by Mr. Palmer, seconded by Mr. Toussaint and passed. Mr. Toussaint then left the meeting and the following new Board members were introduced: Mr. Kevin P. O'Connor Mr. Kenneth Cutchens Mr. Frank LUBien, Public Works Director, was also present. (1) Request by Dr. Bruce Majilton, 453 N. E. 99th St. to convert a detached garage into a game room with bath. At the first meeting that this was presented no action was taken on approval as a result of a tie vote, and it was deferred until this meeting in anticipation of a full Board being present. The plans for making the garage into a recreation room were reviewed in light of the zoning regulations dealing with use of accessory buildings. Mrs. Johnson made two motions for approval without the shower, which failed to receive a second. Mr. Stobs relinquished the chair and moved that the request for the bathroom portion of the addition be denied. The motion was seconded by Mr. O'Connor and passed 4/1 with Mrs. Johnson dissenting. (2) Request for approval of radio transmitter antenna by the owner of the tower, Roger Pollock, 428 N. E. 91st St. This was brought before the Board following complaints received on the height and size of the radio tower. A petition was pre- sented to the Board signed by 22 neighbors objecting to the tower. Sub- sequent to receipt of the petition a letter was received from the owner of the building stating that the tower would be removed by the weekend of Oct. 11-12, which eliminated action by the Board. (3) Request for variance on setback in converting a garage at 900 N. E. 97th St. This was brought before the Board because a baywindow planned for the converted garage protruded into the rear setback, In 10/9/80 -2- reviewing the plot plan for this irregularly shaped lot, it was noted that special setbacks had been provided. Discussion followed as to whether this made the house non -conforming or merely the setbacks. Action was delayed until the next meeting pending advice from the Village Attorney.
