08-28-1980 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING August 28, 1980 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7:30 p.m., August 28, 1980, at the Village Hall, with the following members present: Mr. J. Robert Stobs, Chairman Mr. Gordon H. Moyer, Jr. Mr. Albert R. Toussaint Mrs. Roberta Johnson Mr. J. S. Palmer Mr. Frank LuBien, Public Works Director, was also present. A correction was made on Page 2. of the minutes of August 14, 1980, in the last sentence of the regulations on trellises, arbors, etc., changing the word "normal" to "nominal". The minutes were then approved as corrected by motion made by Mrs. Johnson, seconded by Mr. Moyer and carried. (1) Remodeling of Wiener/Vadas residence, 10166 N. E. 12th Ave. Architect Franklin Grau presented a plan for remodeling the home at 10166 N. E. 12th Ave., which included removing the mansard roof and adding a small cedar trellis along a portion of the front facade.. As there was no provision in the Zoning Ordinance for this type of trellis, the Board had recently approved regulations covering same for writing of an ordinance, Mrs. Johnson moved that a variance be granted in lieu of the upcoming ordinance on trellises. The motion was seconded by Mr. Moyer and passed unanimously.. (2) Request by Presbyterian Church to close a portion of Park Drive to thru traffic. A plan was presented through a letter from Rev. Timothy Croft to the Village Manager, as well as a report from Dade Co., Traffic & Trans, portation Dept., for the blocking off of Park Drive at 95th St., as a safety measure for persons using the Presbyterian Church facilities. After hearing a presentation by Mr. Miles Moss of the Dade Co. Traffic & Transportation. Dept,, and arguments against the plan by Dr. Soutar, one of the owners of property in the area, the Board agreed to call a public hearing for this purpose, This hearing was set for Thursday, October 9, 1980, 730 p.m, at the Community Center. The Board also requested that the property owners on Park Drive and N, E. 6th Ave. receive: notification of the hearing, as well as the Village at large through the Newsletter. 8/28/80 -2- (3) Request for a pool setback variance by Dominic and Kathryn Giacoboni, 1044 N. E. 97th St. This plan required a 22 ft. variance on the side yard setback of the pool. Since the sketch that was presented did not include dimensions the Board could not identify exact location or whether the pool complied with the Building Code on distance from a septic tank. Mr. LuBien was asked to check this. Because the Board felt this pool may have to be, or could be, relocated Mr. Toussaint moved that the request be denied. The motion was seconded by Mrs. Johnson and passed 4/1 with Mr. Moyer dissenting. (4) Request by Mr. & Mrs. Oliver Darmanin, 761 Grand Concourse, to enclose a carport. It was reported that the carport at the above address was being enclosed. The only question that the Board considered was the overhead wood beam which will become part of the enclosed room. After review of the plan Mr. Palmer moved that it be approved provided the wood beam will be made fire proof. The motion was seconded by Mrs. Johnson and passed unanimously. (5) Request for permit to build on Lot 12, Block 76, Miami Shores Sec. #3, by Homes America Corp.. This lot is located on Biscayne Blvd. at the southeast corner of 96th Street and includes all of Lot 12 and a portion of Lot 13 with a 75 ft. frontage and a net area of 7,182 sq. ft. A Waiver of Plat had been approved for relocation of the original lot lines of Lots 12 and 13, on Oct. 4, 1974 for Mr. Vasquez. Mr. Toussaint moved that variance be granted to allow this lot to be built on with the hardship being that there is no way the lot can be increased, subject to a Waiver of Plat if this is required by Dade County. The motion was seconded by Mrs. Johnson and passed unanimously. (6) Approval of plans for new home with second floor Terraces, wood railinand wood trim, for Lot 1 Block 75, Miami Shores Sub. This lot is located at the southwest corner of Biscayne Blvd., and 96th Street, owner R Manuel Rodriguez. In reviewing this plan the Board determined that the flat roof sections were in excess of the roofing ordinance and visible from a street side. Mr. Rodriguez was requested to have his architect contact the Building Inspector for our roof regulations. The plan was referred back to the architect. (7) Plans for alterations at the Biscayne Kennel Club. Plans were submitted by William Bradford, architect/engineer, for the construction of a new enclosure to hold dogs prior to the races. After review of the plan it was approved by motion made by Mr. Palmer, seconded by Mrs. Johnson and carried unanimously. (8) 8/28/80 -3- Fred Astaire Dance Studio. Although this was not on the agenda Mr. LuBien reported that he had issued a permit for remodeling a portion of the Biscayne Cafeteria building on N. E. 2nd Ave. at 99th St. The Planning Board did not review the plans since the construction was well underway. The problem was in the issuance of a license since "Dance Halls" are prohibited in all districts. It was reported by the Village Clerk that Mr. Ackley had received an application for this license from the operator of the dance studio but approval was denied on the zoning issue and an appeal has been made which will be on the Council agenda for a determination. Consideration of other plans for remodeling the remainder of the building plus an addition was denied pending proper presentation.
