06-26-1980 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING June 26, 1980 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7:30 p.m., June 26, 1980, at the Village Hall, with the following members present: Mr. J. Robert Stobs, Chairman Mr. Albert R. Toussaint Mrs. Roberta Johnson Mr. J. S. Palmer Absent: Mr. Gordon H. Moyer, Jr. Mr. Frank LuBien, Public Works Director, was also present. Minutes of the meeting of June 12, 1980, were approved as written by motion made by Mr. Palmer, seconded by Mrs. Johnson and carried. (1) Request for zoning variance on height of fence by owner, Daniel J. Lapadula, 9701 N. E. 3rd Ave. Mr. LaPadula had received a Zoning Violation Notice for the erection of a 3 ft. wood section of fencing on top of an existing C.B.S. 5 ft. wall. No plans had been submitted with the application for remodeling which did not specify changing the fence. Mr. LaPadula presented a petition signed by his neighbors attesting to the fact that they did not object to this fence. Mr. LaPadula argued that this fence was required to provide the privacy he needed around his patio and that it enhanced his property. In the discussion that followed Mr. Toussaint pointed out that the hardship was self-imposed by the construction of the patio in its present location, that there were no plans filed and that the permit did not indicate a fence addition. Mr. Toussaint moved that the request for variance be denied. The motion was seconded by Mrs. John and passed unanimously. (2) Request for zoning variance on height of fence by owner, Robert M. Baron, 468 N. E. 100th St. Mr. Baron had received Notice of Violation for the construction of a lattice wood section on top of a concrete wall, creating a 7 ft. fence. No permit was secured for this fence. Mr. Baron argued that he needed this privacy around his pool area from children traffic and automobile traffic. He further contended he was being discriminated against as we were not uniformly enforcing regulations on fence height. Mr. Baron presented pictures of 18 other fences which he claimed were violating the height limit. After discussion Mr. Toussaint moved that the request be denied. The motion was seconded by Mrs. Johnson and passed unanimously. (3) A permit was requested by Dr. Jerry Zelman, 1410 N. E. 103rd St., to convert his garage to a family and laundry room. The Board reviewed the plan with regard to parking area and 1 • 1 6/26/80 -2- and outside doors. Mr. LuBien was asked to check the Building Code for any restriction on the number of outside doors. The plan was approved by motion made by Mrs. Johnson, seconded by Mr. Palmer and passed unanimously. The meeting adjourned at 9:30 p.m.
