07-24-1980 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING July 24, 1980 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7:30 p.m., July 24, 1980, at the Village Hall, with the following members present: Mr. J. Robert Stobs, Chairman Mr. Gordon H. Moyer, Jr. Mr. Albert R. Toussaint Mrs. Roberta Johnson Absent: Mr. J. S. Palmer Mr. Frank LuBien, Public Works Director, was also present. Minutes of the meeting of July 10, 1980, were approved as written by motion made by Mrs. Johnson, seconded by Mr. Moyer and carried. (1) Approval of architectural design of home for 25 N. E. 101st St. At the last meeting, the Board requested that the neighbors be contacted to review the design of this home, as to its harmony with other homes in the neighborhood. The following people voiced objections to: the two stories, three bedrooms, parking, garage on the alley, size of house on a 50 ft. lot, and incongruous with the neighborhood: E. F. E. 101st St. Mr. Moyer moved that the Board recommend to the Council that the overall plan be denied because it is not harmonious with the neighborhood. Motion died for lack of a second. Mrs. Johnson then moved that the architectural design of the home be approved as presented since it conforms to all setbacks and that there are no limitations on a second story. The motion was seconded by Mr. Toussaint but failed to carry on a 2/2 vote. It was requested that this be resubmitted at the meeting of August 14, when a full Board will be present. (2) Request for additional directional signs for Tony Roma Drive-in restaurant. A representative of the architectural firm of James E. Vensel Associates, was present to explain the request for additional signs 7/24/80 -2- being necessitated by actual use to expedite the drive thru traffic. After reviewing the plan Mrs. Johnson moved, in the interest of safety, that sign 1, 2, and 4 be permitted and that if the previously approved red & green sign is not being used, that it be removed. The motion was seconded by Mr. Moyer and passed unanimously. (3) Alteration of garage by Dean R. Claussen, at 9820 N. E. 5th Ave. Rd. Mr. Claussen's plans were reviewed for altering the garage,originally built to house a boat, back to a garage and storage loft. Mrs. Johnson moved that the proposed alteration of the garage be approved. The motion was seconded by Mr. Toussaint and passed unanimously. (4) Architectural design of Vazguez homes on east side of N. E. 2nd Ave. between 101st & 102nd Sts., regarding use of wood trim. The Board reviewed these plans and ascertained that the wood was applied over the CBS construction. Upon motion by Mr. Moyer, seconded by Mrs. Johnson and carried, approval was given for this design on wood. (5) Trellis regulations - Automobile repairs in residential zones - The first item discussed was an ordinance to prohibit parking for certain purposes in R -zones, as proposed by Chairman Stobs. After refining the wording Mr. Toussaint moved that the following be sent to the Village Attorney for preparation of an ordinance. The motion was seconded by Mrs. Johnson and carried. AN ORDINANCE TO PROHIBIT PARKING FOR CERTAIN PURPOSES IN R -ZONES. No person shall have a vehicle in other than an enclosed garage in an R -Zone for the principal purpose of: (a) Displaying such vehicle for sale, (b) Painting, greasing or repairing such vehicle except repairs necessitated by an emergency.. (c) Displaying advertising. (d) Selling merchandise from such vehicles except in a duly established market place or when so authorized or licensed under this code or other ordinances of the Village. (e) Storage or as junkage or dead storage for more than 24 hours. Arbor/trellis regulations were given to the Board for review and discussion at the next meeting. (6) Flat roof addition - Geo. LeVasser, 96 N. E. 99th St. Mr. LeVasser re -submitted his plan for a flat roof 7/24/80 -3- addition after having revised it to meet the code. Mr. Toussaint moved approval as it meets the requirements. The motion was seconded by Mrs. Johnson and carried unanimously. (7) Letter from George M. Deacon, 10025 N. E. 5th Ave. A letter was received from Mr. Deacon following his receipt of a Notice of Violation for maintaining an unsightly canvas awning carport, asking for certain considerations.
