02-14-1980 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING February 14, 1980 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7:30 p.m., February 14, 1980, at the Village Hall, with the following members present: Mr. J. Robert Stobs, Chairman Mr. Albert R. Toussaint Mr. Gordon H. Moyer, Jr. Mrs. Roberta Johnson Mr. J. S. Palmer Absent: None Mr. Frank LuBien, Public Works Director, was also present. (1) The minutes of the meeting of January 24, 1980 were corrected by adding the word "wall" on the second page following ''5 ft." and then approved as corrected by motion made by Mr. Moyer, seconded by Mr. Toussaint and passed. (2) Waiver of Plat - Lot 4, Block 75, Miami Shores Subdivision. A Waiver of Plat was presented for Lot 4, Block 75 (northwest corner of 95th St. and Biscayne Blvd.) to permit building on a lot that had been diminished by a previous waiver increasing the abutting Lot 3 to create a building site on that lot while maintaining sufficient area in Lot 4 for a building site (9147 sq. ft.). Planning Board approval was given by motion made by Mr. Toussaint, seconded by Mrs. Johnson and passed unanimously. (3) Request for variance on pool setback at 775 N. E. 97th St. A request was made by Action Pool Builders, Inc., to construct a pool at the above address maintaining an 82 ft. side setback instead of the required 122 ft. setback. In reviewing this plan it was noted that a 4 ft. variance would be needed on the pool and a 42 ft. variance on the patio deck. Mrs. Johnson moved that the request be denied. The motion was seconded by Mr. Toussaint and passed unanimously. (4) Request for variance to construct flat roof addition which exceeds 15% limit, at home of Mr. & Mrs. P. G. Hewitt, 1391 N. E. 102nd St. In reviewing this plan the roof area was refigured and the overage amounted to only 24 sq. ft. With this knowledge the petitioners withdrew the request to attempt to meet the requirement without a variance. (5) Request for approval to change roof from tile to built-up gravel on a portion of the roof area at the home of Clover B. Apelian, 124 N. E. 96th St. After reviewing the engineer's report it was ascertained that the portion of roof under consideration could not be re -tiled per Village and South Florida Building Code because it did not meet the required pitch. Mr. Toussaint moved that based on Ordinance #403-78, paragraph 4.(f), "All 2/14/80 -2- roofs having an incline of less than 22 inches per foot shall be constructed of built-up roofing material ", that the request be approved. The motion was seconded by Mrs. Johnson and passed unanimously. (6) Request for approval to allow a tree house at remain at 1235 N. E. 96th St., home of Mr. & Mrs. Robert F. Williamson, Jr. Mrs. Julie Williamson reported that the vertical walls had been removed and there now existed only a platform. In the discussion that followed it was pointed out that there were two levels. At the Planning Board's request Mrs. Williamson agreed to remove everything but the lower level platform. Mr. LuBien cautioned that any building in the setback was a violation and that if the neighbor pursued the nuisance complaint, further steps would have to be taken. (7) Request by J. H. Miller, 1130 N. E. 104th St. for variance to use a wooden beam in place of a concrete lentil. This request was tabled at the last meeting pending an inspection of the present structure and a report by Mr. LuBien, who reported that the existing work that had been done was according to Code. After a review of the proposed construction the Board approved revision of the wood beam providing details are prepared by a professional engineer or architect. (8) Request by George P. Cunningham, 130 N. W. 97th St., to place a wooden fence across front of house. After a review of the proposal Mr. Toussaint moved that it be denied because it does not comply with the Zoning Ordinance, Section 518, (a) and (b). The motion was seconded by Mrs. Johnson and passed unanimously. Discussion - roof ordinance: Chairman Stobs introduced a discussion of the 15% limitation on flat roof additions which the Council had requested the Board to review. Mr. Toussaint moved that the Board recommend an amendment to the ordinance to allow a maximum of 300 sq. ft. or 15%, whichever is the greater. The motion was seconded by Mr. Palmer and passed unanimously. The Board also discussed visibility of flat roofs on a corner lot and agreed to leave the ordinance as it is on this point. Public hearing - February 28th on the minimum housing standards.. Mr. Stobs reported that the school ordinance is being written by the Village Attorney and if it is available it can be reviewed on Feb, 28th. Mr. Palmer reported violations as follows: trucks at 10418 N, E, 2nd Ave., truck on right-of-way extending into street at 360 N. E. 105th St.,, and "Sold" sign at 535 N.
